Based on your submittal and signed certification of no exposure at the above referenced facility and a site visit on August 17, 2009 by Myrl Nisely of the Raleigh Regional Office, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 126.22(g), which is incorporated by reference in North Carolina regulations. We are also hereby rescinding your current permit Certificate of Coverage, NCGO60294. Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure conditions at your facility. If conditions change such that your facility can no longer qualify for a no -exposure exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an unpermitted discharge (subject to civil penalties of up to $25,000 per day). Your conditional no -exposure exclusion expires in five years (August 19, 2014). At that time you must re -certify with the Division, or obtain NPDES permit coverage for any stormwater discharges from your facility. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. The current stormwater permit NCG060294 would be rescinded if NE is approved. The facility is has no exposed potential rainwater pollutants. The landscaping and housekeeping are immaculate. Employees handling raw materials and finished product storage are trained to FlazMat 40 hr level. The No Exposure will be granted. The NCG06 permit was recommended by their consultant when a standby generator was added a few years ago. That system is isolated behind a fence, has a double -walled fuel tank, and would not have needed to come under a stormwater permit. Appalachian Stone Company. Inc. has contracted the services of Freemen Environmental Consulting, I-I.0 to help them become compliant and this letter is in response to the above listed NOV and is written on their behal f. A Stormwater Pollution Prevention flan (SWPPP) has been developed for this site that includes 1 the required items listed in the general permit including site maps, discussion of BMPs, maintenance; training and sampling. As you are aware the rainfall events this year have been limited and have prevented sampling but sampling and monitoring is - STedder NOV Response Page 2 planned for future rainfall events that produce runoff. The mining performed at this site by campaign and there are long periods when there are no activities at the site and no personnel to do sampling but while there are workers onsite during rainfall events sampling and monitoring will be performed. Stormwater Controls and BMP's will be checked for stability and effectiveness as outlined in the SWPPP. The above ground storage tank and 5 gallon containers mentioned in your letter are being removed. Sullins, Director (v, Division of Water Quality Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ) conducted a compliance evaluation inspection (CEI) at the subject facility on 24 September 2008. The assistance and cooperation of Ricky Sigmon was greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. The facility is located at 1093 Tom East Road, in Westfield, Stokes County, North Carolina. The facility discharges stormwater to an unnamed tributary (UT) to Vade Mecum Creek, which is currently classified as a Class B water in the Roanoke River Basin. Documentation & Monitoring Review 3. The facility does not have a best management practices (BMP) plan as required by the permit. 4. Neither analytical nor qualitative monitoring has been conducted in accordance with the permit. Site Review 5. The site has been shut down for about four months according to Mr. Sigmon. The site was inspected, including one location that appears to be a stormwater discharge outfall (SDO) and the discharge point for mine dewatering wastewater. No obvious indicators of water pollution were detected. The site is fairly clean and no outstanding issues were noted. 6. There was one elevated steel diesel fuel tank and miscellaneous 5-gallon buckets of unknown materials. Please be aware that although these quantities do not require secondary containment, you must still immediately clean up spills and report spills of such chemicals in accordance with NC General Statute 143-215.75. It is strongly advisable, while the site is in operation or as long as such chemicals are on the site, that you maintain the supplies and/or equipment necessary to enable you to quickly contain and clean up spills. 7. Please be aware that the Division may assess civil penalties of up to $25,000 per day, per violation for failure to comply with the requirements of NCG020000 and NC General Statutes 143-215.1 and 143-215.75. You may wish to review the permit and general statutes in detail to familiarize yourself with the requirements of each.
