This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. A requirement of this permit is compliance with the Division of Land Resources' (DLR) Miningfermi therefore, you must hold an approved DLR permit before any mining industrial activities take place. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part 111, Section E of your permit. You must have an, approved Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. We understand you are currently working with Linda Willis at the Wilmington Regional Office (910-796-7215) on developing this. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. (2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or (3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official. The outer limits of proposed borrow pits 4 and 7 are within 400 feet of jurisdictional features. These proposed borrow areas will need to be evaluated according to the NCDOT standard described below. Section 230 — Borrow Excavation, of the "North Carolina Department of Transportation Standard Specifications for Roads and Structures, July 2006" requires that if a Contractor proposes a borrow source, an environmental assessment will be conducted that includes a wetland and stream delineation extending 400 feet beyond the proposed borrow source limits. This section requires that if wetlands and streams are present within 400 feet of the borrow source: 1. Submittal of a hydrologic analysis (Skaggs Method) or equivalent to determine if lateral effects will impact or cause degradation to wetland or streams consisting of but not limited to: a) Hydric soil type; b) Average profile depth to restrictive soil layer; c) Effective hydraulic conductivity or permeability; d) Average drainable porosity or available water capacity; and e) Required buffer width, including safety factor. 2. If wetlands and streams are present within 400 feet and the contractor does not propose to excavate below the seasonal high water table or the water level in the adjacent stream, no documentation is required. 3. If wetlands or streams are not present within 400 feet, no additional documentation is required. AM EC scientists collected field data on April 8, 2010 for borrow pits 4 and 7. Field data collected included: soil profile descriptions to determine soil series present; depth to seasonal high water table; depth to restrictive layers; and existing ground elevations of jurisdictional features. The soils were described by a MACTEC licensed soil scientist. The soil borings and elevation surveys were completed at previous geotechnical boring locations that were within 400 feet of a jurisdictional feature. These geotechnical boring locations were located by survey and the ground surface elevations are known. The results of the lateral effect evaluation and recommended buffers are presented below. Borrow Pit 4 Borrow pit 4 is located between Stone Street and Wallace Creek, and is less than a half -mile west of the proposed roadway alignment. Pit #4 is approximately 17 acres in size. The site is heavily wooded with thick undergrowth. The overall slope of the land is south-east toward Wallace Creek which is classified as SB; NSW. The existing elevation for this site ranges from 16 feet to 24 feet msl. Access to borrow pit 4 will be from Stone Road. The soil boring and elevation data were collected at boring BP4-15. The soils present at this location are generally similar to the Baymeade fine sand soil series. According to data collected by AMEC, the seasonal high water table (SHWT) was observed at 2.5 feet (30 inches) below ground surface (BGS). The elevation of the jurisdictional feature adjacent to BP4-15 was determined to be approximately 10-11 feet below ground surface. The ground surface elevation of the stream channel is 7.5-8.5 feet below the SHWT depth. Based on observed SHWT, water in the pit once it has reached equilibrium is anticipated to be above the stream elevation. Therefore, based on approved NCDOT methodology for determining minimum buffer requirements, the proposed Borrow Pit 4 would be considered a Type 2: Flow from pit to wetland. Type 2 pits do not require Skaggs Method calculations. A minimum setback of 50' feet from the jurisdictional feature will be required. Borrow Pit 7 Borrow pit 7 is approximately 1-mile south of the southern tip of the proposed alignment along Sneads Ferry Road. Pit #7 is the largest of all is spread across approximately 42 acres. However, a significant portion of Pit #7 is covered by shallow water as a result of previous borrow pit excavations. The site is primarily clear of vegetation with the exception of one small area of existing pine trees in the middle of the propose pit. The site is generally flat with elevations ranging from 23 feet to 28 feet msl. Drainage from this area is naturally directed toward two existing excavations pits on -site and ultimately flows towards Cowhead Creek which is classified as SC; NSW. Access to borrow pit 7 will be from an existing dirt road to the south of the proposed pit. The soil boring and elevation data were collected at boring BP7-19. The soils present at this location are generally similar to the Onslow loamy fine sand soil series. According to data collected by AMEC, the seasonal high water table (SHWT) was observed at 1.5 feet (18 inches) below ground surface (BGS). The elevation of the jurisdictional feature adjacent to BP4-15 was determined to be approximately 2.0 feet above ground surface. The elevation of the SHWT in the borrow pit is approximately 3.5 feet below the surface elevation of the upstream wetland. Based on observed SHWT, water in the pit once it has reached equilibrium is anticipated to be below the stream elevation. Therefore, based on approved NCDOT methodology for determining minimum buffer requirements, the proposed Borrow Pit 7 would be considered a Type 1: Flow from wetland to pit. These plans may use similar stormwater best management practice (BMP) components as part a of a site specific stormwater pollution prevention plan (SWPPP). This document will identify and describe all measures necessary to protect water quality and nearby wetlands for the borrow pit activities. Compliance with Part II Section A: Requirements to Construct New or Expanding Treatment Facilities. Session Law 2011-394 Section 9 discontinued ATC requirements as of July 1, 2011 for wastewater treatment and disposal systems at industrial facilities with discharge permits. This change affects NCG020000 for mine dewatering. The proposed borrow pit 7 will follow guidance from NCDENR associated with NCG020000. Compliance with Part III Section A: Monitoring, Controls, and Limitations for Permitted Discharges. A Stormwater Pollution Prevention Plan (SWPPP) that can be easily understood and followed by borrow pit workers is required to be developed and implemented. A SWPPP is attached to this document. The SWPPP addresses items 1 through b in Section A of Part III, including a site plan, erosion and sedimentation control plan, stormwater management plan, spill prevention and response plan, preventative maintenance and good housekeeping program, and employee training. Compliance with Part III Section C: Effluent Limitations and Monitoring Requirements for Mine Dewatering Wastewater and Process Wastewater. This section of the permit requires permittees to provide an Operation and Monitoring Plan that demonstrates the effect of pumping, and as necessary, establish a pumping regime necessary to reduce potential impacts to adjacent wetlands. All wetlands in the vicinity of borrow pit 7 have been delineated and the Corps has verified the wetland boundaries. Wetlands have been surveyed and located on the borrow pit plans. As requested on page 5 of the NPDES NCG020000 permit application, the wetland delineation is attached. There will be two types of discharge from the borrow pit site, stormwater runoff and mine dewatering. Compliance with Part III Section B: Stormwater Discharges: Analytical Monitoring Requirements. Part III Section B defines stormwater discharges as stormwater from mining activity areas, including but not limited to areas of mine excavations, other land disturbance, process areas, and vehicle maintenance. This section does not apply to wastewater discharges from mine dewatering and process areas. Analytical monitoring is not required for any basin or pond designed to contain the 25- year, 24-hour storm without discharging and that can regain capacity to hold such an event within 5 days time through means other than discharging to surface waters. A basin or pond that meets these requirements is considered a non -discharging stormwater control. Calculations were performed to take into account the rainfall on the borrow pits and the area immediately around them and draining to them. A 25-year storm event causes a rise in the excavation area of 1.7 ft. Based on these calculations and the fact that the observed ground water is approximately 2.3 ft below ground surface, this pit is non -discharging. Compliance with Part III Section C: On -Site Vehicle Maintenance Monitoring Requirements. Facilities that have on -site vehicle maintenance activity that use more than 55 gallons of new motor oil per month averaged over a calendar year must perform analytical monitoring of stormwater discharge. No vehicle maintenance will be performed on this site. Any maintenance performed on vehicles used in the removal or transport of borrow material from this site will be performed at off -site locations. Compliance with Part III Section D: Qualitative Monitoring Requirements for Stormwater Discharges. This section of the permit requires that a visual inspection of each stormwater outfall regardless of representative outfall status shall be performed according to semi-annual qualitative monitoring requirements. Qualitative monitoring is intended to evaluate the effectiveness of the SWPPP, assess new sources of stormwater pollution, and prompt the permittee's response actions to pollution. Qualitative sampling at each outfall must take place during a representative storm event as defined for this General Permit, unless adverse weather conditions prevent sample collection during the sample collection period. Inability to sample due to adverse weather conditions must be documented in the SWPPP with date, time, and written narrative. A minimum of 60 days must separate monitoring dates. Compliance with Part III Section E: Effluent Limitations and Monitoring Requirements for Mine Dewatering Wastewater and Process Wastewater. Mine dewatering requirements apply to all mines including borrow pits. During the period beginning on the effective date of the permit and lasting until expiration, the permittee is authorized to discharge mine dewatering wastewater controlled in accordance with conditions of this permit. It shall be the responsibility of the Contractor to provide the EMD with withdrawal totals meeting NCDENR CCPCUA permit requirements and in accordance with any monitoring requirements set forth by this permit for which this application is intended. An evaluation of soils, seasonal high water table (SHWT), and ground surface elevations reveals the underlying soils present are generally Baymeade fine sand, Muckalee loam, and Onslow loamy fine sand. The highest recorded groundwater level in the piezometer was 2.3 feet below the EGS. Based on observed SHWT, water in the pit, once it has reached equilibrium, is anticipated to be below the wetland elevation. Therefore, based on approved NCDOT methodology for determining minimum buffer requirements, the proposed Borrow Pit 7 would be considered a Type-1: Flow from wetland to pit. Type-1 pits required Skaggs Method calculations, or approved equivalent. The Skaggs analysis indicated that the setback from the jurisdictional features should be approximately 172'. l Borrow Pit 7 MCB Camp Lejeune, Onslow County, NC Stormwater Pollution Prevention Plan (SWPPP) Site Plan. A site plan providing a physical description of the facility and its location relative to surrounding roads and surface waters is attached. A USGS topographic quad map shows the borrow pit relative to the features around it. See figures attached with mining permit application. This property drains through wetlands to Cowhead Creek and from there to New River in the White Oak River Basin. Cowhead is not on the 303(d) list. This is not a TMDL watershed. Narrative. The site was cleared in the past and some soil was excavated as cover for the old landfill at MCB Camp Lejeune. Because of this past use, there is standing shallow water in two areas of the borrow pit. The center part of the pit has some trees that need to be cleared. This area will be cleared and drained in order to be used as a borrow pit to construct a new Base Entry Road at MCB Camp Lejeune. Erosion and sediment control devices will be installed according to the approved mining permit prior to any earth moving on site. Topsoil and other unsuitable fill material will be temporarily stockpiled and stabilized on site during active excavation of the borrow pit. The stockpile will be removed and topsoil spread over the site prior to seeding it as part of the remediation plan. The borrow pit is designed to be up to 30 feet deep. Dewatering is proposed to facilitate excavation activities down to design depth. Dewatering discharge will be filtered, dispersed, and released at a non -erosive velocity into wetlands behind the borrow pit. There will be no process or unloading activities on the site. The site will be operated strictly as a source of fill material to be used in the construction of the Base Entry Road on MCB Camp Lejeune. There will be no vehicle /machinery maintenance on site. There have been no significant spills or leaks on the site. The construction contractor will be responsible for all sampling and monitoring requirements for the life of this permit. Erosion and Sedimentation Control. A mining plan for this borrow pit has been prepared and submitted to NC Department of Natural Resources — Land Quality Section for review and approval. Erosion control is an integral part of this plan. A copy of the mining permit application is attached. Stormwater Management Plan. Management of Stormwater Runoff and Runon — Silt fence will be installed around the perimeter of the borrow pit. Temporary diversion swales are proposed to carry runoff to stilling basins for treatment before it is released through a skimmer device. Sediment stilling basins may be removed once stormwater runoff is directed into excavation area of the borrow pit. Once stormwater runoff mixes with groundwater, it must be treated as wastewater if removed from the mine. In general most stormwater runoff will enter the borrow pits and not be discharged from the site. Slope drains may be installed to direct stormwater into the borrow pit in a non -erosive manner. BMP Control Inspection and Maintenance — Stilling ponds with skimmers, silt fence, and slope drains will be inspected and inspections will be recorded once every seven days and within 24 hours of any storm event that results in a discharge from an active site. A rain gauge shall be kept on site and rainfall amounts shall be recorded. Stilling ponds must be cleaned out when sediment storage capacity is at 50% permitted volume. If sediment is leaving the site, corrective action shall be taken to reduce sediment discharge. Corrective actions shall be recorded. The record book shall be maintained on site for the duration of borrow pit operations and made available to DENR inspectors at their request. Secondary Containment will be the responsibility of the Contractor as detailed in the Contractor's specific Operation and Maintenance plan. Spill Prevention and Response Plan (SPRP). The site will be used for loading mined sand/clay suitable to build a road bed. There will be no transfer of fluids or other pollutants that would necessitate a SPRP. Preventive Maintenance and Good Housekeeping. The permittee is informed of the requirement to maintain all mining equipment in good working order to prevent any discharge of pollutants into surface water or groundwater. Any fluids spilled on site shall be cleaned up to the maximum extent practicable and properly disposed of to prevent entry to surface waters or groundwater of the state. Schedules for inspections, maintenance, housekeeping, and documentation shall be recorded and maintained in the SWPPP. Employee Training. The permittee is responsible to identify and train all personnel in any of the mining operations that have the potential to contaminate stormwater runoff. Training will cover spill response and cleanup, preventive maintenance activities, and any operations that have the potential to contaminate stormwater runoff, such as fueling procedures. This training is to take place at the start of mining operations and at a minimum on an annual basis. Training shall be documented by the signature of each person trained. Plan Amendment. The permittee shall amend the Plan whenever there is a change in the design, construction, operation, or maintenance that has a significant effect on the potential for discharge of pollutants to surface waters. All aspects of the SWPPP shall be reviewed and updated on an annual basis. The annual update shall include an updated list of significant spills or leaks of pollutants for the previous three years, or notification that no spills have occurred. The annual update shall include written re -certification that the stormwater outfalls have been evaluated for the presence of non-stormwater discharges. Each annual update shall documented re-evaluation of the effectiveness of the BMPs listed in the BMP summary of the Stormwater Management Plan. Plan Implementation. The permittee shall implement the Plan and all appropriate BMPs to ensure contaminants do not enter surface waters via stormwater that comes into contact with any unstabilized overburden, raw materials, intermediate products, finished products, byproducts, or waste products located on the site covered by this permit. Implementation of the plan shall include documentation of all monitoring, measurements, inspections, maintenance activities, and training provided to employees. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions, Show all buffer locations and widths on the mine map(s), A 25-FOOT MINIMUM WIDTH UNEXCAVATED (UNDISTURBED) BUFFER WILL BE ESTABILISHED AROUND THE EDGE OF THE PERMIT BOUNDARY. b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. THREE TO ONE (3:1) SIDESLOPES WILL BE ESTABLISHED DOWN TO THE WATERLINE AND TWO TO ONE (2:1) SIDESLOPES BELOW THE WATERLINE TO ENSURE VERTICAL STABILITY Of THE BORROW PIT; UNLESS THE CLAY CONTENT IS SUCH THAT IT CAN SUPPORT STEEPER SIDESLOPE. HOWEVER, THERE WILL BE NO SLOPE STEEPER THAN 2:1. STOCKPILES WILL BE TEMPORARILY SEEDED TO IMPROVE STABILITY AND REDUCE EROSION. REFER TO THE MINE MAP FOR EACH BORROW PIT. c. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all out slopes including specifications for benching and sloping. Cross -sections jbr all cut slopes must be provided on the mine map(s). THREE TO ONE (3:1) SIDESLOPES WILL BE ESTABLISHED DOWN TO THE WATERLINE AND TWO TO ONE (2:1) SIDES LOPES BELOW THE WATERLINE TO ENSURE VERTICAL STABILITY OF THE BORROW PIT; UNLESS THE CLAY CONTENT IS SUCH THAT IT CAN SUPPORTA STEEPER SIDESLOPE NO STEEPER THAN 2:1. A 5-FOOT WIDE BENCH LOCATED APPROXIMATELY AT THE WATER TABLE ELEVATION WILL BE CONSTRUCTED, ADDITIONAL BENCHES WILL BE ESTABLISHED AS NEEDED WITHIN THE PIT. d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches, and the expected maximum depth of the excavation. NO HARDROCK EXCAVATIONS ARE PROPOSED AS PART OF THIS PROJECT. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. THE ONLY STRUCTURES WITHIN 300 FEET OF ANY PROPOSED EXCAVATION ARE ROADWAYS. CONSTRUCTION ENTRANCES WILL BE CONSTRUCTED OFF OF ANY PAVED ROAD AND OFF OF DIRT/GRAVEL IF THERE IS A SIGNIFICANT CHANCE FOR SEDIMENT TO BE CARRIED OFF -SITE ON VEHICULAR TRAFFIC. TO THE GREATEST EXTENT PRACTICAL, CONSTRUCTION TRAFFIC WILL UTILIZE EXISTING HAUL ROADS TO AVOID AND MINIMIZE TRUCK TRAFFIC ON EXISTING PAVED ROADS WITHIN MCB CAMP LEJEUNE. 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable high wall barricades. A construction etail/cross-section and location of each type of barricade to be used must be indicated on the mine map(s). HIGH WALL AREAS ARE NOT ANTICIPATED IN ANY OF THE BORROW PITS; THEREFORE, THIS IS NOT APPLICABLE. Could the operation have a significantly adverse effect on the purposes of a publicly owned park, forest or recreation area? Ifi so, how will such effects (i.e., noise, visibility, etc.) be mitigated? NO PUBLICALLY OWNED PROPERTY 15 LOCATED AROUND THE BORROW PITS. ALLSURROUNDING AREA IS OWNED BY MCB CAMP LEJEUNE; THEREFORE, MITIGATION 15 NOT REQUIRED. 11. Will explosives be used? Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land. This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This information must be illustrated on a reclamation map and must correspond directly with the information provided on the mine map(s). In addition, design information, including typical cross -sections, of any permanent channels to be constructed as part of the reclamation plan and the location(s) of all permanent channels must be indicated on the reclamation map. A 5-FOOT WIDE BENCH WILL BE CONSTRUCTED APPROXIMATELY ATTHE WATERLINE ELEVATION. SLOPES ABOVE THE WATERLINE WILL BE SEEDED WITH AN APPROVED MIXTURE OF GRASS BASED ON THE SEASON. Is an excavated or impounded body of water to be left as a part of the reclamation? PLACE THE BARREL (TYPICALLY 4-INCH SCHEDULE 40 PVC PIPE) ON A FIRM, SMOOTH FOUNDATION OF IMPERVIOUS SOIL. DO NOT USE PERVIOUS MATERIAL SUCH AS SAND, GRAVEL, OR CRUSHED STONE AS BACKFILL AROUND THE PIPE. PLACE THE FILL MATERIAL AROUND THE PIPE SPILLWAY IN 4-INCH LAYERS AND COMPACT IT UNDER AND AROUND THE PIPE TO AT LEAST THE SAME DENSITY AS THE ADJACENT EMBANKMENT. CARE MUST BE TAKEN NOT THE RAISE THE PIPE FROM THE FIRM CONTACT WITH ITS FOUNDATION WHEN COMPACTING UNDER THE PIPE HAUNCHES. 5. PLACE A MINIMUM DEPTH OF 2 FEET OF COMPACTED BACKFILL OVER THE PIPE SPILLWAY BEFORE CROSSING IT WITH CONSTRUCTION EQUIPMENT. THIS WILL BE USED TO PULL THE SKIMMER TO THE SIDE FOR MAINTENANCE. 8. EARTHEN SPILLWAYS - INSTALL THE SPILLWAY IN UNDISTURBED SOIL TO THE GREATEST EXTENT POSSIBLE. THE ACHIEVEMENT OF PLANNED ELEVATIONS, GRADE, DESIGN WIDTH, AND ENTRANCE AND EXIT CHANNEL SLOPES ARE CRITICAL TO THE SUCCESSFUL OPERATION OF THE SPILLWAY. THE SPILLWAY SHOULD BE LINED WITH LAMINATED PLASTIC OR IMPERMEABLE GEOTEXTILE FABRIC. USE TEMPORARY SLOPE DRAINS OR DIVERSIONS WITH OUTLET PROTECTION TO DIVERT SEDIMENT -LADEN WATER TO THE UPPER END OF THE POOL AREA TO IMPROVE BASIN TRAP EFFICIENCY. 10.EROSION CONTROL - CONSTRUCT THE STRUCTURE SO THAT THE DISTURBED AREA IS MINIMIZED. RE -ANCHOR THE BAFFLES IF WATER IS FLOWING UNDERNEATH OR AROUND THEM. 3. IF THE SKIMMER IS CLOGGED WITH TRASH AND THERE IS WATER IN THE BASIN, USUALLY JERKING ON THE ROPE WILL MAKE THE SKIMMER BOB UP AND DOWN AND DISLODGE THE DEBRIS AND RESTORE FLOW. IF THIS DOES NOT WORK, PULL THE SKIMMER OVER TO THE SIDE OF THE BASIN AND REMOVE THE DEBRIS. ALSO CHECK THE ORIFICE INSIDE THE SKIMMER TO SEE IF IT IS CLOGGED; IF SO REMOVE THE DEBRIS. 4. IF THE SKIMMER ARM OR BARREL PIPE IS CLOGGED, THE ORIFICE CAN BE REMOVED AND THE OBSTRUCTION CLEARED WITH A PLUMBER'S SNAKE OR BY FLUSHING WATER WITH WATER. BE SURE TO REPLACE THE ORIFICE BEFORE REPOSITIONING THE SKIMMER. 5. CHECK THE FABRIC LINED SPILLWAY FOR DAMAGE AND MAKE ANY REQUIRED REPAIRS WITH FABRIC THAT SPANS THE FULL WIDTH OF THE SPILLWAY. CHECK THE EMBANKMENT, SPILLWAYS, AND OUTLET FOR EROSION DAMAGE, AND INSPECT THE EMBANKMENT FOR PIPING AND SETTLEMENT. MAKE ALL NECESSARY REPAIRS IMMEDIATELY.
