A copy of the Compliance Inspection Report is enclosed for your review. Mr. Tony Harris, General Manager, was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG020000 under Certificate of Coverage NCG020562. Permit coverage authorizes the discharge of Stormwater from the facility to receiving waters designated as the Cape Fear River, a Class WS-IV waterbody in thw Cape Fear River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. At the time of the inspection, the Stormwater Pollution Prevention Plan (SPPP) was not available for review but was emailed to the Inspectors at a later date. In reviewing the received SPPP, it appeared to include most of the applicable required components which are stipulated in the General Permit NCG 020000. Training is not being documented on an annual basis. There should be included in the SPPP documentation of the Annual Review of the SPPP with a date and signature for 2015, 2016 and 2017. There are no outfalls at this mine and no dewatering is taking place because the mine has been under reclamation for the last few years. The Waste Water Annual Discharge Monitoring Report Forms (DMR) were reviewed. Records were available for February - May 2018 with No Discharges noted. No records were available for review for 2017. According to General Permit NCG020000 there needs to be a minimum of 60 days separating the monitoring dates. A tour of the mine was conducted. The mine is currently in the process of being reclaimed and appears in stable condition. At the time of the development of this inspection report an inspection of the Clark Mine occurred on June 14, 2018 and a letter releasing this mine was issued on July 5, 2018. Attached is the Rescission Request Form since the NPDES stormwater permit will no longer need to be maintained. (The previous cut-off concentrations have been removed.) • Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring (reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring shall be done until three consecutive monitoring events show no benchmark exceedences. • Section B — This part contains a new provision that four exceedences of any benchmark will trigger increased DWO involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the implementation or installation of specific stormwater control measures. • Section B — The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72 hours) of little or no precipitation to precede an RSE. • Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be monitored. • Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the remainder of the permit. • Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil & Grease parameter in the previous permit. • Section D — Qualitative monitoring must now be conducted during the same representative storm event as the analytical monitoring. • Section D — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. • Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the permittee may be required by DWQ to perform corrective action. • Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for some Stormwater Discharge Outfalls (SDOs). • Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring, install or modify structural stormwater controls, or implement other controls. • Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and recorded in the Annual Summary DMR. • Section E — A lower TSS Wastewater limit for PNA waters is included in the permit. • Section E —All mining operations are now required to monitor TSS in wastewater effluent discharges (not only industrial sand mines). However, TSS limits only apply to industrial sand mining operations. • Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still apply in the receiving waters. • Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with dewatering activities that have the potential to drain wetlands or other surface waters). • Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR). • Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform monitoring is now required for all process and mine dewatering wastewater discharges to SA waters. Part IV: • Section E — Items 1. and 2. require submittal of a new reporting form: the Annual Summary DMR. This annual summary of the anal tY ical monitoring results should be submitted to the DWQ Central Office by March 1 of each year. • Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30 days of receipt from the lab. • Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling period in the SPPP. MINING PERMIT EXPIRATION DATE: November 2, 2019 Page 2 In_accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources, hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the -above, the Department may institute other enforcement procedures authorized by law. npfinitinn.q Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications April 25, 2000: This permit has been transferred in its entirety from Stewart Aggregates Inc. to American Materials Company. Expiration Date This permit shall be effective from the date of its issuance until November 2, 2019. Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: Page 3 OPERATING CONDITIONS: A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary stormwater permits or other approval documents. 2. A. Any mining process producing air contamination emissions shall be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During mining operations, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. A. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and, enforced by the N. C. Environmental Management Commission. 4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. All drainage from the affected area around the mine excavation shall be diverted internal to said excavation. C. No dewatering activities shall occur at this site. D. Mining activities shall occur as indicated on the mine map received by the Land Quality Section on October 12, 2009 and the supplemental information received by the Land Quality Section on February 1, 2008, December 31, 2008 and October 12, 2009. 5. All affected area boundaries (100.8 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. Page 4 6. The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. Sufficient buffer (minimum 50 foot undisturbed except for the placement of any necessary screening berms or tree planting) shall be maintained between any excavation and any mining permit boundary to protect adjacent property. 10. A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land. Resources prior to commencement of such disposal: Page 5 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed. at least 4 feet above the seasonally high water table; and, 5. verification that a permanent vegetative groundcover will be established. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 12. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit or any approved revision to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 14. A. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human Skeletal Remains Protection Act," should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. Page 6 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to restore the mine excavation to a lake area and to grade and revegetate the adjacent disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. The lake area shall be excavated to maintain a minimum water depth of four feet measured from the low water table elevation. Page 7 B. The side slopes to the lake excavation shall be graded to a 3 horizontal to 1 vertical or flatter to the water line and 2 horizontal to 1 vertical or flatter below the water line. C. Any areas used for wastepiles, screening, stockpiling or other processing shall be leveled and smoothed. D. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition Nos. 10A through 10D. E. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Reveec etation Plan: After site preparation, all disturbed land areas shall be revegetated as per a.) the Vegetation Plan outlined on the Reclamation Plan last revised August 19, 1997 prepared by Engineering and Environmental Science Company, Inc. and b.) the Wildlife Reclamation Plan included in the 404 Wetlan ds/VVild life Impact Report of the Clark Mine Tract prepared by Land Management Group, Inc. dated October 30, 1997 and revised December 1, 1997. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. INTRODUCTION A. Materials Management Narrative This operation mines sand and aggregates, which are delivered to off -site construction projects. The aggregates are transported by truck to the plant, stored in stockpiles located outside and fed into the plant via loader and conveyors. B. Plant Operations — A description of plant operations follows: 1. Production Sand and aggregates are ribbon fed, by way of conveyor, into the plant. Sand and aggregates are separated and stockpiled on site. Wash water is captured and solids are allowed to settle out. 2. Process Water Management — Process water from the plant area flows into previously mined area. 2. SITE ASSESSMENT • Site Map A site map for this plant. • USGS Map A USGS map showing the plant location. Significant Spills and Leaks - There have been no significant spills or leaks at this location in the past three years. 3. STORM WATER MANGEMENT PLAN A. Feasibility of Modifying Operations - Sand and aggregates used in this operation are stockpiled outside where they are exposed to rain. It is judged to be impractical to cover these stockpiles. Since the aggregates are all processed with water and required to contain less than 2% by weight passing the #200 sieve, there is minimal contribution of sediments from this source. B. Best Management Practices (BMP's)- Best management practices are physical, structural or management practices that prevent or reduce pollution of waters of the state. The following BMP's are in effect at this plant: 1. Process water is channeled from the plant in to previously mine area to allow sediment to settle out. 2. Drivers and operators are assigned a specific parking location. They must report any fuel, hydraulic, or other fluid leaks to the plant manager. 3. Water from the aggregate stockpiles drains into previously mined area. 4. Spill Prevention and Response Plan A. Potential Contaminates - The most likely sources for contaminates are listed below: 1. Parked trucks and equipment. 2. Sand and aggregate stockpiles. 3. Fuel storage and truck fueling area. Spill Prevention and Countermeasure Plan The best defense for spill prevention is training and awareness by all plant personnel. This training should include the importance of operating procedures to minimize potential spills and emergency responses to take in the event of a spill. Diesel and hydraulic oil spills are also a concern with the high volume of activity we have with our off -road trucks. Large spills will be contained with sand and properly disposed of. The state will be notified of any fuel/oil in excess of 25 gallons. Spills of other liquids are most likely to occur as a result of handling liquids in 5 gallon buckets or transferring liquids from 55 gallon drums. These spills should be small enough to be easily manageable. 5. Preventive Maintenance & Good Housekeeping - A. Preventive Maintenance & Monthly Visual Inspection Log Preventive maintenance (PM) includes monthly inspections and random visual inspections of the maintenance area, plant facilities and equipment. The purpose of PM is to locate and correct equipment problems before they occur or cause major problems. PM'will reduce truck breakdowns and plant shutdowns in addition to reducing the risk of polluting storm water. The following lists items to be checked and frequency: 1. Trucks and equipment will be inspected daily for fuel, oil, and hydraulic leaks and recorded on the site inspection report. 2. Settling ponds and detention one__ d/pit will be maintained in good operating condition. 3. Secondary containment structures will be inspected as part of the Monthly Visual inspection Report. Reports will be maintained in SWPPP file. Any needed repairs will be made immediately. 4. Storm Drain Outfalls will be inspected monthly as part of the Good Housekeeping Checklist. (There are no SDO at this site) B. Good Housekeeping Good housekeeping means taking the time and effort to maintain a clean, orderly, and safe environment in the work place. These steps will help to minimize any potential for storm water pollution in addition to promoting safety and a sense of well being at work: I . Trash and other waste will be picked up regularly. A covered trash receptacle will be placed outside and emptied on a regular basis. 2. Interior floors will be kept clean and dry. Brooms, mops, and dustpans will be stored for convenient use. 3. Empty drums and unused pallets will be disposed of 4. The Monthly AMC Housekeeping Inspection will be performed by the plant manager and kept on file in the SWPPP. :: 6. Training ,Training of employees is essential to the success of the program. The following training will be conducted: A. Annual training for all employees will include: 1. Spill Prevention and Countermeasure Plan The best defense for spill prevention is training and awareness by all plant personnel. This training should include the importance of operating procedures to minimize potential spills and emergency responses to take in the event of a spill. Diesel and hydraulic oil spills are also a concern with the high volume of activity we have with our off -road trucks. Large spills will be contained with sand and properly disposed of. The state will be notified of any fuel/oil in excess of 25 gallons. Spills of other liquids are most likely to occur as a result of handling liquids in 5 gallon buckets or transferring liquids from 55 gallon drums. These spills should be small enough to be easily manageable. 5. Preventive Maintenance & Good Housekeeping - A. Preventive Maintenance & Monthly Visual Inspection Log Preventive maintenance (PM) includes monthly inspections and random visual inspections of the maintenance area, plant facilities and equipment. The purpose of PM is to locate and correct equipment problems before they occur or cause major problems. PM will reduce truck breakdowns and plant shutdowns in addition to reducing the risk of polluting storm water. The following lists items to be checked and frequency: 1. Trucks and equipment will be inspected daily for fuel, oil, and hydraulic leaks and recorded on the site inspection report. 2. Settling ponds and detention pond/ —Tit, will be maintained in good operating condition. 3: Secondary -containment structures will be inspected as part of the, Monthly Visual Inspection Report.
