Please Management System (BIMS) checklist. Below is a list inspection. Coleen H. Sullins, Director Division of Water Quality inspection on August 21, 2008. Your cooperation and find attached with this letter the Basin Wide Information of findings and recommendations developed from the 1. The current permit was reissued November 01, 2007 and expires October 31, 2012. Please note that the monitoring schedule for analytical sampling is specific and that the definition of a representative storm event has been modified. Benchmarks have been assigned for analytical monitoring requirements results. Exceedences of benchmark values require the Permittee to increase monitoring, increased management actions, increase record keeping, and/or install stormwater Best Management Practices (BMP's) in a tiered program. 2. The facility dismantles automobiles for scrap and parts. Scrap cars are spread out over an undetermined amount of acres. All cars that are brought in are drained of fluids, batteries and tires removed. Used oil is stored in drums and burned in a clean burn heater. Other fluids are stored in barrels and taken to be recycled. Batteries are sold, traded as core for the purchase of new batteries. Scrape tires are stored in a trailer until removal to a landfill. 3. The scrap yard slopes gently downhill toward the office / shop area next to US Highway 301. There is one common stormwater discharge outfall listed for the facility that consists of a ditch. Flow from the ditch drains to the roadside drainage ditch along US 301 North. Flow from this drainage ditch may reach an unnamed tributary to Town Creek currently classified as Class C, Nutrient Sensitive Waters (NSW) in the Tar -Pamlico River Basin. The discharge outfall was dry at the time of inspection. There was no indication of any negative effects from previous discharges. 4. The Stormwater Pollution Prevention Plan was reviewed. The SPPP is well written and meet all requirements. Preventative training for employees was last documented 04/05/2008. Quarterly and non-stormwater monitoring was last completed on 04/0502008. Four rain events were recorded for 2007 however, there is no record of qualitative monitoring. Please begin qualitative monitoring as required in the permit. Analytical monitoring reports for the last two years were available. Microbac Laboratories and Southern Testing perform all analyses. Records are required to be maintained for five years. This is a violation of NCGS §143.215.1 (c)(1) which states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be". Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a permit after the expiration and has not requested renewal at least t80 days prior to expiration, will be subjected to enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq. In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a completed permit coverage ienewal application to the attention of the "Stormwater and General Permits Unit" at the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions are listed on the bottom of the form.
