Dear Mr. Tedder:
The purpose of this correspondence is to acknowledge receipt of your correspondence dated March 25, 2009
regarding the above referenced site and phone conversations with Mr. Ron Boone of the Division of Water
Quality on March 25, 2009 and June 8, 2009. As we discussed in June 2009 telephone conversation,
Geological Resources, Inc. did not get copied on the March 2009 DWQ correspondence and was not aware
that a response was required. The absence of the requested response is regretted and was unintentional. We
assure you that any future requests for information regarding this site will be provide in a timely manner.
As noted in the March 2009 correspondence. the Vaden Quarry site has a Storm Water BMP plan in place.
Operations at the quarry have been limited over the past few years due to the economic down turn as well as
the yield. As we discussed on -site on March 20, 2009, Jacob's Creek Stone Company is in the process of
completing the repair and maintenance of existing sediment and erosion control structures and reclamation of
unused sediment and erosion control structures at the quarry in accordance with the mining permit and BMP
plan. Repairs are expected to be completed by the end of July. Storm water sampling (qualitative and
quantitative) of the outlets of Traps 91 and #10 and Basins #3 and #8 will be conducted in accordance with
the NPDES permit in July after the repairs and maintenance activities are completed. Mr. Boone from your
office will be notified approximately a week in advance of the sampling event so he can be present during the
sampling.
As we discussed with Mr. Boone on -site and during subsequent telephone conversations; the BMP plan will
be maintained on -site in a lock box, with a schedule for on -site inspections of sediment and erosion control
structures as well as a schedule of analytical and qualitative monitoring. Records for each inspection by the
site manager as well as monitoring records will be maintained diligently on -site. Communication with your

Office is a critical element of the BMP plan to ensure that Jacob's Creek remains in compliance with all
permit requirements at all times in the future.
Jacob's Creek and GRI are taking all the necessary steps to ensure that all monitoring and inspection
activities are in place by July 31, 2009 and that all permit requirements for sampling and inspections are
followed in the future, in accordance with the schedules set forth in the permit. It is respectfully requested

1. Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ)
conducted a compliance evaluation inspection (CEI) at the subject facility on 20 March 2009.
Your assistance and cooperation during the inspection, as well as that of Mr. Rohit Shetty, of
Geological Resources, Inc., was greatly appreciated. An inspection checklist is attached for your
.records and the inspection findings are summarized below.
2. The facility is located on the north side of Moores Spring Road, approximately 4.7 miles northeast
of the intersection of NC Hwy 66 and Moores Spring Road, in Westfield, Stokes County, North
Carolina. Stormwater related to industrial activity is discharged to an unnamed tributary to the
Dan River, this section of which is currently classified as WS-V (water supply) waters in the
Roanoke River basin.
Documentation & M_o_n toring_Review
3. A BMP plan was available at the site during the inspection. The plan was found to be sufficient.
4. Best Management Practice (BMP) inspections are not being conducted and recorded. Please
immediately begin conducting and documenting the inspections as required by the permit.
5. Neither qualitative nor analytical (quantitative) monitoring has been accomplished as required.
Please begin conducting the required monitoring as required by the permit. Please notify Mr.
Boone of the next sampling event so he can be present and provide a copy of the analytical
results to this office along with the copy that you have to send to the Central Office in Raleigh.

Site Review
5. The site was clean and well maintained. There are several BMPs located throughout the site,
most of which discharge to three other drainage areas with their own BMPs. These final drainage
areas and BMPs are the stormwater discharge outfalls (SDO). No issues were noted with the
SDOs at the time of the inspection. They are in good condition and apparently handle the flow
well.
6. You are reminded that violations of the NCG020000 permit are subject to civil penalties not to
exceed $25,000 per day, per violation. No penalty is being assessed for the above violations at
this time, however you must reply in writing to this letter within 30 days of receiving it. Your reply
must include a corrective action plan' with implementation schedule for each of the
deficiencies/violations noted above in paragraphs 3 through 5.

Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.
