Skvarla, HI, Secretary Based on observations made on December 10, 2013 at the Cedar Creek Mine located on Gen Boykin Ave in Sampson County, North Carolina, it has been determined that coverage under the NCG020000 General Stormwater Permit for Mining Activities may be rescinded. Specifically, the channel and associated sediment basins that were installed as erosion and sedimentation control measures appeared to have a base flow and lead to a rock weir where sampling of stormwater and/or process wastewater discharges could not reasonably be collected. Enclosed is a copy of the Rescission Request Form to be completed and submitted to the Stormwater Permitting Program at the address on the bottom of the form. This NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be submitted at least 90 days prior to construction'. For existinct mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities: This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place. Construction, modification, or installation of any new treatment components at an existing_site requires an ATC. The lat/long on their NOI is slightly different from the coordinates on the USGS map that you/they provided. Based on the lat/long on the NOI, the site would be a little further northeast between the Sampson County Airport and the UT to Great Coharie Creek where there is a small blue line stream. If the mine site is where the plateau is located and stormwater drains due north, then there does appear to be a UT coming from a large pond to the east and flowing west toward Great Coharie Creek. There doesn't appear to be in any wetlands in the area. The NOI states only 1 stormwater outfall and no dewatering or process wastewater discharges. The FRO has no objections to issuance of permit coverage. It is on kind of a plateau that falls off pretty sharp to the west before getting to Great Coharie Creek. They state that it discharges to a UT of Great Coharie Creek, but based on the USGS map and our GIS data, there is not a UT in/near the mine. I've attached a few maps. I did call the engineer about it. I asked several times whether they were or would be dewatering, and he insisted they would not. The bottom of the pit is at the top elevation of the sediment basin with a rock dam. Let me know what you think. The facility, Cedar Creek Mine, drains to Great Coharie Creek (class C; Sw) in Clinton (Sampson County). It is located off of Boykin Bridge Rd, south of Clinton, about 100 ft south of Boykin Drive. Google shows the haul road as Annie Bell Ln. No dewatering, vehicle maintenance or haz waste. Their DLR permit expired and the renewal is almost complete; they are waiting on the bond.
