On July 10, 2018, staff from the Nklilmington Regional Office of the Division of Energy Mineral
and Land Resources (DEMLR), conducted a site inspection for the tract/project known as
Whiteville Ready Mixed Concrete located in Duplin County, North Carolina. The site drains to
Pine Log Branch, which is currently classified as Class C Sw Waters in the Lumber River Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
L A stormwater pollution prevention plan has not been developed and implemented and is a
violation of Permit Condition Part I1L.
2. Analytical sampling has not occurred for the site and is a violation of Permit Condition
Part IV Section A and Section D which requires semi-annual sampling for 5 parameters.
3. Qualitative sampling has not occurred for the site and is a violation of Permit Condition
Part IV Section C which requires semi-annual observations for 10 parameters.
4. The site needs general housekeeping and implementation of best management practices
to keep potential pollution sources from entering stormwater and wastewater discharges.
5. Spill prevention and response procedures need to be implemented. Petroleum products
found on site were spilled on the ground.

Required Response
1. You are directed to respond to this Ietter in writing within 30 calendar days of receipt of
'this --.,"Notice. Your response should be sent to this office at the letterhead address and
include a schedule for compliance with the permit.
2. Develop and implement a Stormwater Pollution Prevention Plan (SPPP). Submit copy of
the SPPP to this office for review with 30 calendar days of receipt of this Notice. Include
all required minimum elements.
Implement the required sampling protocol as outlined in the permit.
Thank you for your attention to this matter. This office requires that the violations as described
above be properly resolved. Unresolved violations may lead to the issuance of a Notice of
Violation and/or assessments of civil penalties.
Thank you for your assistance and cooperation during this inspection. Please be advised that
violations of the NPI)ES Stormwater General Permit may be subject to a civil penalty
assessment of up to S25,000.00 per day for each violation. If you have any questions,

Inspection Summary:
Complaint recieved regarding the Whiteville Readi-Mix facility.
The inspector met with the site operator. He was fairly new at the facility, having transiered from the Ocean Isle Beach
plant. He was unaware of the permit or the requirements, including the SPPP and sampling.
The site has three sources of wastewater discharae.
The drum cleanout pit, southeast corner of facility, is breached on the west side and appears to overtop frequently. The
berm of the pit is covered with dried concrete residue A ditch is to the south of the pit. The ditch does have evidence of
concrete material in it. A secondary basin is to the west. The inspector is unsure of the definition of this basin.. whether it is
constructed or natural low spot; due to vegetation. Outlet of this basin is unknown. The pit breach drains to this basin,
The truck washddown is on the south of the facility. No measures are installed to retain process wastewater from running
into the woods.
The stockpile spraydown is on the west side of the facility. No measures are in place to retain wastewater onsite. The
wastewater flows into the woods.
A truck maintenance facility is onsite. The used oil is deposited into a container inside, then pumped to a container outside.
A recent spill is evident around the outside container Used oil container does not have secondary containment. The
employees had thrown sand on the spill; but did not clean it up. Secondary containment around the desiei fuel is in need of
repair. Some other containers are stored outside, generally used containers of various sources.
The facility generally sheet flows offsite. There is no containment to reduce suspended solids and sediment for the site.
The waste concrete area to the west of the facility is in the process of being crushed. The concrete did include offsite
concrete as there was rehar present. The conveyor belt spraydown was not contained on site.

This facility currently has an active NCG140000 permit (COC No. NCG140060);
consequently, we have interpreted your December 14, 2010 submitted NOl as a name/ownership
change request. Accordingly, we are forwarding herewith the subject certificate of coverage
(COC) to discharge under the subject state -- NPDES general permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215. l and the Memorandum
of Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
The Division acknowledges that temporary wastewater measures have been installed at
this existing facility until a properly designed wastewater treatment facility can be designed,
approved, and installed. The proposed future construction, installation, or modification of
wastewater treatment facilities (including process wastewater recycle systems) will require an
Authorization to Construct (ATC) prior to construction per 15A NCAC 2H .0138 & ,0139. The
design information must demonstrate that the proposed treatment system will be able to meet
permit conditions and effluent limits as required in the permit. You must submit, in triplicate,
plans/specifications and design calculations, stamped and sealed by a professional engineer,
with a letter requesting an ATC to the Stormwater Permitting Unit, 1617 Mail Service Center,
Raleigh, NC 27699-1617. Also, a design narrative must be included that tells us specifically
how the stormwater and wastewater flows will be generated, collected, conveyed, treated, and
discharged. This requested information should be received by this Off -tee prior to April 4,
2011.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal

For new plant sites that will discharge or recycle process wastewater (even if commingled with
stormwater): This N01 is also an APPLICATION FOR Authorization to Construct (ATC) wastewater
treatment facilities. ATC requests must be submitted at least 90 days prior to construction'.
For existing plant sites discharging or recycling process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to continue tooperate wastewater
treatment facilities in place. Construction, modification, or installation of any new treatment components
at an existing site requires an ATC.
Treatment facilities used to treat or recycle process wastewater (including stormwater BMP structures
treating process wastewater flows commingled with stormwater) require an ATC prior to construction
per 15A NCAC 2H .0138. The authorization to construct or continue to operate will be issued at the
same time as the Certificate of Coverage (COC) for the NCG14 permit. Design of treatment facilities
must comply with requirements of 15A NCAC 2H .0138 & .0139.
Construction of wastewater treatment facilities (this includes recycle systems) at new or existing plant
sites requires submission of three (3) sets of plans and specifications signed and sealed by a
Professional Engineer (P.E.) or qualified staff2 along with this application. A copy of the design
calculations should be included. Please see questions 14 & 15.

Your facility is currently covered for stormwater discharge under General Permit NCG 140000. This permit will
expire on July 31, 2004. North Carolina General Statute 143.215.1(c) requires that an application for permit
coverage renewal be filed in a timely manner. A prior notice of renewal was sent for this site on December I,
2003, To date, no response has been received by the Division of Water Quality (DWQ). In order to assure your
continued coverage under the general permit, you must apply to DWQ for renewal of your permit coverage.
Enclosed you will find a general permit renewal application form. The application must he completed and returned
by April 19, 2004 in order to assure continued coverage under the general permit.
Failure to request renewal by April 9, 2004 can result in a civil assessment of at least $250.00. Larger penalties
maybe assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $10,000 per day.

The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess

both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
