On September 20, 2005, and again on November 17, 2005, the Division of Water Quality
Stormwater Permitting Unit received your Notice of Intent (NOI) to be covered under North
Carolina's general permit NCG140000, and supporting information, all submitted for your facility
located at 195 APAC Street in Winston-Salem. Your submittal contained a check for $80, one NOI
form, a single page of calculations, a site location map, vendor information for a pH control unit,
and two site layout drawings by Chas. H. Sells, Inc., consulting engineers. In addition, in
September 2007, DWQ received a second submittal package, including another NOI, a check for
$80, a site location map, and an 11"x17" site plan by Trigon Engineering Consultants. The two
submittals are significantly deficient, and we are returning them unprocessed.
I apologize for the lengthy delay on my desk. You reported to me recently that you had not
received my letter of March 17, 2006 requesting additional information on the submittal.
The submittal is deficient in the following particulars.
1. Inadequate design basis. You have applied for a permit to discharge stormwater and
wastewater under our general permit NCG140000. North Carolina rules require DWQ to
conduct an engineering review of your application. Briefly, our key design basis criteria for
review of your submittals are: Does the application include engineering calculations that
predict compliance with the permit limits (i.e. TSS removal talcs, Settleable Solids removal
talcs, pH correction narrative) for wastewater discharges; or else, does the application
include water balance calculations that show that there will be no discharge of wastewaters
from the recycle system in response to the 25-year, 24-hour storm event? The two criteria
are stated in items 14 and 15 of the second NOI form that you submitted. The submittals
are not approvable in that neither is based on either of the two approvable design bases.
Note also that there is no design narrative that tells us specifically how the stormwater and
wastewater flows will be generated, collected, conveyed, treated, and discharged.'
2. Inadequate narrative, site plan, and engineering details. Please consider that as
reviewers, we are confused as to your intent as represented differently in the two different
submittals. Both site plans submitted in 2005 and 2007 show.a water recycle system, but
the 2007 submittal includes narrative text indicating that a recycle system is not

scontemplated. What are you asking us to permit? If you are not contemplating a recycle
system, what is the design basis for meeting permit limits on wastewater discharges?

If you are contemplating a recycle system, we must review engineering details (dimensions,
configuration, elevations) of the mixing drum wash pit in order to review the volume and
hydraulic operation of that structure.
Please ask your engineer to contact me for a more specific explanation of the submittal
requirements for this permit.

For new plant sites that will discharge or recycle process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to Construct (ATC) wastewater
treatment facilities. ATC requests must be submitted at least 90 days prior to construction'.
For existin plant sites discharging or recycling process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to continue to operate wastewater
treatment facilities in place. Construction, modification, or installation of any new treatment components
at an existing site requires an ATC.
Treatment facilities used to treat or recycle process wastewater (including stormwater 13MP strut[
treating process wastewater flows commingled with stormwater) require an ATC prior to construi
per 15A NCAC 2H .0138. The authorization to construct or continue to operate will be issued at
same time as the Certificate of Coverage (COC) for the NCG 14 permit. Design of treatment facil
mast comply with requirements of 15A NCAC 211 .0138 &.0139.
Construction of wastewater treatment facilities (this includes recycle systems) at new or existing pl
sites requires submission of three (3) sets of plans and specifications signed and sealed by a
Professional Engineer (P.E.) or qualified staff2 along with this application. A copy of the design
calculations should be included. Please see questions 14 & 15.

RECYCLE SYSTEM INFORMATION
Central Carolina Concrete plans to add a wash -water recycle system in the future at the`Winston Salem,
North Carolina facility at 195 Apache Drive. On our Notice of lntent, we have checked the box that states
we plan to add a recycle system in the future. However, we do not have the plans in place at this time.
When we have our plans for the recycle system developed, we will submit an Application to Construct
(ATC) with the required plans, calculations, and design specifications.

1 am writing this letter in response to the Notice of Violation letter you sent dated August
8, 2005.
As requested during our phone conversation on Wednesday, September 14, 2005, please
find enclosed a copy of the originally prepared Notice of Intent Application, which has
been submitted to Raleigh for the above referenced plant.
As you will note in our cover letter for the application, we deem the application
incomplete, as it does not include an engineered assessment or evaluation of our proposed
compliance plan. As 1 stated to you on the phone, we have engaged an independent
engineer to evaluate all of our sites, new and old, to review our operational practices,
control devices and stormwater plans to ensure that we arc in full compliance with all of
our activities.
As I indicated, the Division of Water Quality ("DWQ") and the ready mixed concrete
industry arc negotiating or collaborating oil addressing the perception that the industry is
not conducting its business in a compliant manner (reference the latest letter from the
Carolina Ready Mixed Concrete Association). 1 thought these specific recluireinents and
activities were what we were supposed to be pursuing to "report back" to the DWQ
through various upcoming me.etings, which are to be held in early October. Once these
meetings occurred, we were to submit plans and applications to your department to
address all non -compliant activities within all ofour operations providing; an explanation
Of duration and costs to implement those control processes identified by the independent
crigineer's assessment.

In addition, this _facility has maintained in active on -going National Pollutant Discharge
Elimination System (" NPDES") permit, which continues to be inspected. Enclosed 1S a
copy of tine actual active permit and the last inspection statement by Titre Garret of your
department on 7/19/05, which Stipulates "No Potential NPDES Permit Violations".
Based upon comments from DWQ personnel and since we arc completing tine engineered
review process, some of our control devices have not been completely implcnnentcd. Iior'
example, we have installed; calibrated and tested ph adjustment equipment which is
intended to "treat and recycle" process water, however, it is not intended to "treat acid
discharge" process water. Furthermore, the facility has a wash pit structure designed to
contain truck -cleaning chemicals, truck rinse down waters, and truck washout water.
Given our history within yOlir region the past six months, I fully appreciate and
understand if your offices have the perception that we are less than diligent in operating
Within the guidelines and requirements of the Department of Environment and Natural
Resources ("NCDENR"). Historically, our compliance process relied solely on the efforts
of one individual. Due to it medical condition, the duality of work by this individual was
drastically compromised and it took receiving "Notices of Violation" for air permit
compliance paperwork for inc to recognize the depth of the problem.
Since the middle of April 2005, 1 have sought out and met with attorneys, lobbyists, trade
association personnel, industry colleagues, and various NCDENR personnel to learn the
various regulatory compliance'requirements and review our compliance efforts.
During this review process of our compliance failures, I have instituted the following.
actions and changes within our organization:
1. No permits or applications may be submitted without the approval and
signaturC of a Company officer.
2. We arc creating it calendar to record the various-rcgulatory'requireiiiciits and
submittal dates for each plant facility.
3. 1 contacted Small Business Assistance Program+for hell} in learning all -of the
requirements and respective time lines to ensure that I am aware of our
compliance requirements.
4, 1 and adding an internal inspection checklist requirement to OEIr 111011thly plant
inspections at our facilities to coordinate the review of all safety,
environmental, and procedural operational issues to ensure ongoing
compliance.
5. 1 am also.creating a "new plant" facility checklist to ensure that all plant
facility permit applications are transmitted at the time we apply for building
permit'S.
6. 1 have participated within the industry discussion's surrolunding the DWQ's
white paper assessments, which were forwarded by our state association in
April 2005 of this year.

Based upon the path we were following, we should have the first draft repoi-t on our
compliance efforts by the independent engineer sotnetime late next week on several of
01.11- facilities, including the facility in Mocksville. i will be happy to share his findings
with you once 1 receive them and/or continue with our planned discussions with DWQ in
October.
If you will review my efforts over the last four months, you will find where I have self
reported violations by my Company pertaining to fuel issues and an- permit Issues to the
appropriate regional offices of NCDENR. As a result ofmy understanding and atternpted
compliance with what DWQ has communicated to our industry, 1 respectfully ask that .
your -office rescind the notice of violation and allow us to proceed with our meeting with
DWQ in early October within the frarn6vork that we have been operating under.

NARRATIVE:
The Concrete Supply site is located in the City of Winston-Salem, North Carolina.
The site was previously used as an asphalt production facility. The total disturbed
acreage for the proposed development is approximately 3.8 acres. The scope of
work includes clearing, stripping and grading for installation of a sediment basin,
installation of a diversion berm at the approximate edge of the gravel area,
and installation of silt fencing.
CONSTRUCTION SEQUENCE:
1. Obtain plan approval and permits prior to beginning work.
2. Flag the work limits to prevent unnecessary clearing.
3. Hold preconstruction meeting at least one week prior to starting construction.
4. Install temporary 6-inch thick gravel construction entrance.
5. Install silt fence, diversion berm and sediment basin, clearing only as necessary
to install these devices.
6. Strip site and properly dispose of debris.
7. Maintain erosion control devices as needed.
8. Grade site to proposed grades shown and install the proposed facilities.
9. Seed all disturbed areas in accordance with the seeding specifications.
10. Remove temporary erosion and sediment control measures after vegetation is
established on all disturbed areas.
MAINTENANCE PLAN:
The following maintenance plan shall be followed until the site is completely stabilized after
construction. During construction the Contractor shall be responsible for inspection and
maintenance of all erosion and sediment control measures.
1. All erosion control measures shall be checked for stability and operation following any
rainfall producing runoff and at least once every week. Any needed repairs shall be
made immediately so that all erosion control measures are maintained as designed.
2. All seeded areas will be fertilized, reseeded as necessary, and mulched in accordance
with the seeding specifications in order to maintain a dense vegetative cover.
3. Sediment deposits shall be removed from sediment fence after each storm event or
sediment fence should be replaced. They must be removed when deposits reach
approx. half the height of the barrier. Any sediment deposits remaining in place
after the sediment fence is removed shall be dressed to conform to the existing
grade, prepared and seeded.
4. The sediment basin shall be cleaned out when the level of sediment reaches the
mid -depth point below the weir elevation. Washed stone shall be cleaned or
replaced when the pool no longer drains properly.
5. Groundcover shall be provided on exposed slopes within 15 working days but no
more than 30 calendar days following completion of any phase of grading. Permanent
groundcover shall be established over all disturbed areas within 15 working days or no
more than 90 calendar days following completion of construction or development.

Just wanted to get back with you to let you know that we are in agreement with your
approach on this issue. I'm assuming that you are looking at both of the facilities
they submitted NOI's for the same way (Mocksville and Winston-Salem). In a couple
of situations in Raleigh and Asheville the regions wanted to take a little different
approach and issue the permits and require the facilities to get their wastewater
treatment process corrected within a certain period of time working with the
region. Their cases were different in my opinion because they were existing
facilities that had been in place and had ponds, etc. already in place but needed to
work on them to come into compliance. in the case of these facilities it appears
that they are both new facilities that should have dealt with the issues upfront.
Even though they are operating now, I would still consider them to be new since they
obviously knew about the requirements and even held their applications thinking some
process with the Concrete Association kept them from needing to apply for a permit
from us.
I currently have a call in to Bill Arnt with the Association to express our concerns
about the message that some of their producers feel they have gotten from the
Association or have made up themselves. I will also let Paul and Alan know a little
more about this situation in preparation for our meeting with the Association.

determine the level of enforcement we take. If they do not know how they are going
to handle the waste to be compliant then they should have not built the facility
till this was handled. Ignorance is not Bliss nor an excuse in my opinion.
Go ahead an visit the site (my suggestion is that Ken or Bethany go with you if
possible) and if not get Ab or Mike to go with you. See what they have (vehicle
maintenance, vehicle washing, drum cleaning , etc) so we will have a clue what the
should be doing.
With the limits these guys have and the cut offs, when you have only an annual
monitoring requirement, then they have nothing to complain about. If they were
smart (probably not the case) they would get the permit, do the monitoring, submit
the data and see if we ever look at it.
Bradley, Since we are treating the Ready Mix Concrete facilities different that
other GPs, I assume that we have sufficient data to show these facilities are a
threat to WQ and are having substantial impacts to streams?//
If not, why are we not handling these GPs the way we do the others, ie. with
qualitative monitoring and cutoffs?

I inspected Concrete Supply Company's new facility in Mocksville (Davie
County) in August. To make a long story short, I sent them an NOV for
operating without the proper permit (NCG140000), and now Henry Batten,
exec. vice president, has asked us to rescind the NOV in light of ongoing
negotiations with DWQ staff in Raleigh.
In this particular instance, Mr. Batten had asked Division of Land
Resources staff here to keep their construction general permit
(NCG010000) open, thinking that he would be covered by it until they
obtained NCG140000. They began operating in April, and have yet to
decide how they are going to handle stormwater and process wastewater.

They claim that no process waste is being discharged, that water from
wetting of raw material stockpiles is just being absorbed into the gravel
covering their entire site, and that there is no overflow from their
recycle system now.
I asked them to submit a Notice of Intent ASAP, not fully understanding
the nature of their ongoing negotiations with Raleigh DWQ staff.
As you can see, it would be helpful for WSRO staff, and probably other RO
staff too, to know some of the details regarding these negotiations with
Concrete Supply Company, The Carolinas Ready Mixed Concrete Association
(CRMCA).or other such facilities. In particular, the framework within
which the parties involved have agreed to, time frames involved, etc. we
would like to cooperate with you , so that we're not sending mixed
messages to the owners of these facilities.
Mr. Batten says it is his understanding that, after meeting with DWQ in
the Archdale building in early October, they are to "submit
plans/applications to address all non -compliant activities within all of
our operations, providing an explanation of duration and costs to
implement those control processes identified by the independent
engineer's assessment.'
Any info regarding this matter would help us in deciding how to proceed

Deficiencies in the submittals include failure to predict compliance with the permit
limits for TSS, settleable solids, and pH (upon closer review of the pH info
provided, I conclude that it's a beginning, but it's not adequate as it is without
additional supporting information.) I also want a site plan showing the locations of
the origins of wastewaters,and the location of stormwater discharges and recycle
system overflow discharges. If the owner or the engineer wants to contact me so that
I can go over what's required verbally, that will be fine. If they want to wait for
me to compose an additional information request letter, that's fine, too.
It's disturbing, just a little bit, that Mr. Batten reports that his engineer is
working on a revised submittal, and should have it ready this week, but I haven't yet
been contacted by the engineer to find out what DWQ believes will be sufficient.

Maybe we need to consider treating these type of permits as "minors" rather than
GPs. Since they have limits and are required monitoring in the permit. We could
treat these as we do other minors as far as compliance evaluations (we do all
minors annually) and if they are not compliant we could pursue enforcement. The
minimal annual monitoring makes it almost impossible to really judge compliance
and do anything constructive about the noncompliance. If these are a problem and
if we are really concerned ........ we need quarterly monitoring to have a clue as
to compliance.
If we are not going to do this........ and if these are not really
problems ........... then maybe we just need to treat as Stormwater GPs and have the
annual monitoring and cutoffs with no limits.
As structured, these permits are doing to be difficult to manage and ensure
compliance and ensure a straightforward and understandable permitting process.

Dear Mr. Pickle,
Thank you for taking,the time to -discuss the additional information needed to process our
permit application. We understand the department has altered is requirements for NOI
applications for.NCG140000 Stormwater permits seeking substantially more information
from the ready mix concrete industry than we have submitted in the past.
As discussed, we surveyed the wash pit structure last week and submitted the information
to`the engineering firm that developed -the site plan'. Based upon this survey, they are
developing an as -built site plan that will delineate the wash pit; stormwater.drainage
flow, and�Bmp's implemented to clarify stormwater runoff.
To expedite our supplemental submittal- information, I am in the process of drawing the,
wash pit_ with cross section elevations and calculating the design volume. Based upon. my
preliminary review; with slight modification I am confident that we can meet the 25-year
24-hour storm event criteria with this structure_
The raw material stockpiles at this facility are not graded to drain into the washpit during"
a storm event. These materials are washed at the quarry and -if needed irrigated with city
water. During a storm. event; water from this area is diverted into a sediment basin where,
it is filtered through a perforated" riser surrounded by stone. I am confident that pH," TSS -
and settleable solids will not be an issue from this source of water.

Just to let you know where we are on two submittals from Concrete Supply Company.
They re -submitted information for Mocksville and Winston-Salem to me on Novmeber 17,
2005. 1 have promised to continue and complete my review of Mocksville, and to begin
and complete my review of Winston-Salem within the next week, by Friday, March 17.
The most recent submittals are much closer to what I need to continue processing
them, but my brief review yesterday indicates that I will likely issue an additional
information request letter to Concrete Supply next Friday on a few remaining points.
I understand from Concrete Supply that they are holding up several additional
submittals until they hear back from me. That only makes sense, since there would be
an obvious advantage for them and me in having the benefit of my next review on
Mocksville and Winston-Salem before they finalize the next few NOIs. I will be in
contact with David Mock next week in advance of my additional information request to
discuss the points with him.

FYI, and in accordance with our promise date, these two add -info letters will go out
today to Henry Batten's engineer, David Mock, via email (already accomplished this
morning) and signed letter (presumably this afternoon by snail mail).
Add -info letter summary, Mocksville - Recycle system permittable as presented, but
the applicant's submittal does not predict permit compliance at the discharge point
for flows from aggregate storage and from batch plant washdown. KBP will continue
processing the permit application upon receipt of an engineering argument predicting
compliance with the permit limits for these two other wastewaters.

On September 20, 2005 and again on November 17, 2005, the Division of Water Quality,
Stormwater Permitting Unit received portions of your application for a permit to discharge under
NPDES General Permit NCG140000, a permit to discharge stormwater and wastewater, from the
subject ready mix concrete facility at 195 APAC Street, in Winston-Salem, North Carolina. I
apologize for my delay in responding to your submittals. Some portions of the submittal are
unclear to us, and we are requesting additional information in order to continue.processing your
application. Please submit additional information addressing the items listed below.
1. Notice of Intent (NOI) review
a. Item 13 of the NOI indicates that there are no discharges from the three wastewater
sources listed. However, based on my review of Sheet C-3 Erosion & Sediment
Control Plan, it appears that wastewater from the aggregate storage area will leave
the site through the remnant sediment basin at the northeast corner of the
developed portion of the property.
b. Similarly, it appears that flows that may be generated in the batch plant area will
flow overland to the same remnant sediment basin before discharge off site to the
north. Given the proximity of the batch plant equipment, we preliminarily conclude
that wash down and possibly other flows from the batch plant area would be
wastewaters. If so, then the discharge from the sediment basin is required to meet
TSS, settleable solids, and pH permit limits. It is not clear to us that either
substantiating calculations or explanatory narrative are presented to establish how
compliance with the permit limits will be obtained at the discharge from this basin.
Please provide an engineering argument that predicts compliance with the three
permit limits.
2. Calculations and Analytical Summary sheet review
a. The calculations appear to be based on a plant average production figure of 250 CY
per day. Rather than an average value, is there a reason to consider either a
maximum or minimum -production day as the critical condition with respect to the
likelihood of a discharge from the recycle system? We are interested in the hydraulic
capacity of the system under some selected nearly -worst -case scenario.
b. I'm uncertain as to the origin and eventual disposition of the waters contained in the
recycle system structure as presented in the calculation sheet. Please confirm or

correct my understanding of the water balance as I understand it from the
calculation sheet: .
i. On an average production day, slump adjustment water accounts for 25
gallons per trip reduction in the contained recycle system volume, amounting
to 781 gallons per day leaving the system. I assume that city water make-up
is added to replace the consumed slump adjustment water, and to maintain a
rinse water inventory in the recycle system. Do I understand this correctly?
ii. , I judge the calculation of Potential Future Rinse Down Water Consumption is
not relevant for a normal operating mode design scenario water balance. Do
I understand correctly that the "potential future" use relates to circumstances
in which recycle water would be directed to the batch plant as mix water, and
this would not be the normal ,mode of operation? And that the "potential
future" circumstances would not be the mode of operation at which the
greatest potential for recycle system discharge would occur?
iii. I note that the four -basin volume is reported as 27,922 gallons. However,
the submittal does not provide information on the volume contributed into the
recycle system by all contributing areas as a result of the 25-year, 24-hour
storm. Lacking this information, it is not possible for me to conclude that the
submittal shows that there will not be a discharge under the design
conditions.
iv. In our discussions yesterday on the Mocksville facility, you reported that the
two facilities (Mocksville and Winston-Salem) were similar. Does Winston-
Salem have the same provision to return excess accumulation back to the mix
plant as rnix water? From our review perspective such a provision means that
you will be able to re-establish the holding capacity in the recycle system
relatively quickly after a significant rain event.
v. Summarizing the'two immediately preceding points, it seems to me that the
recycle system design scenario described in your submittal is promising, but
the submittal is insufficient for me to concur that the calculations presented
indicate that there would not be a discharge from the recycle system in
response to the 25-year, 24-hour storm event. Please address this point with
additional engineering calculations or explanatory narrative.
vi. Do I understand correctly that there are no physical means constructed to
discharge from the recycle system to surface waters? Are there any bottom
drains from the recycle system, for example?
vii. Vendor information on an automated pH control system is part of your
submittal package. Does the system feature adjustable pH on -off set points
and automatic operation to maintain pH within the set point range?
3. Sheet C-3 Erosion & Sediment Control Plan review
a. As indicated in 1.a. and 1.b. above, wastewaters from the aggregate bins and the
dry batch plant will enter the remnant sediment basin. Wastewater discharge is via
an overflow spillway:
b. The submittal does not include an engineering argument in the form of engineering
calculations or in the form of explanatory narrative that predicts compliance with the
permit limits for this wastewater discharge. To re -iterate item 1.b. above, please
provide an engineering argument predicting compliance with the three numerical
permit limits.
c. Please make minor revisions to Sheet C-3 in the area of the recycle system to locate
the installed mechanical equipment (wash pump, transfer pump, pH control system),

and to locate the approximate routing of the "potential future" return lines to the
batch plant.
4. Do I understand correctly that aggregate irrigation will be accomplished either by city water
or by pH -corrected water from the recycle system?
5. Finally, please note that we need three copies of any re -submittal as noted on page 1 of 5
of the revised NOI (revised form attached.)

I wanted to update you on our progress thus far. We will be meeting with the F & R
tomorrow to finalize the six plans. We will also be meeting with the local
Mooresville office on Monday or Tuesday prior to submitting the drawings to you.
once that is complete, I will forward the six sets to you for your review.
We will then begin five more plants to include our North, West, Mocksville,
Winston-Salem, and Concord plants. These should be completed from an engineering

On July 31, 2007 the North Carolina General Assembly and Governor Easley put into effect a new budget
that included a 20% increase to all fees associated with Division of Water Quality annual fees, new permit
applications, permit modifications, certifications, and project fees. S100 is the new permit application fee,
instead of the former $80 application fee for General Stormwater permits.
The Division of Water Quality attempts to operate in a fiscally responsible and efficient manner. This
increase represents the first change in fees since 1999 and reflects inflationary pressures over that time.
As of September 1, 2007, all permit fees collected must meet the legal requirements of these changes.

today. Here's the short history and status:
8/8/05 - NOV from WS for discharging w/o a permit
9/20/05 - Stormwater Permitting Unit (SPU) receives NOI from CCC.
9/20 - 9/28 - WSRO and KBP emails exchange concurring: No permit until they submit
adequate info.
11/17/05 - CCC submits single page of calcs as a follow up to the NOT.
3/17/06 - SPU sends additional information request letter
6/30/06 - SPU mtg with Henry Batten to clarify requirements on all sites, including
CCC.
9/5/06 CCC email to KBP with update on progress
9/11/07 - SPU receives another NOI - - apparently some confusion, since another NOI
is not necessary. The new NOI does not address the specifics of the 3/17/06 add -info
letter.
1/14/08 - KBP calls for Loren Wild; left a voice message; email message to follow
today.
As far as I can tell from the file, this facility has submitted the NOI; they have
not provided a substantive response to the 3/17/06 Add -Info letter; and, they are
still without a permit. I will email Loren today to see what they are confused
about.

Thanks, that's great. I'll be available this week: Tuesday after 11.:00; Wednesday
except for 1:00-2:00; Thursday all day; Friday morning.
I've also picked up the Mocksville file. It looks like I have similar confusion
about Mocksville, too. My files show the following progression and status, similar to
WS:.
a) I received the first NOT submittal 9/20/05, with a follow-up submittal of talcs,
drawings, and lab reports on 11/17/05.
b) My 3/17/06 letter requesting additional information.
c) On 8/16/07 we received the confusing submittal of a second, unnecessary NOT for
this facility.
d) And again, I still can't tell how this facility intends to insure that the
wastewater discharges are within permit limits. From my files it appears that the
site is discharging wastewater and stormwater without a permit, and I'm not sure what
progress, if any, is underway.
Let's cover both Mocksville and Winston-Salem in our conversation later this week.

Here are my two letters of March 17, 2006 on the Mocksville and WS
submittals. Essentially, I've been waiting for responses to these letters.
As we discussed today, at this point in time the most productive thing might
be for me to provide a current review of the Trigon submittals. So, please
don't initiate a response to the questions in the March 2006 letters, which
were based on the engineering packages provided by Grey Engineering
(Mocksville)" and Chas. H. Sells, Inc. (WS).
The original submittals are still live applications ,in our office, so the
additional NOI forms and checks are not necessary. The two checks (from
Concrete Supply Company to the Division of Air Quality (?), #64800,
9/17/07, $100, for WS; and from Trigon Engineering, #2006, 8/14/07, $80, .
for Mocksville) are still on my desk. I can return yours to you, or I can
destroy it here. Please provide instructions.
Given that we are discovering a breakdown in communication on these two
projects, it may be helpful for me to provide a short status report on
permitting and ATC for all of the Concrete Supply Company submittals
currently in our office. I'll have that to you this week.

without a permit, and without a permit application pending. How would WSRO react to that, given
all the relevant circumstances (ie my delay, their delay)?
