Director May 25, 2012 Dee Freeman Secretary Subject: NPDES General Permit NCG020000 Royal Oak Mine Brunswick County Division Representative, Linda Willis, met with your representative, Mike Borton, on May 17, 2012, at your mine site located on Alotadoe Road in Brunswick County (DLR Mine Permit No. 10-61). Pursuant to the Division of Water Quality's review of the Division of Land Resources (DL R) mine permit application and the site visit, it was determined that storrrlwater and wastewater (from pit dewatering) discharges will occur from your mine pit to a network of ditches that discharge to Fall Swamp which is classified as a C-Sw water of the State in the Lumber River Basin. Therefore, the stormwater and wastewater discharges from this mine will require a National Pollutant Discharge Elimination System (NPDES) Permit NCG020000. The NPDES General Permit NCG020000 covers mining and quarrying of nonmetallic minerals (except fuels) including borrow pits {that would not be covered under the statewide DOT stormwater permit) and active or inactive mines that discharge stormwater contaminated with, or that has come in contact with, any overburden, raw material, intermediate products, finished products, byproducts or waste products located at the site of such operations and stormwater runoff from vehicle maintenance areas. This General Permit also covers discharge of wastewater from processing mined materials and mine dewatering wastewater from the groundwater and/or stormwater that accumulates in the mine pit. A discharge without a permit is a violation of North Carolina General Statute 143-215.1(a). Pursuant to G.S. 143-215.6A (a)(2), a civil penalty of not more than twenty-five thousand dollars (S25,000) per violation per day may be assessed for discharges without a permit. That person, and/or company may designate a consultant and/or firm [in writing] to act as their Authorized Representative. If so, that person can then sign the permit application. You should apply for the NPDES Permit by filling out a Notice of Intent (NOI) form.- Information concerning this permit, such as the permit text, reporting forms, and a technical bulletin can be found at: htt]2://portal.ncdenr.orglweb/wq/ws/su/npdessw#General Permits NPDES.
