REGAN Secretary TRACY DAVIS Director Subject: General Permit No. NCG020000 412 Quarry COC NCG020910 Forsyth County Dear Mr. Johnson: In accordance with your application for a discharge permit received on October 5, 2016, we are forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources, The Division may require modification or revocation and reissuance of the certificate of coverage. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Also, you may be required to apply for a separate Post -Construction stormwater permit from the State or local government (Winston-Salem in this case) if you are adding built -upon area at this site. Please see guidance on our website for mines located in Phase 1Z Post -Construction areas (in the table along with the NCG020000 General Permit, on this page: (http://deq.nc.gov/about/divisions/energy- mineral-land-resources/energy-mineral-land-permitslstormwater-permits/npdes-industrial-sw). This guidance clarifies the applicability of Session Law 2006-246 to mines located in Phase II Post - Construction areas. -:5'Nothing Compares--,,.,, SState of North Carolina i Environmental Quality I Energy. It is anticipated that the quarry would be pumping pit water at a rate of 1200 gallons per minute. Continuous pumping would be rr dewalered. After that point, She flow rate may be reduced depending on the amount of rainfall that occurs each day. Per our conversation, the owner is applying for a NPDES permit that allows direct discharge into the stream. The runoff Is tested during the pumping operations to ensure that it complies " limits. The water being pumped is the stormwater runoff collected from the upstream drainage basin, runoff from the site that flows into the pit, and any groundwater that seeps into the Qua The NPDES permit applications requires that the owner evaluate other options for treatment including available sewer, In order respond to this question. I would like to get an email about th or the Utility's position about accepting the pit discharge and project runoff into the sewer system. Please call if you have any questions. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. 10. Visual Screeninq Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. Page 9 11. Plan Modification A. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Received FEB 21 2017 s•; Winston-Salem W Regional Office Subject: General Permit No. The Division may require modification or revocation and reissuance of the certificate of coverage. Please see guidance on our website for mines located in Phase Il Post -Construction areas (in the table along with the NCG020000 General Permit, on this page: (http://deg .nc.gov/about/divisions/energy- mineral-land-resourceslenergy-mineral-land-permits/stormwater-permits/npdes-industrial-sw). This guidance clarifies the applicability of Session Law 2006-246 to mines located in Phase 11 Post - Construction areas.
