Dear Mr. Garner:
In accordance with your application for a discharge permit received on
September 7, 2006, and the issuance of your Division of Land Resources mining permit
on June 18, 2009, we are forwarding herewith the subject certificate of coverage to
discharge under the subject state — NPDES general permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated October 15, 2007 (or as subsequently amended).
This general permit allows the discharge of stormwater from your facility. in your
application, you specified that only stormwater would be discharged from this facility. If
separate point -source discharges of wastewater occur (i.e., mine dewatering water or
other process wastewater), you will be required to seek a modification to this permit.
Any modification to add a wastewater discharge for this facility would have to be
reviewed and issued prior to that discharge occurring at your facility.
This permit does not affect the legal requirements to obtain other permits which
may be required by the Division of Water Quality or permits required by the Division of
Land Resources, Coastal Area Management Act or any other federal, state or local
governmental permit that may be required.
