Chapter 143, Article 21 of the North Carolina General Statutes (G.S,) authorizes and
directs the Environmental Management Commission of this Department to protect and preserve
the water resources of the State. The Division of Water Quality has the delegated authority to
enforce adopted pollution control rules and regulations.
Enclosed please find a copy of an Investigation Report for the investigation conducted on
August 22, 2006, by Mr_ Samar Bou-Ghazale of this office- As a result of this investigation, the
following conditions were found:
1. The discharge outfall monitoring report data submitted by your company for 2005
reflects a pH value of 9.8 standard units (s.u.). This exceedance is a violation. of
your NPDES General Permit NCG140175, which states "The pH shall not be less
than 6.0 standard units nor greater than 9.0 standard units".
To comply with the requirements of your permit, it will be necessary to immediately
implement corrective actions to eliminate the potential for recurrent pH exceedanees.

Mr. Pickle and Mr. Bou-Ghazale,
Per the request in the above reference NOV's, 1 am writing to inform the Division of Water Quality
of our proposed correction action on the exceedance of the permit limit on PH values.
Each NOV was issued for the same reason, although each PH value exceeded the pen -nit limit by
different values. Please see the attached copies of each NOV for reference. All other line items
found on the Routine Compliance hispection form were found to be in compliance. Copies of each
plants inspection form are found on the attached files immediately following the each NOV,
respectively.
Samar, per our earlier discussions, I spoke with Mr. Pickle immediately following yesterdays joint
CRMCA/NCDNR DWQ meeting in Raleigh. After the discussion, Mr. Pickle agreed to issue the
authorization to construct on each site upon my written request for the following:
NOV-2006-0370 Statesville — Installation of Fortrans, Inc. PH adjustment system to correct the PH
level exceeding the pen -nit limits.
NOV-2006-0366 Denver — Installation of Fortrans, Inc. PH adjustment system to correct the PH
level exceeding the permit limits.
NOV-2006-0369 Taylorsville — Installation of Fortrans, Inc. PH adjustment system to correct the
PH level exceeding the permit limits.
Upon your offices reply to this letter, Ready Mixed Concrete will implement the installation of the
PH adjustment systems as soon as Fortans can deliver the systems and assist in installation.

After your call today informing me that the e-mail response dated September 29, 2006 was not
submitted in an approved fashion by the Mooresville Regional office, I am re -submitting the
original response by next day mail to the office of the NC DNR Mooresville Office for the
Department of Water Quality to your attention, with copy to Mr. Ken Pickle. The e-mail method of
submittal was discussed and approved by Mr. Pickle on September 20, 2006. Due to the tinning of
the deadline, September 30th, I felt it most efficient to respond in the most expedient way possible
and Mr. Pickle agreed. If there was any misunderstanding on your inshuction for Andy Stanikwytch
and myself to speak to Mr. Pickle about the resolution of the NOV's, I apologize. In fad,1 had the
opportunity to speak to him in person after a joint meeting between the Carolina's Ready Mixed
Concrete Association and the state office of the Department of Water Quality's Permitting unit- h
was a very cordial and informative meeting, which I felt allowed a reasonable resolution of the PH
violations through the Fortran's System.- We were not aware as you stated in our call today, that the
Raleigh Office has nothing to do with the Mooresville Regional office..
It was not our intentions to circumvent the chain of command over the Mooresville Regional office
in any way. We were simply acting upon the direction you had given to us in conversation on the
matter.
Please accept this re -submittal within the timeline offered on the NOV's.

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG140000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal

In accordance with your application for a stormwater discharge permit received on December 7, 1994, we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that. this certificate of coverage is not transferable. Part fl, B.2. addresses the
requirements to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
