The Division of Energy, Mineral, and Land Resources (DEMLR) has reviewed the Representative
Outfall Status (ROS) Request Form submitted for AT Auto Parts, Inc. on September 9, 2013.
On October 16, 2013, DEMLR staff conducted a site inspection and records review at J&T Auto
Parts, Inc. in Marion, North Carolina. Analytical data for outfalls 001 and 002 were requested
during the inspection. However, no analytical data for outfall 002 were provided. Additionally, you
stated that you had not sampled outfall 002 for some time. The inspection also revealed that some
activities occurring at the site are not restricted to one location and can occur throughout the
facility. One such activity is crushing.
Based on the findings referenced above and pursuant to 40 CFR § 122.2 1 (g)(7), representative
outfall status does not apply to outfalls 001 and 002.
Please submit a letter, within 30 days of receipt of this letter, explaining why J&T Auto, Inc. has
failed to sample all subject outfalls as required by the referenced Certificate of Coverage (COC)
and general permit. Immediately begin sampling all of your outfalls in accordance with the
procedures outlined in your permit.

Inspection Summary:
DWQ staff was met on site by Mr. James McKinney, facility owner. A tour was conducted of the exterior of the facility,
observing the stormwater conveyances, outfall and site conditions. During the visit, the SPPP manual was reviewed,
operational activities and a representative outfall status were discussed.
At the time of the inspection the site was not in compliance with the permit. The facility has not been collecting samples
at outfall 002. They have been instructed to begin sampling all subject outfalls in accordance with the permit. The
inspector noted that the facility appeared to maintain good housekeeping practices and records were found to be in good
order.
The facility is seeking representative outfall status. The request has been denied due to the lack of data for. outfall 002
and due to the mobile nature of some of the activities that occur at the facility. It was not clear, at the time ofthis.--,
inspection, that that the drainage areas for outfalls 001 and 002 are substantially identical.

this outfall. They were instructed to begin sampling both outfall in accordance with their
permit.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be tiled with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.
