NPDES Stormwater Permit NCG140129 Durham, NG Durham Countv Dear Mr. Spence: This Friday, March 30, 2003 inspection -by Myrl Nisely of the Raleigh Regional Office of the Division of Water Quality was made in response to reports of foam in the creek across from the plant. Plant Manager Eddie Chavis graciously provided a tour of the facility even though fie was quite busy loading trucks. A brief re -visit was made on Monday. June 02. 2003. Along with pictures and a checklist. comments are as follows: Analytical data from sampling events on 5/13/02 and 9/16/02 consistently show high, non- compliant TSS values at the present two sample points. A third sampling station may be required at the bottom of the south entrance where rainwater puddles and then ntns into the ditch toward the culvert serving sample point 2. 2. All process water except drum washout enters a concrete catch basin. This collection point also serves the central portion of the site watershed, and historically overflows during heavy rain. (See picture from 612/03 after a weekend rain.) On 5130/02 a pump was discharging wastewater through a pipe under the wooden fence with pH of 10.74, a permit violation. New filtration equipment is there reportedly to establish a water recycle system, but is not yet in service. Workmen were installing the recycle unit during a follow-up inspection visit on 6/2/03. The pumping noted in 2. above had stopped. A check of water standing near the culvert under Hwy 55 on 6/2/03 was pH 9.68. 4. Admixture tanks are stored inside a metal warehouse building on a slab floor (no retaining walls). This does not meet the secondary containment requirements and is a permit violation. The floor had considerable chemical on it, some apparently being acidic truck cleaning agents. Housekeeping was needed. Drum wash water is discharged into a large deep earthen pit at the north end of the plant. The pit had recently been cleaned, and had at least 10 feet of freeboard. Excavated pits are potential conduits to groundwater, Please be aware that Groundwater Standards apply, and contamination needs to be avoided. 6. A fuel tank,containment area near the drum wash pit had an estimated 6 to S" of water and an oily layer on it.. Noble Oil was expected to empty the containment soon. There is no drain. 7. SP3 documentation was in place (see checklist). Inspections for the first half of 2003 need to be completed soon. 8. There is no vehicle maintenance done at this location. The continued existence of an inadequately sized settling basin that overflows to a culvert crossing under Hwy 55, the willful pumping of wastewater to that culvert having a pH above 9.0 and past sampling excursions of solids limits give reason for the Division to recommend an enforcement action against Southern Equipment Company. Be aware that if the RRO chooses to take enforcement action, assessment of civil penalties of up to 525,000 per day per violation are possible.
