(CEI) have been contracted by Fogleman and Fogleman Soils, Inc. to assist them in resolving the above referenced Notice of Violation (NOV) Letter dated March 22, 2016 (Attachment 11. Fogleman and Fogleman Soits, Inc. operates under NC Solid Waste Permit No. 32-F and NC Mining Permit No. 32-09 as a LCID Landfill and Processing Facility. This letter is provided to document the completion of the response items set forth in the NOV Response/Restoration Plan, submitted April 22, 2016 and subsequently approved on April 25, 2016 (Attachment 21. NOTICE OF VIOLATION REQUEST STATUS We are providing the current status of the NOV requests below: 1. March 22, 2016 NOV Request: Dredged material that has been disposed of in the stream, buffer and wettand needs to be immediately removed and secured away from natural resources as required below. Current Status: Compteted. Dredged material has been removed per the approved restoration plan discussed below. 2. March 22, 2016 NOV Request: Removal of dredged material needs to occur with hand and buckets; no heavy equipment can be used to remove material. Please note that use of mechanical equipment to remove material from stream/buffer/wetland will constitute an additional violation. Current Status: Completed. Per the approved plan, heavy equipment (excavator) was used to remove the bulk of the sediment that was above the elevation of the wetland and buffer. This removal was performed from the road with oversight from S+G. Hand/manual removal was performed for the lower approximate 6 inches of sediment to prevent disturbance of the underlying soils. March 22 2016 NOV Reguest: Basin needs to he immediately repaired so that no additional sediment discharges to ' the stream. Current Status: ' Completed. A temporary rock filter consisting of an approximate 10 foot semi -circle of rip rap over the current basin outlet has been installed. #57 stone will be maintained over the rip rap approximately 6" in depth. This temporary measure will remain in place 1 until the new riser and outfall can be constructed. A delay in completing the planned riser and outfall installation is due to an ongoing property line determination. The riser and outfall will be installed when this issue is resolved, until that time, this rock filter ' will be monitored and maintained. RESTORATION PLAN IMPLEMENTATION: 1 The approve restoration plan was implemented at the site upon for this work. Key items in the plan are provided below, along with a description of their project implementation. 1. Repair of Sediment Basin: A temporary rock filter (discussed above) has been installed. A delay in completing ' the planned riser and outfall installation is due to an ongoing property line determination. The riser and outfall will be installed when this issue is resolved, until that time, this rock filter will be monitored and maintained. 2. Dredged Material „Removal Per the approved plan, silt fence was installed at the lower limit of the dredged ' material prior to excavation of the dredged soils. Heavy equipment (with excavator) was used to remove the bulk of the sediment. This removal was performed from the road with oversight from S+G. Hand/manual removal was performed for the lower, approximate 6 inches, of sediment to prevent disturbance of the underlying soils. All removed material was placed within the permitted LCID landfill area and will eventually be used for landfilling activities lie. periodic cover). Stabilization: Per the approved plan, the disturbed side slopes of the acess road were seeded with tall fescue. Disturbed wetland areas were seeded with brown top millet to allow ' future natural regeneration of wetland species. These seeded areas were also stabilized with straw. It should be noted that seed germination has begun at the time of this report. Attachment 3 includes photographs of the seeding and straw process. Sediment control fence will be left in place until the area is stable and then removed by hand. Surveying: ' The wetlands and buffers have been identified in the field and have been surveyed by a Professional Licensed Surveyor. The attached Figure 1 has been revised to show ' the extent of material and the surveyed location of natural resources. Additionally, as stated above, a delay in completing the planned riser and outfatl installation are due to an ongoing property line determination. While the survey of the property line has been conducted, discrepancies in actual versus recorded boundaries do exist. The riser and outfall will be installed when this issue is ' resolved. Upon inspection, DWR observed impacts to streams, wetlands, and riparian buffer(s); the impacted stream(s) on -site is an un-named tributary to Ellerbe Creek, Nutrient Sensitive Waters (NSW) waters in the Neuse River Basin. Neuse River Basin Riparian Buffer Violation 15A NCAC 213.0233 The Neuse River Basin is subject to the riparian (streamside) buffer rules covered under ' North Carolina Title 15A NCAC 02B .0233. The purpose of these rules is to protect and preserve riparian buffers in the Neuse River Basin that help protect surface water by removing nutrients from overland flow. The North Carolina buffer rules apply to areas immediately adjacent to surface waters which includes intermittent streams. perennial streams, lakes, ponds, and estuaries. The protected riparian buffer has two zones: Zone 1 is measured from the stream bank landward for 30 feet. Zone 2 is measured an additional 20 feet landward from the outer edge of zone 1. Both Zone i and Zone 2 consist of a stable vegetated area that is i undisturbed except for activities and uses provided for in item (6) of 15A NCAC 28 .0233(4). • Mechanical dredging of an on -site basin and disposal of dredging material into the ' riparian buffer; • Sediment appears to be several feet deep and has been deposited in several ' locations for a total of approximately 50 to 70 linear feet; 4. This information must be clearly depicted on a map that you provide as a part of this response. This map should also indicate all of the wetlands/buffer/stream locations on the tract that have been impacted; 3. Address the measures that will be used for temporary stabilization/sediment control while this work is under way; earthen fill material must be removed from wetlands/streams/buffers, placed on high ground, and stabilized. Please provide a schedule with dates by which this work will be completed..
