MecklenburgCounty
MRO inspected the Nationsway Transport Service facility at 1000 Thomasboro Drive (old 1-85
South Service Road) on February 4, 2010, as noted in the attached inspection report. The inspection
and associated investigation found that Nationsway transport Service is no longer conducting
transportation related activities at the site and went bankrupt in 2000. The property was last used by
Concrete Accessories Materials but is now vacant and up for sale.
MRO is therefore requesting that Stormwater Certificate of Coverage NCG080367 be made
"Inactive" in BIMS to remove it from the list of facilities needing inspections -and remove it from the
associated EPA permitting and compliance databases available online to the public.

Inspection Summary:
A site visit was conducted because the Certificate of Coverage for the Nationsway Transport Service facility under
General Stormwater permit NCG080000 for Transportation related stormwater discharges expired in 2002.
From the Mecklenburg County GISIPoiaris website it was determined that the property was never owned by Nationsway
Transport Service and was last sold in 2005 to CAM Properties, LLC. A Google search of "!Nationsway Transport Service"
found that the company filed for Bankruptcy in 1999 and subsequently dissolved.
The site visit on February 4, 2010, confirmed that Nationsway Transport Service is not operating out of the facility. The
facility was last occupied by Concrete Accessories Materials but is now vacant. Therefore, the Mooresville Regional
Office believes NCGO80367 should be made "Inactive".

Oct. 14--An Arizona bankruptcy judge Friday approved the reorganization plan of NationsWay Transport
Service Inc., Bearing the way for creditors to be paid from the remaining assets of the bankrupt trucking
company.
Judge Sarah S. Curley of U.S. Bankruptcy Court in Phoenix confirmed the plan after the major creditors
resolved their differences over how much they were owed.
Jerry McMorris, one of the principal owners of the Colorado Rockies baseball team, was NationsWay chief
executive.
"Management of the company worked very hard to achieve the resuR they did," said NationsWay attorney
Donald Gaffney.
He said the amount of money distributed to creditors was higher than the company originally estimated.
"There were concerns that there wouldn't be enough money to pay Foothills Capital," he said.
Foothills, of Los Angeles, NationsWay's €argest creditor, was paid the full $38 million it was owed, Gaffney
said.
The remaining secured creditors, which include 3,500 former employees, will share between $7 million and
$8 million, Gaffney said. Prudential Insurance Co. of America and Bank of America will divide about 65
percent of that.
Workers will share $2,4 million -- a fraction of what they are owed. Frederick Periilo, an attorney for the
International Brotherhood of Teamsters, has said employees were owed $5 million in unpaid wages alone,
and closer to $12 million if vacation pay and other money due them is included.
But the union supported the reorganization plan because it felt it was the best result possible. Any further
objections likely would have just lengthened the process and not resulted in any more money, Perillo has
said.
The approval ends the bankruptcy reorganization of the trucking concern, which filed for Chapter 11 on May
20. 1999.
About 3,500 drivers, dock workers and office staff were not paid for their final two weeks of work when the
company filed Chapter 11, Payments to workers is the subject of a separate court action in U.S. District
Court in Denver.
The workers -- about 1,000 of whom worked in Colorado — won a victory in July when U.S. District Court
Judge Edward Nottingham ruled that former officers of NationsWay, including McMorris, are liable for at

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

on August 31, 2002. The Division staff is currently in the process ol' rewriting this permit and is scheduled to have

In order to aSSur'c your continued coycrage under the general permit, you must apply to the DiviSiOn of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier. we are informing you in,
advance that your permit xill he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Forril. The application must he completed and returned by March 4. 2002 in order to aSsurc continued
coverage under the general permit.
Failure to request renewal within this time period nlay result in a civil assessment of al ]cast $250.00, Larger
penalties may he assessed depending on the delinquency of-ilte request. IaischarLe of stot-iiiw itu- from your facility
without coverage under a valid storrnwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments 01' civil penalties of up to $10.000 per day.
Please note that recent 1ecleral legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "stone water discharoes associated with industrial (except
construction activities), II -you feel your facility can certify a condition of "no exposure", i.e. the lacilty industrial
materials and operations are not exposed io storrmvater. you can apply for the no exposure exclusion. l'or additional

In accordance with your application for discharge permit. received on November 10, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
.Area Management Act or any other Federal or Local governmental permit that may be required.
