This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section E of your permit. You must follow your approved Operation and Monitoring Plan during mine dewaterinz discharges at your facility. Discharging mine dewater wastewater outside of the parameters discussed in the approved Plan will be subject to enforcement action. For the purpose of this permit, a responsible corporate officer means: (a) a president, secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or operating facilities employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. (2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or (3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official. I hereby request coverage under the referenced General Permit. I understand that coverage under this permit will constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an individual permit. INTRODUCTION Sawmill Land and Sand Mine is an existing mine site, Mining Permit No. 10-90, issued October 25, 2013. Mining operations began at the existing mine site in February 2014. The permitted acreage atz'the site is.55.94 acres, and the amount of land approyed.to be disturbed is 44.25 acres. The site is located off Sawmill Road (SR 1425), in Northwest, Brunswick County. The materials permitted to be mined are sand, clay and marl by shovel and truck, The expected average depth of the site is 28 feet, with a maximum depth of 42 feet. All areas within 500 feet of the mining excavation are served by Northwest Municipal Water System. r. ; A jurisdictional deteiriiination was approved by the US Army Corps 4 Engineers (the Corps) on 06/01/09 (SAW-2008-02120). The applicant is currently coordinating with the Corps to renew this determination. On February 19, 2015 the permit was modified to include dewatering activities to manage the mining pit when the excavation extends below the water table. The mining site is located adjacent to wetlands. The North Carolina Administrative Code includes Wetland Standards, 15A NCAC 02B.0231(b)(5), requiring that, "Hydrologic conditions necessary to support the biological and physical characteristics naturally pr'esebt in wetlands shall be protected to prevent adverse impacts". I. PUMP DEWATERING SIZE AND INFORMATION ON ITS SPECIFICATIONS It is anticipated that a maximum of 100,000 gallons a day will be pumped during mining excavations, using a 4" pump with a maximum pumping capacity of 450 GPM (gallons per minute). 2. PHYSICAL MONITORING FOR THE WETLAND AREAS Groundwater monitoring strategies must be used to demonstrate the effect of pumping does not impact the wetland hydrology. Visual inspections shall be performed quarterly. Visual inspections shall include observation of wetland characteristics, surface water elevation, and soil saturation. Any apparent adverse changes of characteristics shall be immediately communicated with the North Carolina Department of Environment -and' Natural Resources (DENR) Wilmington Regional Office. All pumping operations shall cease until the Regional Office can conduct a field visit to evaluate the site conditions. In addition, the Mine Operator may choose to retain a Professional Soil Scientist licensed in the State 'of North Carolina to perform a site visit and evaluate the area using the Corps Wetland Hydrology Indicators, 3. SETTLING POND SIZING INFORMATION A stilling basin has been designed to hold 100,000 gallons, which exceeds the required 425 SF of surface area for the maximum pumping capacity. Rip -rap protection will be installed at the pump discharge point into the basin, and at the outlet weir, to prevent scouring. 4. LEVEL SPREADER DESIGN A level spreader is not proposed for this design since the stilling basin is sized in excess of the required 425 SF of surface area for the maximum pumping capacity. S. DETAILS ABOUT DEWATERING METHOD Pumping operations will be limited to mine operating hours of the facility. All water shall be pumped from the surface of the standing water in the mine excavation and shall be directed to a proposed stilling basin prior to discharge. The pump will be placed in the mining excavation greater than 400' from adjacent wetlands. The receiving stream for the dewatering discharge is Rattlesnake Branch, water classification C; Sw. The wetland areas are upgradient to Rattlesnake Branch, therefore it is expected that all pumped water will recharge the wetlands, maintaining their hydrology. L 6. DESCRIPTION OF MEASURE TO PREVENT EROSION AND FLOODING All development will be in accordance to the Best Management Practices and the North Carolina Erosion and Sediment Control Planning and Design Manual. These measures include temporary diversions, temporary sediment basins and a stilling basin.. The stilling basin shall remain until all pumping operations are complete. The pump location and stilling, basiWare within• the permitted mine boundary, and can be mined upon completion of pumping operations.
