On May 11, 2006 Mr. Roy Davis with this office determined the discharge from Southern Concrete
Materials' Burnsville Plant to have a pHof 11.47. The discharge was a combination of truck wash
water and storm water runoff. The sample analyzed was taken from an overflowing pool beside the
drop manhole in the middle of the yard. This same manhole is located directly over Tantrough
Branch. A discharge pH of 11.47 is a violation of General Permit Number NCG140000 which limits
discharge pH to a range of 6.0 to 9.0.
Part of the area where trucks are washed at the Burnsville Plant does not drain to the settling basins.
The entire truck wash area should drain to the basins. Capture, treatment and reuse of all wastewater
would allow the facility to operate without discharging process wastewater to the State's surface
waters.
I find it reasonable that within 90 days from date of receipt of this letter, Southern Concrete Materials
will complete construction of facilities to convey all vehicle washwater to the existing settling basins.
This conveyance modification may be carried out without applying for an Authorization to Construct
Permit.

For future reference I will remind you that any project involving the construction of storm water/ wash
water treatment facilities first requires the submission of plans and specifications and a Request for
an Authorization to Construct and receipt of an Authorization to Construct prior to starting
construction. Any such plans and specifications must be prepared by a person licensed to practice
engineering in the State of North Carolina. If you contemplate constructing treatment facilities, I urge
the consulting engineer who will help you with the project to first talk to Ken Pickle at 919-733-5083,
Extension 584. Ken is in Raleigh and will be reviewing any construction plans and design calculations
submitted by members of the ready -mix industry.
You will likely -eventually have to undertake a comprehensive stormwater management project at this
location. ] would suggest you go ahead and have topographic maps prepared for all SCM sites which
will have"to=,improve upon stormwater management practices. Such maps will be a necessary first
step.
The North. Carolina Genera Statutes provide for Civil Penalties in ,the amount of $25,000 for violation
of conditions or limitations contained in permits issued by the North Carolina Department of
Environment` and Natural Resources. Each days violation is considered a separate offense. I urge
you to call Mr. Davis at 828-296-4659 to keep him informed regarding your progress. Failure to bring
this washwater discharge into compliance within 90 days from date of receipt of this Notice will force
us to consider Civil Penalties.

Knowing that you have a project in mind I thought I should let you Know Surface
Water Protection Section expectations relating to plans and specifications for new
wastewater treatment systems to be constructed by anyone in the Ready Mix Industry.
Prior to constructing the proposed treatment/reuse basin at the Burnsville Plant SCM will
need to submit three copies of plans and specification along with design calculations and
a request for an Authorization to Construct.
SCM has plans to reshape the yard at -the Burnsville Plant in order to carry vehicle
wash water over spray and storm water to a point in the back of the property where it can
go through a settling basin in preparation for reuse. When designing the project you might
wish to consider that systems designed to overflow only in rain storm which exceed a 10
year-24 hour storm event are not required to perform self monitoring. I would suggest that
you call Ms. Bethany Georgoulias at your earliest convenience to insure that you have an
understanding as to exactly what we need in the way of plans and specifications. She

In response to your renewal application for continued coverage under general permit NCG140000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCO140000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

Dear Ray Hogue:
In accordance with your application for a stormwater discharge permit received on December 2, 1994, we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this certificate of coverage is not transferable. Part 11, 13.2, addresses the
requirements to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
