Skvarla, III Secretary The purpose of this letter is to inform you that the Division of Energy, Mineral and Land Resources (DEMLR) is hereby granting your request for regulatory relief at the subject facility in the form of a collapsed Tier Two -- Tier Three response. Upon receipt of this letter, Honeywell International, Inc. may resume semi-annual analytical monitoring for the remainder of the current permit term. Your current permit is set to expire on October 31, 2017. This decision applies only to the copper and zinc benchmarks. A benchmark ezceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the general permit. Please keep in mind that benchmark exceedances are not limit violations or violation's of permit conditions; however, you are obligated'to follow the tiered response actions outlined in your permit. The decision to grant your request for relief from Tier Two - Tier Three response was based on a review of information provided to DEMLR in an email dated October 28, 2014 from Mr. Chuck Hoffman, Project Geologist with Mid -Atlantic Associates, Inc and previous discussions with you and Mr. Hoffman concerning exceedances of the benchmark values for zinc and copper at Outfall No. 1. information provided included a narrative description of the actions Honeywell has taken in accordance with Tier One response requirements, as well as analytical monitoring data collected at five additional on -site locations. DEMLR is satisfied that Honeywell has responded in accordance with the Tier One requirements and other conditions of the NCG030000.General Permit. It is also notable that zinc and copper levels from all sampling locations, including Outfall No. 1, were below the revised copper and zinc benchmark values that DEMLR began incorporating into NPDES industrial stormwater permits issued on or after January 1, 2014. For permits issued on or after January 1, 2014, the benchmark value for zinc is 0.126 mg/l and the benchmark value for copper is 0.010 mgll. These values were revised to be consistent with the most recent EPA National Recommended Water Quality Criteria (Acute) for dissolved zinc and dissolved copper, then translated to total recoverable metal values for NPDES permitting purposes. We anticipate incorporating these revised benchmark values into General Permit NCG030000 upon renewal in 2017. If industrial practices change, and copper or zinc becomes a significant stormwater exposure risk, DEMLR reserves the right to withdraw this decision and reinstate the permit -specified tiered response or other actions that may be warranted by the new circumstances. This e-mail is in response to our earlier telephone conversation and recent stormwater sampling activities conducted at the Honeywell facility in Rocky Mount, NC, Certificate of Coverage NCG030043. Per our conversation, please see below for a summary of the recent sampling events conducted at the site, along with a request for Tier 11 Relief and supporting documentation. The results of the August 2014 outfall sampling revealed the following: The stormwater sample collected from Outfall No. 1 exceeded the current benchmark values for Copper and Zinc under NCG030000 (although you have noted that beginning 1/1/2014, NCDENR will be using new benchmarks of 0.010 mg/L for copper and 0.126 mg/L for zinc; assuming these values, the previous sampling results would be considered below the thresholds for copper and zinc). This served as the initial benchmark exceedance for copper and zinc at the site. Also, please note that the August 2014 sample was collected to satisfy the Jan -June sampling requirements due to a collection error during the June 2014 event (as previously documented with NCDENR). Historical stormwater data for the site is provided as an attachment to this e-mail; In response to the initial copper and zinc benchmark exceedances, a comprehensive Tier One Response was conducted at the facility to identify potential on -site sources of impact and evaluate the facility operations. Based on the results of the Tier One evaluation, the benchmark exceedances did not appear to be representative of the facility operations, considering the minimal exposure at the site and BMP implementation; Following the Tier One evaluation, stormwater samples were then collected from 6 different on -site locations (including Outfall No. 1) during the next sampling event (October 2014). The sampling locations are shown on the attached drawing, with the corresponding analytical results summarized in the attached table. This sampling approach was implemented to target potential off -site sources of impact and evaluate whether the associated run-on may have served as contributing sources for the copper/zinc exceedances observed at Outfall No. 1. The results are discussed below. As shown on the attached table, the stormwater sample collected from Outfall No.1 exceeded the current benchmark for zinc for the second consecutive sampling event (0.0698 mg/L compared to the current benchmark of 0.067 mg/Q. Therefore, by the letter of the permit, the facility would move into a Tier 2 response and monthly monitoring. However, the sampling results appear to indicate that additional off -site contributing sources may be the driving factor for these exceedances, as evidenced by the exceedance of zinc detected in Sample #3 (collected from the culvert/run-on from the southern adjacent Huttig facility and College Road) and the exceedance of copper detected in Sample #5 (collected from the culvert/run-on from the western adjacent Wesleyan College and US 301). Based on the site -specific circumstances and supporting information detailed above, we are requesting to remain under the current Tier One Response and semi-annual sampling schedule (i.e. relief from the Tier 2 monthly sampling requirement). Under this approach, the same six locations would be sampled on a semi-annual basis in 2015, with the results used to further evaluate the run-on versus run-off for the facility over time. As a follow-up, we will also submit the hardcopy DMRs to your attention for review. Some, or maybe all, of the data you have provided us so far would not be benchmark exceedances if the permit was being written today. This might be worth noting in your request. One question that came to mind after we ended our conversation earlier: In regards to the culverts where you have taken additional samples, are they made of galvanized steel? And if so, could that be a source of zinc in some of your samples? Just food for thought. This DMR covers the period from July lst to December 31st. Permit benchmarks for TSS and Pb were met. Oil and Grease benchmarks were also met; however, they were collected and analyzed in January 2014 because one of the lab sample containers from the December I I`h sample date became damaged during transport to the lab. As we discussed during our recent phone conversation, Cu, Zn and pH samples were not collected and analyzed because of a misunderstanding by the lab and the interim HSE Leader of our requirements.
