Based on information that Mr. Tony Harris provided to Mr. Mike Lawyer of the Fayetteville Regional Office, we understand there will be no discharges associated with mine dewatering or other wastewater and no stormwater discharges from this mine site. Therefore, we are returning your NOI application because an NPDES permit is not required. The Division reminds you that any mine dewatering discharges and/or stormwater discharges to surface waters are subject to the NPDESpermit requirement, and any discharges without a permit will be subject to enforcement action. Please note that for industrial and construction sand mining operations, mine dewatering wastewater includes. wet pit overflows caused solely by direct rainfall and groundwater seepage. If you ever anticipate discharges of this nature from this mining site, you must reapply for an NPDES permit. During our review, the Division noted this mine boundary drains to a watershed designated under an Outstanding Resource Waters (ORW) Special Management Strategy specific to the Black River and associated tributaries. As per 15A NCAC 02B .0225 (e)(9), no new discharges of wastewater are allowed to the Black River ORW area, and a more stringent TSS limit applies to new wastewater discharges located one mile upstream of stream segments designated ORW. Please also be aware that any dewatering at this site has the potential to impact nearby wetlands. Requirements for mine dewatering at such facilities covered under General Permit NCG020000 can be found in Section C, Part I of NCG020000 (Part III Page 5'of 9). If activities at Ivanhoe Pit #2 ever require an NPDES permit, it is likely you will need an approved Operation and Monitoring (O&M) Plan before mine dewatering discharges could occur. Regardless of whether an NPDES permit applies, under no circumstances may dewatering activities at this mine drain or otherwise impact wetlands or other surface waters, or the company could be held responsible for water quality standard violations. This mine is currently awaiting a renewal/modification approval to its Mining Permit No. 82-19, The application says the site currently operates with hyrdraclic dredge (no discharge), but future mine development may necessitate dewatering discharge. Apparently they would pump any mine dewatering water to a UT to the Black River (Class C; Sw, ORW+). A copy of the NOI is attached, along with a map I made. Unfortunately the site drawings are too large for me to scan. Some important special issues with this one: 1. This part of the Black River is classified ORW with a Special Management Strategy under the 2B .0200 rules. No new NPOES wastewater discharges are allowed to the mainstem, but they are allowed into tribs within one -mile with certain effluent limits. Our NCG02 permit covers those -- 20 mg/1 TSS would apply (Technically, this ORW area is a subset of HOW). However, it's imperative that we ensuredischarges would in fact he to -a tributary, and not directly to the Black River, or wed can't issue the permit:` (They are definitely within the mile buffer -- see my map). Also, we need td[COnsider whether the applicant will be able to meet those TSS limits with the proposed dewatering strategy-', 2. You'll notice from the NOI that the applicant doesn't think this site needs an O&M Plan because they anticipate "no groundwater impact." From the site plan, it's apparent there are wetlands contiguous to the mine (in fact, that's where all the temporary dewatering basins are shown), so I'm sure-it--will_need an 06M'Plan., We need to educate them on this point. [I was just out in the field last week in Onslow County and saw a sand mine dug right into wetlands, and it was a mess...you could see the water trickling through into the pit, and it had been pumped indiscriminately until DWO gat involved.] Depending on how well they understand the requirement, it may take some time to get them where they need to be on that issue. 3. There are some endangered aquatic species (State listed, not federal) in the area (Barrel Floater mollusk), and state and federal 'species of concern' (Thinlip Chub?, Dwarf Salamander, Broadtail Madtom catfish) as well. The occurrence data Fro- the Natural Heritage database is ranked "low" accuracy, but it is still something to be aware of. Again, we need to make sure any dewatering can \ achieve TSS limits -and does not impact adjacent wetlands.) Does the Fayetteville Regional Office have any concerns about issuing this facility a COC for this general permit? ATC requests must be submitted at least 90 days prior to construction'. For existing mining sites that require an Authorization to Operate (A TO) wastewater treatment facilities: This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place. Construction modification or installation of any new treatment components at an existing site requires an ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI). Some wastewater treatment facilities used to treat or recycle process wastewater (even if commingled with stormwater) at mining sites will require an ATC prior to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which treatment facilities require an ATC (summarized in Table 1 at the end of this form). For example, an ATC is required for treatment of mine dewatering discharge from clay pits and non -closed -loop wastewater recycle systems. The authorization to construct or continue to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit.
