On 9/7/2010, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020612. in accordance with your request, Certificate of Coverage
Number NCG020612 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific tees of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If; in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.

A site inspection at the Dixon Mine Pit facility was conducted on August 18, 2010. This mine pit discharges to Broad Creek a class
SA, HQW (high quality water) water of the State. A file review indicates that the certificate of coverage (NCG020612) is active.
During our phone conversation on August 18, 2010, you indicated this pit has been inactive due to the slow down in construction
activities. You indicated an interest in having the NPDES permit rescinded. Enclosed is a Rescission Request Form for your
convenience. if you are interested in discontinuing mining at this location, please fill in the date the mine pit was closed. Sign and
date the form and send it to the address highlighted at the bottom of the form. The Wilmington Regional Office will support your
rescission request based upon the fact that no current mining has been conducted. If you decide to pursue rescission and later intend to
resume mining, you may reapply for the NPDES Permit; however dewatering will he restricted to discharges to the wetlands rather
than directly to class SA/HQW waters of the State.
Should you wish to maintain an active NPDES Permit, please ensure the appropriate reporting is conducted and that any discharges
from the mine pit are properly monitored in accordance with the NPDES Permit language (see enclosed permit text). Currently, you
are not in compliance with your permit. An operation and monitoring plan will be required for the dewatering activities to ensure that
the discharges will not adversely affect the ability of the receiving waters to properly function as a Primary Nursery Area. Please note
that on January I, 2011, a written Stormwater Pollution Prevention Plan will be required for this mine site.

Inspection Summary:
This mine pit could be a pit that eliminates discharges to SA/PNA/HQW classified receiving stream. The site has a large
poccosin wetland located to the west of the pit. Pump rates and frequencies could be managed such that no discharge
would occur to the receiving stream, but this will have to be managed and identified in accordance with an approved
operation and monitoring plan.

settling basin that will need to be maintained to provide adequate settling prior to
discharge to a wetland poccosin. The discharge channelizes through the poccosin and
eventually discharges to Broad Creek (SAIHQWIPNA waters of the State).

Comment: If you do not have a copy of your certificate of coverage for this facility,
please request one from the Wilmington Regional Office (WiRO), the staff will assist in
providing you one. Only one outfall should exist from this site and that is the outfall
located at the center of the pit on the west side (where the settling basin exists). Should
another location be necessary, you must identify the new location on your site map
required in the Stormwater Pollution Prevention Plan (SWP3). Should you need
assistance in developing the SWP3, please contact WiRO.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit'
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

In accordance with your application for discharge permit received on January 28. 2003, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983.
The permittee shall develop an approved plan to avoid wetland impacts (See Part III, Section C, Page 6 of 9).
Since discharges of wastewater (Mine dewatering) from this mine are into waters that have been
designated as High Quality Waters (HQW) there are more stringent effluent limitations on Total Suspended
Solids than provided for in the General Permit. Attached to this copy of the General Permit NCG02000O.are
supplemental effluent limitations, these replace Table 9 from the General
Permit and are applicable to this facility.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental permit that may be required -
