If a facility is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
If Representative Outfall Status is granted, ALL outfalls are still subject to the qualitative monitoring
requirements of the facility's permit —unless otherwise allowed by the permit (such as NCG020000) and DWQ
approval. The approval letter from DWQ must be kept on site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DWQ in writing if any changes affect representative status.

stock pile removal. The last land disturbance activity was in 2014. We called the Statesville Brick environmental manager
when we were onsite and he scanned amnd emailed resent sampling data indicating compliance. All records are kept at
the Statesville Brick Plant.Efforts to reduce TSS have been successful.

Statesville Brick Company intends to stay in compliance with existing permit . .
requirements. We have taken corrective action of non compliant issues listed in the . _
compliance evaluation that occurred on August 10, 201 i.'StatesviIle Brick has put .
together a plan to address outstanding issues which are.listed below.
1. Monitoring outfall # I on a monthly basis until in compliance with turbidity levels
and report levels to the Mooresville Regional office.
2. We are working with Bobby Starling with Hanes Geo Components a distributer
of HaloKlear. After running tests we have decided to use two components

which are environmentally friendly. These products are listed on the North
Carolina DOW approved DAMS/Flocculants list.
3. Statesville Brick installed a pipe as recommended by Barbara Sifford this will
help control water flow into the catch basin. This pipe will also direct water flow
through.the treatment socks_which have been placed inside the pipe. The socks are
held in place'by using metal snaps and nylon ropes. The socks will be monitored
to see if .replacement is necessary. This will drop turbidity,levels.over time.

4. We evaluated water runoff on the mine site and made changes to
help slow water flow. Silt fence and berms were put in key locations.
Grass was planted in some areas to help with controlling erosion.
Overall this will help control and decrease the amount of material runoff into the
catch basin.
5. We are looking at portable turbidity meters for monitoring levels to ensure that we
are moving in the right direction to meet compliance levels. This would be for
our use only and would not affect permit required testing and sending of results to
the Mooresville Regional Office.
As of September 20, 2011 all parts of this plan have been completed and will be - - —
monitored to see if changes are necessary. If you have any questions please

subject facility on August 10, 2011, by Ms. Barbara Sifford of this Office. Thank you for your assistance and
cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the facility-s failures to implement the
Stormwater Pollution Prevention Plan, and comply with all monitoring requirements, all violations of the subject
StormNvater Permit and North Carolina General Statute (G.S.) 143-215.1, are detailed its the Storniwater Pollution
Prevention Plan, QnalitatiN,e 1'ionitot-ing, Analytical Monitoring and Permit & Outfalls Sections of the attached
report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand doliars($25,000.00) may
be assessed against any person Nvho violates or fails to act in accordance with the terns, conditions, or requirements of
any permit issued pursuant to G.S. 1113-215.1.
It is requested that a written response be'subrnitted to this Office by September 30, 2011, addressing
the above -noted violations in the attached report and detailing the corrective action plan that is to be
implemented to address the non-compliance issues of the permit. In responding to the violations, please
address your comments to the attention of Ms. Marcia Allocco.

Inspection Summary:
The permittee was given the DWQ approved PAMS and Flocculants list and immediately began researching the various
products listed to determine which polymers were most applicable to this sb&rnent and erosion issue. Samples have
been submittted to them which have resulted great laboratory setting reductions in turbidity. A design application is under
consideration with a new inlet to the pond being constructed to raise the roadway and prevent disturbing the soils at that
location.
_ This-fall.additional_seeding will_be-done-to_stabilize-some_of.the_mined.area._,Floc logs will be -placed. in the ditch_ line to
the pond with additional brick bat dams to slow the water and settle the solids. With these corrective actions taken over
the next six months a drastic reduction in turbidity and TSS should be noticed at this outfall.
This facility will require a follow up visit in the next several months.

sheet flow and goes to Hwy 52 drainage ditch.

Comment: Analytical monitoring indicates that 001 has not met the benchmarks of the

and observations indicate that this area which is currently being mined has always had

downstream water quality each month after a rainfall event. Review the permit for
conditions of turbidity compliance as it has changed with the new permit issued in 2010.

This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .l and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
