The Division has reviewed your request to rescind coverage under the subject Certificate of Coverage, which we received on
2/23/2009. At this time, the Division is unable to concur with your request for rescission of your Certificate of Coverage.
We are aware of the issue that the current permit -is under Rea Contracting when, in fact, it belongs to Carolina Sunrock. We
have spoken with Tony Sample and he is working on getting the address changed so that we can separate NCG 140225 from
Rea Contracting and put it under Carolina Sunrock. Please let us know the progress that is being made to get this finalized.
You are still responsible for the site under the current valid Certificate of Coverage.
It is important to maintain compliance with your current stormwater discharge General Permit until the Division has rescinded.

As per your Notice of Violation dated July 3, 2003, the following is submitted for your
review regarding stormwater activities for the above references site.
Being a former DENR Employee like yourself, I have been aware of Carolina Sunrock
Corporation and its attitude toward doing things the right way since it started it's
operation in North Carolina in the early 1980's. I researched it further prior to accepting
employment with Mr. Pfohl, and was satisfied that the Company's work ethic was
compatible with mine. Carolina Sunrock Corporation has always cooperated with the
many regulatory agencies and embraced their assistance and suggestions.
I started to work with Carolina Sunrock Corporation as the Compliance Manager in
September 2000. My focus from day one was to insure that we had all of the permits
that was required for each or our sites and were in compliance with these permits.
noticed almost immediately that Carolina Sunrock Corporation held three permits on our
Butner Property. This seemed strange since we did not have financial control over the
Rea Construction Asphalt Plant, but they were permitted. I was told by Aisha Lau that
multiple permits were not issued on single ownership property and that the SIC Code
designation for the commodity with the greatest.profit was the determining factor. This
led me to believe that the Mining Permit over rode the other permits, therefore I
concentrated on getting the remainder of our sites, existing and new, permitted.
This NOV, for the concrete plant, indicates that an SPPP Plan has not been done for
this site. I contend that we have all the pieces of an SPPP Plan for the Quarry Site,
which includes all of the property, including where the Asphalt and Concrete Plants set.

We have a SPCC Plan prepared by Earth Tech, Inc on June 2001. Training for
Managers was conducted February 27, 2002 (see attached sign in sheet). Employee
training is handled through the weekly safety meetings and the spill prevention and
clean-up was covered in the Hazard Communications and House Keeping training (see
attached sign -in sheets).
Our Mining Permit Map indicated all of the storm -water discharge points, all of our
erosion and sediment control measures and we have not been found to be out of
compliance with any of the operating conditions contained within our mining permit.
Again, our mining permit includes all of the property that the mine, our concrete plant
and Rea's Asphalt plant are located.
We submit that the violation included in your Notice dated July 3, 2003 is unwarranted
at this site, that this Notice should be vacated and that no further enforcement be
pursued.
As a result of this Notice of Violation, we have reevaluated the stormwater issues on
this property and have decided that we can eliminate the potential for stormwater
damage caused by the Asphalt Plant Site and the Concrete Plant Site by plugging the
associated discharge pipe that receives runoff from these plants. Please find attached,
pictures of the inlet side of the discharge pipe as it existed at the time of your inspection
and after we sealed this inlet. As a result of this action, stormwater from the asphalt
and concrete plants will be contained in the area of our north berm and will evaporate,
infiltrate or run back into our pit where it will be used to replenish our process water in
our recycle system. As no discharge can occur, we respectfully request that the
Stormwater Permits Nos. NCG 140225 and NCG 160044 be rescinded.

The Sunrock Butner facility holds three stormwater permits. NCG 020072 (quarry), NCG
160044 (asphalt) and NCG 140225 (readymix concrete). You have raised the question of
whether the concrete and asphalt stormwaters can be combined and held in a ponded mode to
eliminate runoff, thereby taking away the need for either permit and the required monitoring.
In order for the State to evaluate this approach, please submit to this office an engineering
Proposal, including design calculations and drawings to show a system capable of handling a 25
year, 24 hour storm event. There would be a freeboard requirement as part of such an
arrangement, unless a satisfactory plan is presented for overflowing the holding pond to another
of the ponds Onsite for water reuse. The proposal is to be prepared by a North Carolina
professional engineer.

are forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Environmental Management. The Division of Environmental Management may require modification or revocatior
and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
