This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Please note that mine dewatering wastewater includes overflows ca sed-solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This project is located in one of North Carolina's 20 coastal counties. Coastal stormwater management rules (15A NCAC 2H .1000) may require an additional State Stormwater Permit (different from the NPDES mining activities discharge permit). Please contact Samir Dumpor in the Washington Regional Office at (252) 948-3859 to determine if you will be required to submit an application for a State Stormwater permit. The proposed permit area is in a flat, sandy, cultivated farm area, and will not present any problems regarding runoff to adjacent areas when all proposed erosion and sediment control measures are in place. The purpose of the excavation will be to return the land to agricultural status. The excavation area will be located geographically 400 feet from the nearest public highway and will be accessible only by a privately -owned access road. Excavation activities will be screened from public view on all sides by existing Vegetated sand berms, and distance across adjacent Fields. Public access to the permit area is limited by private property, and gated private road access. There will be minimum 25-ft wide uncxcavated buffers on all sides of the permit area. Upon receipt of the approved permits from NCDEQ, Mr. Crouse plans to excavate the sand stockpile back to natural ground level for farm cultivation to proceed aftenvard. Reclamation of the permit area will include grading, leveling, and establishment of groundcover on all affected areas. All adjacent landowners have been contacted and made aware of the proposed excavation operation, and land entry agreements have been obtained. The excavation area will be well marked with warning and keep out signs to prevent inadvertent public access. Nlr. Jon S. The proposed Tanglewood Sand project area served as the stockpile area for the Tanglewood Lake excavation in 2005, and the stockpiles were never fully removed from-the_site. Now„Tanglewood Development is applying-for_a.mining_permit`with the NCDEQ Division of Energy, Mineral and Land Resources to remove the sand stockpiles and return the land to cultivated farm field, beginning in April 2018. The site is located in the Elizabeth City planning) district and is not required to have a Use Permit to perform this project, though copies of all State - permits will be furnished to the Elizabeth City Planning Department. Site Description and Stockpile Removal: The 16.39-acre Tanglewood Sand excavation area consists of three adjacent large stockpiles. Stockpile A is directly adjacent to a grassed field irrigation ditch on the stockpile's east side. The head of the ditch is adjacent to the north end of stockpile A and drains southward alongside Mt. Everest Dr. to Halstead Blvd roadside ditches, and thence to Knobbs Creek and Pasquotank River. There are remnants of sedimentation control measures, silt fence, along stockpile A's eastern and southern sides, which are covered by sand or in disrepair. There are also smaller ditches, formerly field ditches, located between stockpile A and B, and between stockpiles B and C. Both ditches drain southward to roadside ditches along Conlon Way and Halstead Blvd. and thence to Knobbs Creek and Pasquotank River. Upon reclamation, the operator, Tanglewood Development, LLC, plans to remove all stockpiles completely down to surrounding natural ground level. Afterward all land in the permit area will be returned to cu� ltv ed-farmland use. - Sedimentation and Erosion Control Main area of concern with offsite sedimentation at this site is with stockpile A located adjacent to the eastern most field ditch draining from the property. Once the operator begins to excavate along the eastern flank of stockpile A, he will construct a minimum 8-ft wide by 2-ft tall berm along the ditch to prevent sedimentation from entering the ditch from the excavation area. The berm will be stabilized with groundcover and will be constructed the full length of the ditch. There is already an existing 4-ft tall sand berm with groundcover along the eastern full-length side of the ditch between the ditch and permit boundary in the field adjacent. In addition to berms along the eastern ditch, the operator will construct and maintain a riprap rock dam in the ditch as it discharges from the permit area at the southern permit boundary. This dam will serve as a final filter to screen sediment from leaving the permit area. This darn is identified on the mine map as SDO #1 (Stormwater Discharge Outfall #1), and water will be monitored for sedimentation there. Operator will also install rock dams in the other two field ditch discharge points leaving the permit area on the south side, identified on the mine map as SDO #2 and SDO #3. Water leaving these ditch discharge points will be monitored for sedimentation. Operator will install silt fence at two access road crossings of ditches for sedimentation control, illustrated on the mine map. Existing 1-ft tall by 12-ft wide grassed berm along the secondary access road, between the road and Tanglewood Lake, will prevent sedimentation from entering the lake. All erosion and sedimentation will remain inside of the permit area. The operator will construct and maintain an 8ft wide x 2ft tall grass -covered sand berm around the perimeter of the current affected area of the excavation during all phases of operation. During mining operations and dewatering, most of the water leaving the excavation will remain inside of the permit area and will only overflow through the ditches with rock dams occasionally. Any excess water passing through the ditches and rock dams will flow downstream 8.5 miles via Knobbs Creek to Pasquotank River. Maintaining the Overflow Rock Dam Structures and Ditches Inspections and maintenance are required to obtain the intended function of safely allowing stormwater discharge from the permit area, and to maintain the life of any adjacent wetlands or waters of the State. Items to inspect and maintain during the anticipated 10-year life of the mining permit are: • Remove accumulated debris from the overflow rock dam structure. • Inspect the structure for excessive settlement or seepage. • Inspect all components of the structure, including appurtenances, and repair or replace any damaged items as needed. • Inspect embankments, berms and appurtenant structures, and repair as needed. • Repair any damage to vegetated areas or berms with compacted earth fill, reshaping, sodding, reseeding and mulching as needed. • Inspect riprap outlet stabilization structures in ditches regularly, replace dislodged rock as necessary. Monitoring the Process and Effects of Stormwater Control Analytical and qualitative monitoring of stormwater will be in accordance with the NCG020000 permit, as follows: • Outflow of stormwater at each stormwater discharge outlet will be monitored semi-annually during a measurable storm event at the exit stabilization structures (discharge points) for pH, settleable solids, turbidity, and total flow. Samples will be collected and tested onsite for pH, and the remainder will be tested for the remaining parameters by a North Carolina certified lab. Analytical results will be documented in the Tanglewood Sand SPPP and reported annually to NCDEQ. • Qualitative monitoring of each stormwater discharge outlet will be performed semi-annually during a measurable storm event, results will be documented in the Tanglewood Sand SPPP and reported to NCDEQ annually. • Rain gauge data will be collected by monitoring rain gauge data monthly and after each rain event and documented in the Tanglewood Sand SPPP. • The Tanglewood Sand permit area will be inspected daily by the operator to identify any abnormal conditions. • All berms and erasion control and sedimentation control structures will be inspected for damages monthly and within 24 hours after every storm event greater than 1.5 inches, and all structures will be repaired immediately. • Special inspections will be conducted immediately following severe storms, vandalism, and other significant events. Records Data will be collected as follows: • The operator will implement and maintain a Stormwater Pollution Prevention Plan (SPPP) for this site. The operator requests NCDEMLR to allow the SPPP to be maintained offsite at the offices of Elliott Consulting, PO Box 112, 202 Elliott Road, Aydlett, NC 27916, as there are no offices or buildings owned by Tanglewood Development LLC onsite. The SPPP will be available for inspection by NCDEMLR personnel at any time. • Data will be collected from samples taken from the three stormwater point source discharges in operation at the time. • Point source discharge data: data from the site taken semi-annually, date & time, general weather conditions, pH of sample, status of process at point source, inlet or outlet, other DWQ required data. • Visual monitoring of farmland for potential flooding or dehydration during excavation activities will take place weekly. Solutions to any degradation caused by any mining activity will include alteration of excavation processor sedimentation control implementation. DWQwill be consulted as needed; alterations to process will be recorded. • Elliott Consulting will maintain the following records in a permanent file at the Elliott Consulting office at PO Box 112, 202 Elliott Road, Aydlett, NC 27916: a record of all significant actions taken; as -built drawings; permits; analytical results from sampling; and related material. Copies of all inspections, monitoring reports and lab analyses shall be provided to NCDWQon a regular basis and as requested. BMP Conditions • The permittee will utilize best management practices to ensure that dewatering the Bayview Sand Mine will not degrade or negatively impact any wetlands or waters of the State. BMP's will include: o All berms, rock dams and erosion control and sedimentation control structures will be inspected for damages monthly and within 24 hours after every storm event greater than 1.5 inches, and all structures will be repaired immediately. o Outlet ditches will have rock lining or riprap stone layer to prevent erosion, scour or sloughing of embankment.
