Dear Mr. Alexander:
In accordance with your application for a discharge permit received on October 31, 2017, we are
forwarding herewith a corrected subject certificate of coverage (COC) to discharge under the subject
state — NPDES general permit. Your previous COC issued on December 6, 2017 failed to identify the
receiving water as a Primary Nursery Area (PNA).
This site will discharge to a receiving water designated as a PNA. As such, a more stringent Total
Suspended Solids benchmark applies to vehicle maintenance activities (Part II, Section B, Table 3), and
a more stringent Total Suspended Solids limit applies to secondary containment structures and oil water
separators (Part II, Section C, Table 4).

In accordance with your application for a discharge permit received on October 31, 2017, we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except upon approval of the
Division of Energy, Mineral and Land Resources (DEMLR). DEMLR may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DEMLR, the Coastal Area Management Act, or any other federal or local government permit that
may be required.

Inspection Summary:
Brian Lambe and Trentt James met with Mike Anderson of Kinder Morgan to review NPDES stormwater permitting needs.
The entire area that is actively used is diked. The dike is constructed of clay with a plastic liner, covered with surge stone to
prevent erosion. In certain hurricane events, Matthew, parts of the dike have been lost, but there is regular maintenance on
the dikes. There is a bio-diesel distribution point, but the storage of the bio-diesel is on state port property and is covered by
their permit. The bio-diesel distribution utilizes spill protection pans which lead to a containment area that is disposed of
offsite. There is an asphalt storage container on the site. There is a methanol distribution point which also uses spill pans
which lead to a containment area that is disposed of offsite. The discharge from the diked area can only do to the tidal
lagoon if it is actively pumped. There is a discharge from an old yard inlet that leads to the canal to the north of the
property. There is a city stormwater permit that covers at least two newer inlets, which drain to the diked area, which
makes it a stormwater pond (?). The stormwater permit covers the newer warehouse area. There is an area that contains
several metal drums with various materials, which has secondary containment, outleted to the old stormwater pond after
testing the pH of the water and visual check for oil sheen. The facility has a SWPPP and follows BMPs, but that is
incorporated with the port property. The facility has a USCG spill response plan and an EPA spill response and
management plan. Mike said he can email it to us if needed.
The facility may not meet NPDES08 Transportation requirements because it does not store anything but asphalt. But one
may be able to argue that the distribution point is a continuation of the 1 million + gallons of biodiesel that is on the site
