On November 2-3, 2009, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water
Quality conducted site visits at the seventeen Charlotte area USPS Stations that would be involved in the
Mobile fueling operations for "city" postal delivery routes.
The site visits found that only 14 of the 17 postal stations that had applied for coverage under the NC
General Stormwater Permit for Transportation Activities, NCG080000 would need coverage. The
Arrowood Station, Carmel Station, and Idlewild Carrier Annex will not be required to tarn under
the NCGO80000 permit because stormwater does not flow off site through an "outfal ,each
of the 17 site visits is enclosed. This information has been forwarded to the Storrnw Permittin -it for
use in issuing the USPS Certificates of Coverage under NCG080000, �n<a CS

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina.
The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on
site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories
are required to obtain permit coverage under a general permit or an individual permit, depending upon
the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active
general stormwater permits in North Carolina. One condition that is applicable to both the general permits
and individual stormwater permits is the requirement to develop and implement site -specific
comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a
comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant
discharge.

forms, and a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater
Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said, please
see the above mentioned web site in order to obtain a copy of the permit such that you may fully comply
with all the conditions therein. Failure to properly comply with conditions of the permit, like those
bulleted below, constitutes violations and are subject civil penalty assessment of up to $25,000.00
per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of intent (NO[) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly-, however, most of the
permits have following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Analytical Monitoring

o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records —Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on -site. The Permittee shalt retain records of all monitoring information,
including all calibration and maintenance records and all original strip chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of least 5 years for the date of the sample measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage.to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
a Name/ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

week. There are no spill response materials at the site since the USPS will rely on the fueling contractor for spill response

There was no evidence of prior spills on the day of the inspection. There is a small swale being cut into area near the
fence line in the middle of the parking lot. There was a small accumulation of gravel and dirt cn grassed area outside the
fence. This grassed area is still on USPS leased property and does not affect surface waters of the state. This facility is
therefore exempt from obtaining permit coverage under NCG080000.

There are no spill response materials at the site since the LISPS will rely on the fueling contractor for spill response during
fueling operations.
There was no evidence of prior spills on the day of the inspection. There are two drop inlets to the City of Charlotte MS4
in area where mobile fueling will occur and subject to stormwater permitting. The drop inlet closest to Ballantyne Trace
Court contained an oil sheen from iron -oxidizing bacteria (broke apart when agitated) not industrial activities at the
facility.

Stormwater flow leads to a wooded area on the property. This facility is therefore exempt from obtaining permit coverage
under NCG080000.

vehicles at the facility are scheduled for involvement in the mobile fueling operations which would occur approximately
twice per week. There are no spill response materials at the site since the LISPS will rely on the fueling contractor for spill
response during fueling operations.
There was no evidence of prior spills on the day of the inspection. There was a large accumulation of organic debris (>2")
in the northwestern corner of the parking lot. This area is also the low spot on the property that would collect stormwater
flow. The adjoining property was walked and there was a small swale with riprap on the opposite side of the fence line
from the LISPS facility in the northwestern corner.
The front of the property has curbing with a 4" PVC pipe installed in it to, allow stormwater to exit from the property. This is
probably what is installed in the northwestern corner of the property since a Swale is installed on the opposite side of the
fence line to facilitate removal of stormwater from the property.
Since it was dry during the inspection a determination of whether the flow leaves the site as "sheet flow" or through
infiltration and discharge through the PVC pipe and swale could not be determined. USPS personnel were instructed to
remove organic debris and maintain the stormwater "outfall" from property.

therefore exempt from obtaining permit coverage under NCG080000.

There was no evidence of prior spills on the day of the inspection. There are two drop inlets which convey stormwater to
an on -site stormwater retention pond. The pond had water in it on the day of the inspection. The pond is roughly 138'
long by 28' at the narrowest end and 44' at the widest end. The pond is designed to discharge stormwater via a concrete
riser pipe to the City of Charlotte MS4. Flow can travel over the top of the pipe or enter at approximately half the height of
the riser. It appeared there may be an opening near the bottom but could not tell since that side of riser was surrounded
by water. There was standing water and also a sediment accumulation in the riser pipe that indicated that water had
discharged from the pond. However, on -site USPS personnel state that the pond does not discharge. USPS
environmental contact did not have any drawings or specifications on the pond so MRO assumes that it can and has
discharged and therefore would require permit coverage. There does not appear to be an O&M plan for the pond other
than mowing along the berm and cutting woody vegetation planted around the pond.

with asphalt. The area is sloped so all stormwater flows to a central low spot. The stormwater is conveyed off site via a
cut in the concrete curb with a concrete swale. There is also a concrete barrier wall (--5' tall) around the back portion of
the parking area with razor wire at the top. Where the concrete barrier wall meets the curbed parking area with chain link
fence there are vertical cutouts in the concrete barrier wall that allows the stormwater to drain from the parking area in
larger storm events. Therefore there are two stormwater outfalls on site. Stormwater would flow to a vegetated area
which leads to a UT to Brier Creek.

Sorry I did not get back to you the other day. I've been back and forth to the doctor's office a bunch of times
since the poison ivy I got from the Oakdale Station stormwater pond riser pond got pretty bad and I needed
steroid shots and antibiotic shots. Did a follow-up today and they said I should be on the mend.
I reviewed the document that the USPS had submitted from the trial fueling period.
I would disagree with Item 10, which states, "No stormwater outfalis on postal premises were observed at any
of the 17 locations. Some of the locations had curb drains, sheet flow, and/or stormwater catch basins,
however none had an on site outfall." I think the USPS is missing the point as each drop inlet at the facilities
needing permit coverage would be considered an outfall since they discharge into the City/County MS4
stormwater systems. The only facility that has a true "outfall" pipe (and the drop inlets are not considered
outfalls) would be the discharge pipe from the stormwater pond at the Oakdale station.
I see no reason to deny issuance of the permits for the 14 sites I identified that needed permits since they have
begun mobile fueling without the permit coverage.

Outstanding issues to be addressed by SMF or LISPS:
Q: SMF's Spill Contingency Plan says refueling can occur on or above storm drains, and that 3"
snakes must be used during fueling, but SMPs response to Marcia's comment indicated
only absorbent pads were carried on the trucks. If the trucks aren't carrying snakes in their .
spill kit inventory, how do they plan to do this? Or is this part of their kit? It wasn't clear
from the response.
Note - SMF responded to this concern in an e-mail from T. Koshollek on 1/16/09. Mr.
Koshollek stated that 3" snakes are carried on the truck as part of the spill kit. He added,
"Snakes are utilized to surround storm drains when fueling within 50ft of a storm drain. During
a rain, the snakes from the spill kit will absorb only petroleum products from the wet area and
not the rain water; this is the design of the product. 'Absorbent pads' are used in wet or dry
conditions in the unlikely event of a small splash back or outage while fueling at a vehicle.
These absorbent pads can be utilized in wet or dry conditions and like the absorbent snakes,
will only absorb petroleum not water in the event it is raining. Absorbent snakes are used for
precaution in case there was a situation near a storm drain. Absorbent pads would be used if
an outage occurred."
Follow-up Q: So is it allowable for SMF to fuel a vehicle over a storm drain? If so, will the USPS
ensure that employees are advised/ trained to park away from storm drains whenever possible?
Q: SMF's Spill Contingency Plan says storm drains should be covered or diked if fueling within
50'. How close do they have to be before the driver actually covers the storm drain? Is there
any difference in the procedure during dry conditions versus when it's raining?
Q: SMF's responses to MRO's comments regarding hoar hose is brought back to the truck
indicated that drivers are trained to "carry (not drag) the hoses between vehicles".
However, the SOP section of the Spill Contingency Plan advises drivers to "Drag hose back
to truck." Please resolve the inconsistency.
Q: SMF's responses to MRO's comments regarding MSDS availability asserted that "MSDS
sheets are carried in the cab of each truck". The response goes on to say "MSDS sheets for a
specific customer are available at the Corporate office." The Spill Contingency Plan is
consistent with the latter and says an MSDS on each hazardous material transported is
available "in the main office." It is unclear whether MSDS sheets are in fact carried in the
truck or only kept at the office. SMF should clarify and revise their SOP accordingly. DWQ
highly recommends drivers carry MSDS sheets with them in the truck.
Q: SMF's responses to MRO's comments regarding employee training indicated
refresher/update training takes place every three (3) years and when new products or
procedures require a change. Please note the requirement for annual training under
NCGO80000. (Same would apply to USPS employees regarding inspections, parking for
fueling, etc.) While this timeframe does not apply for a 60-day trial period, this is not an
adequate schedule under NPDES permit obligations.
Q: DWQ had an overall comment that the Spill Contingency Plan did not really address fueling
during inclement weather or give details specific to stormwater. There was no response to
this comment from Mr. Koshallek.

B. Sufficient buffer shall be maintained between any affected land and any
adjoining waterway or wetland to prevent sedimentation of that waterway or
wetland from erosion of the affected land and to preserve the integrity of the
natural watercourse or wetland.
C. All buffer zones shown on the mine map prepared on December 2007 shall be
maintained to protect adjoining property. These buffer zones, with the exception
of the installation of required sediment control measures and approved earthen
berms, shall remain undisturbed.
4. Erosion and Sediment Control
A. Adeq\ to mechanical barriers including, but not limited to diversions, earthen
dikes, c} eck dams, sediment retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake, wetland
or natural watercourse in proximity to the affected land.
B. All mining activities, including the installation and maintenance of all erosion and
sedimentation control measures, shall be conducted as indicated on the mine
maps prepared on December 2007 and the supplemental information received
by the Land Quality Section on March 29, 2007 October 26, 2007 and May 29,
• 2008.
C. An erosion and sediment/control plan(s) shall be submitted to the Department for
approval prior to any land distu bing activities not indicated on the revised
erosion control plan or mine mas submitted with the approved application for a
mining permit and any approved recisions to it. Such areas include, but are not
limited to, expansion outside of the a proved pit area, creek crossings, or
expansion of overburden or waste dis�, osal areas.
5. Groundwater Protection
Groundwater monitoring wells shall be installed and monitored as deemed appropriate
by the Department.
6. Graded Slopes and Fills
A. The angle for graded slopes and fills shall be no greater than the angle which
can be retained by vegetative cover or other adequate erosion control measure,
structure, or device. In any event, exposed slopes or any excavated channels,
the erosion of which may cause off -site damage because of siltation, shall be
planted or otherwise provided with groundcover, devices or structures sufficient
to restrain such erosion.

During trial period not to exceed 60 days, DWO will require:
Qualitative Monitoring at all stormwater outfalls draining mobile fueling areas at
selected group of 3-4 post office sites that represent both typical and "worst case"
scenarios. For example, sites where the most vehicles will be fueled or sites that are
located closer to receiving waters are ideal to monitor for this period.
Qualitative Monitoring should be performed once every two weeks, beginning on the
date fueling activities commence. If no rainfall event occurs that results in a discharge
during a two -week period, the USPS should record "no flow" on the Qualitative
Monitoring Form for that period. DWQ Forms and guidance are on the SPU website at:

This monitoring schedule should result in four (4) observation events (or recordings of
"no flow") for each post office selected during the 60-day trial period. Please be sure to
record the amount of rainfall on the form. While we are not requiring the rain event to
qualify as a "representative storm event" because of the abbreviated time of this trial, it
is ideal that events that would qualify be monitored whenever practical. Also, only the
areas that discharge stormwater associated with fueling operations need to be
monitored.
Qualitative Monitoring results should be submitted to the Mooresville Regional Office
DWQ every 30 days, beginning on the first date of fueling activities. The address is:

At the conclusion of the 60-day trial period, the USPS will submit a summary report
with the following information. Please submit this report to both the DWQ Regional

1617 Mail Service Center, Raleigh, NC 27699) within two weeks of the end date of mobile
fueling operations. At a minimum, the report should include:
1) Amount of fuel dispensed
2) Amount in gallons spilled
3) Number of spills and responses
4) Approximate size of drainage area where fueling occurred at each post office
5) How parking was organized for fueling
6) How procedures were communicated to post office employees
7) How the USPS ensured consistency in operations at all post offices
8) Summary of contractor's performance

B. Overburden cut slopes along the perimeter of any pit expansion conducted after
the 1997 renewal of this permit shall be graded to a minimum 2 horizontal to 1
vertical or flatter and shall be stabilized within 60 days of completion.
Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be
provided at the top of the rock and at the toe of any overburden slope
constructed after the 1997 renewal of this permit.
Surface Drainage
The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
Blasting /
The operator shall monitor each blast withia seismograph located at a distance
no farther than the closest off site regularly occupied structure not owned or
leased by the operator.\A seismographic record including peak particle velocity, air
overpressure, and vibration frequency levels shall be kept for each blast (except as
provided under Operating Condition Nos�813 and 8D of this permit). The following
blasting conditions shall be observed by the mine operator to prevent hazard to persons
and adjacent property from surface blasting:
A. Gro
In all blasting operations, thb maximum peak particle velocity of any component
of ground motion shall not/exceed Figure 1 (below) at the immediate location of
any regularly occupied building outside of the permitted area such as a dwelling
house, church, school, or public, commercial or institutional building.

9) Summary of qualitative monitoring results at select post office sites and why
those sites were selected
10) Identification of stormwater discharge outfalls observed
11) Identification of receiving waters (even if through Charlotte M54, identify
nearest stream)
12) Any non-stormwater discharges observed during the trial period, and responses
13) Any other information related to stormwater pollution prevention efforts
DWQ is approving the U.S. Postal Service's request to conduct this trial period of
mobile fueling operations at select post offices in the Charlotte area on the basis
that:
• The Contractor and/or USPS address outstanding issues on the first page
• The Contractor (SMF Energy Corp.) has provided spill prevention and
contingency plans that mirror many requirements in NC NPDES General
Stormwater Permit, NCG080000.
• The USPS is implementing actions that also mirror many specific requirements in
the NCG08 permit, including qualitative monitoring, routine inspections, and
response measures. (Note analytical monitoring would not be required at these
sites under the permit because the sites do not use > 55 gallons of new motor oil
a month on average.)
• Should USPS decide to resume mobile fueling operations with a contractor on an
on -going basis, the USPS is responsible for fulfilling NPDES stormwater
permitting requirements either by:
a) applying for coverage under an appropriate stormwater general or
individual permit (currently, General Permit NCG080000 is available for
vehicle maintenance and fueling activities), or
b) implementing measures to attain No Exposure conditions at post office
vehicle areas during fueling operations and applying for a No Exposure
Certification from N.C.
c) USPS would be responsible for coordinating compliance measures with
any future contractors.

B. Ground Vibration Without Monitoring:
In the event of seismograph malfunction or other condition which prevents
monitoring, blasting shall be conducted in accordance with the following
formulas:

C. Air blast With Monitoring:
Air blast overpressure resulting from surface blasting shall not exceed 129
decibels linear (dBL) asmeasured at the immediate location of any regularly
occupied building not/owned or leased by the operator outside of the permitted
area such as a dwelling house, church, school, or public, commercial or
institutional building, unless an alternate level based on the sensitivity of the
seismograph microphone as specified below is being used:

4) Approximate size of drainage area where fueling occurred at each post office -
The three (3) pilot sites included the Downtown Station- 142, 839 sqft; Ballantine
Station- 185,562 sqft, and the Independence Station- 216,102 sqft.
5) How parking was organized for fueling- Each parking lot has designated
parking spaces for each postal vehicle. The postal vehicles were fueled without
moving any of the vehicles to a different location.
6) How procedures were communicated to post office employees- Procedures
were communicated to employees through service talks and informational
memos.
7) How the USPS ensured consistency in operations at all post offices- The
USPS ensured consistency in operations by using a uniform, standardized
approach combined with effective supervision. One contractor, Streichler Mobile
Fuel, was used during this pilot, with one set of procedures that did not vary from
site to site.
8) Summary of contractor's performance- Streichler Mobile Fuel completed its
mission according to their planned scope of work. No issues or discrepancies
were noted.
9) Summary of qualitative monitoring results at select post office sites and why
those sites were selected- qualitative results were not located for inclusion with
this information.
10) Identification of stormwater discharge outfalls observed- No stormwater
outfalls on postal premises were observed at any of the 17 locations. Some of
the locations had curb drains, sheet flow, and/or stormwater catch basins,
however none had an on site outfall.
11) Identification of receiving waters (even if through Charlotte MS4, identify
nearest stream) — this information was verified by Ms. Marcia Allocco of the
NCDENR, who completed site visits to all 17 locations during the week of
11/2/09. No direct receiving waters could be verified directly for the three pilot
stations (Downtown, Ballantine, and Independence Stations).
12) Any non-stormwater discharges observed during the trial period, and
responses- None were observed.
13) Any other information related to stormwater pollution prevention efforts- Best
management practices such as cleaning of parking lots and also direct
supervision of the activities were employed by each site.
