Aana,
In regards to this rescission /No Exposure certification request, are you going to prepare the rescission/no exposure
letter for the Nussbaum Center? I ask because Bradley put a note on the name/ownership change form that said he
talked to you and that you were going to issue the No exposure and rescission letter.
I've done the name/ownership changes for NCG030319 in BIMS. Let me know if you want me to take care of the letter.
I guess I'll need to actually rescind the NCG03 in BIMS once the NCGNE is issued?

Hi Julie,
I've been working with Sam Funchess at the Nussbaum Foundation on the Williams Steel site. He is going to submit the
change of ownership form, if he hasn't done so already. Also, I visited the site on Monday and they do actually qualify
for No Exposure. What I thought I saw earlier is steel lying outside from their neighboring company, O'Neal Steel, which
has a separate NCG03 permit. There's nothing going on at the Williams Steel site and nothing stored outside, so they
should be good to go. Sam said he'd go ahead and apply for No Exposure so that he can keep some kind of permit open
as a benefit to any new tenants they may have.

An entity managed by D.H. Griffin Sr. has donated 9.2 acres along South Elm Eugene Street in Greensboro, including the 193,000-
square-foot former Carolina Steel Corporation industrial warehouse, to The Nussbaum Center for Entrepreneurship,
Steel Industries Inc. has owned the property since late 2005, public record shows. That entity is controlled by both Griffin, a veteran
Triad businessman who helms D.H. Griffin Cos., and Jimmy D. Clark of moving engineering firm Guy M. Turner Inc.
The donated property spans 9.2 acres at 1431 S. Elm -Eugene St. just south of downtown Greensboro and is now owned by
Nussbaum Center Properties LLC.
Portions of the property date back to 1920and the total assessed valued for the land and building tops $2.2 million, according to
Guilford County tax records. The transaction closed Dec. 30.
The Nussbaum Center for Entrepreneurship is the state's largest small-business incubator. Sam Funchess, the center's president and
CEO, said the idea of the property donation first came up in 2009, when Nussbaum announced its plans to move from Revolution
Mill Studios on Yanceyville Street. (Revolution Mill is currently amid a large-scale renovation.)
Griffin, who also invested in Revolution Mill, was one of the donors who gave the Nussbaum Center its current home, another
former Carolina Steel building at 1451 S. Elm -Eugene St.
The Nussbaum Center made its move in June 2012.
"Back in 2009, when we were looking for a permanent home... (Clark and Griffin) showed us the building that we're in and said, `we
also own that over there.... It may be in the future that we're interested in donating that to you as well,"' Funchess said of the
property at 1431 S. Elm -Eugene St. "They said, `Is that something you can do something with?' We ran with that and said,'Yeah,

there's probably something we can do something with."'

Now the real fun and exploration begins. There's 15 football fields' worth of vacant industrial space and more than 9 acres to play
with, and Funchess is open to any and all Ideas of how to use the space.
Some initial potential ideas include: Using the space as a soundstage for a film production ("Why not? You're not going to find that
many enclosed buildings that size for as cheap as we can make it available," Funchess said); building Class A or high Class B office
space facing South Elm -Eugene Street with the rear of the property filled by advanced manufacturers; small-scale kitchen incubation
space for local -food startups and entrepreneurs; a brewpub or restaurant anchor on a retail site.
There's no set timel€ne for when the building and property will be transformed — and judging by the three-year tlmeframe of the
Nussbaum Center relocating to South Elm -Eugene Street, it's safe to say there won't be any serious action in the immediate future.
But Funchess wants to hear the community's ideas.
"The reality Is that we have the opportunity to either use a 200,000-square-foot building, or we have the opportunity to remove that
to dirt and have a brand-new clean slate, and that's the question: what do we want to do?" Funchess said, "What can the
community come up with? We have some ideas, but there are smarter people in this community than us, or at least more creative
people, so let's chat and see what ideas we can see."

National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DWO must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained
vehicles used in material handling; and final products, other than products that would be mobilized in
stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
You are required to self re -certify your No Exposure Exclusion annually.

Annual Permit Fee
This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs associated
with your permit. It is required of any person holding a permit for any time during the annual fee period, regardless of
the facility's operating status. Failure to pay the fee by the due date will subject the permit to revocation. Operating
without a valid permit is a violation and is subject to a $10,000 per day fine. If the permit is revoked and you later
decide a permit is needed, you must reapply, with the understanding the permit request may be denied due to changes
in environmental, regulatory, or modeling conditions.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.ordweb/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/1 for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Your facility is currently covered for stormwater discharge under General Permit NCG030000, This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of'2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Hermit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwaWr from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to S 10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Permits Unit Web Site at Itttp://1r2o.enr.state.nc.its/su/stormwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request I+orm. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
