This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate.of coverage. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other federal or local governmental permit that may be required. The application included a copy of an associated application for a mining permit submitted to the Division of Land Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated mining permit from DLR. PURPOSE In order to facilitate "dry" mining techniques, perrnission is being sought to dewater the proposed excavation. AQUIFER iNF ORMATION According to the NCDENR, Division of Water Resources, Visual Hydrogeologic Framework, North Carolina hydrogeological Database website, four hydrogeologic units are present within the proposed maximum depth of the mine site; the Surficial aquifer, Yorktown confining unit, Yorktown aquifer, and Beauforf confining unit. The fop of the.Yorktown confining unit and Yorktown aquifer are estimated to be approximately 36-37 feet below the existing ground elevation The proposed average and maximum mine depths are 45 and 50 feet, respectively. This information is based upon the approximate center of the mine (lof 35.315N, long 77.369722W) and data recorded from NDENR boreholes nearest the mine. The groundwater surface elevation in the vicinity of the mine -has not been observed, but is estimated to be opproximoteiy 5-8 feet below the existing ground. PUMP INFORMATION Manufacturer, pun-sp model and capacity information are not currently available: A maximum pump capacity of 2,000 gallons per minute is proposed. This estimated maximum is expected to exceed actual pumping requirements. The pump(s) will be positioned within the active mine pit and used to provide a lowered water surface elevation to a maximum depth of 50 feef below existing grade (corresponding to approx. 40 feet below the existing groundwater elevation). PUMP OPERATIONS Pumping will be employed as groundwater is encountered, and the pumps] will be utilized as required to maintain a water surface elevation that is siigh iy lower than the excavation bottom to enable the use of "dry" mining techniques. Continuous use of the proposed pump(s) of maximum capacity will result in approximately 3,000,000 gallons of water removed from the active excavation pit per day. It is recommended that pumping activities be suspended whenever periods of inactivity at the mine will lasf longer than the time required to dewater file active pit. PUMP DISCHARGE The dewater pump(s) will discharge into the proposed perimeter swale and sedimenf basin. Water will iecve the site through the existing drainage diich. 3 of 4 The'mine is iocaied within the Neuse River Basin, and the nearest surface water is an unnamed tributary of the Neuse River that is located north of NC HWY 55. An existing drainage ditch that provides a connection to the unnamed tributary is located on the proposed mine site, MONITORING PLAN (PUMP) Pump monitoring is required for the Central Coasial Plain Capacity Use Area Water Use Permif. Monitoring shall include type and number of pumps operating, hours operated, volume withdrawn (gallons per day), depth of pump intake (below existing ground), water surface elevation, and any additional information requested by the permitting agency. Monitoring shal# be performed daily unless otherwise directed/allowed by the permifting agency. During pumping, withdrawal rates shall be assumed to equal manufacturer's it 6cated pump capacity unless actual measurements indicate otherwise. Withdrawal rates shall be reported according to the requirements dictated by'the applicable permitting agency. Pump withdrawal rate records shall be retained for a period of at least 5 years from the date.of measurement, unless otherwise indicated by permitting agencies. MONITORING PLAN (WELLS) There are no known private wafer supply wells in or around the mine site. Adjoining property owners have been requested to provide information to the contrary if they have private welts on their property_ No monitoring wells are proposed for the mine dewatering activity. MANDATORY PLAN REVISION The approved pump operation plan shall be revised if, additional withdrawal capacity is required or if it is determined that there are private water supply wells located within the vicinity of the mine and dewatering activities are adversely affecting iheir production. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required, unless technical justification can be provided to allow steeper slopes. ' A 110 feet wide unexcavated buffer will separate the proposed excavation from adjoining permit boundaries. A cut slope of 1 foot vertical for every 3 feet horizontal is adjacent to the inside edge of the unexcavated buffer and will extend inward approximately 30 feet horizontally forming the cut slope in unconsolidated overburden. A 10 feet wide safety bench is proposed between the toe of the unconsolidated cut slope and the top of the rock excavation high wall. The proposed slopes and buffer combine to place the high wall crest approximately 160 feet from the adjoining pen -nit boundaries. This provides room for a side slope of 4 feet horizontal for each ' vertical foot of proposed mine depth for a failed slope before it affects the adjoining permit boundary. b. Provide a cross-section on the mine niap(s) far- all fill slopes (berms, wastepiles, overburden disposal ' areas, etc.), clearly indicating the intended side slope gradient, installation ofany benches and/or.rlope drains (with supporting design information) if needed, and the method offnal stabilization. See mine plan drawings. c. In excavations} of unconsolidated (non -rock) materials, specify the angle of all cut slopes including specifications for benching and sloping. Cross -sections for- all cut slopes must be provided on the mine nrap(s). ' AlI cut slopes in unconsolidated material are proposed to provide a minimum of 3 feet horizontal distance for each I foot of vertical change. d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine excavation clearly noting the angles of the cut slopes, widths bf all safety beaches and mine benches, and the expected maximum depth of the excavation. A minimum 10 feet wide safety bench will be provided between the toe of cut slopes in unconsolidated overburden material and the top of rock excavation high walls. The safety bench will be flat. High walls are expected to be approximately 25-30 feet in height. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling ' house, public road, public, commercial or industrial building from any mine excavation. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable high wall barricades. A construction detaillcross-section and location of each type of barricade to be used must be indicated or the mine rnap(s). The proposed swale, mine access road, overburden slope and safety bench are interior to the earthen berm. RECLAMATION PLAN Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land. This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This information must be illustrated on a reclamation map and must correspond directly with the brformation provided on the mine map(s). In addition, design in including typical cross -sections, of any permanent channels to be constructed as part of the reclamation plan and the location(s) of all permanent channels must be indicated on the reclamation map. The excavation will be reclaimed as a lake. The surrounding overburden side slopes will be dressed and vegetated. The sediment basin and its outlet structure will be removed and the existing ditch re-established if necessary to provide a discharge for the remaining lake. The proposed mine access road will be regraded if necessary and the area of the proposed swale and perimeter berm will be restored and vegetated. 2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes ® No ❑. If )-es, illustrate the location of the body(s) of water on the reclamation map and provide a scaled cross -sections) through the proposed bodi,(s) of water. The minimum water depth must beat least 4 feet, measured from the normal low water table elevation, unless information is provided to indicate that a more shallow water body will be productive and beneficial at this site. Will the body(s) of water be stocked with fish? Yes ❑ No Z. If yes, specify species. 3. Describe provisions for safety to persons and to adjoining property in all completed excavations in rock including what kind of permanent barricade will be left. Acceptable permanent barricades are appropriate fencing, large boulders placed end -to -end, etc. Construction details and locations of all permanent barricades must be shown on the reclamation map. Upon reclamation as a lake, surrounding barricades will be removed. Overburden side slopes and high wall benches will remain, although submerged, to provide egress to those who choose to enter the water body. 4. Indicate the method(s) of reclamation of overburden, refuse, spoil banks or other such on -site mine waste areas, including specifications for benching and sloping. Final cross -sections and locationsfor�such areas must be provided on the reclamation map. Overburden stockpiles, uncontaminated refuse, spoil banks and other such on -site uncontaminated mine waste 'which would otherwise classify as beneficial fill will be deposited in the bottom of the completed excavation. Contaminated waste will be disposed of in accordance with applicable regulations. a. Describe reclamation of processing facilities, stockpile areas, and on -site roadways. On -site roadways will be regraded and stabilized with pennanent vegetation when no longer required for site access. Stockpiles will be deleted to the extent practical. Remaining stockpiles and processing facilities will be restored to match surrounding grades and stabilized with pennanent vegetation. b. Will any on -site roadways be left as part of the reclamation?
