With regards to the recent inspection of our facility, 1 am responding per your request to
the noted deficiencies:
- -1. Recision of NCG020212 request — Madison Pomona Mine
Even though we no longer mine materials from this area, we currently use this mine as an
area for disposal of beneficial fill as approved by the Division of Waste Management.
Should we still seek recision based on this fact?
2. We will continue qualitative and quantitative monitoring of stormwater from our
mining operations. Checks will be made in the proper intervals according to
permit requirements and documented appropriately. This will be in affect by end
of year 2012.
3. We will continue qualitative and quantitative monitoring of stormwater from our
manufacturing facilities as required in the permit. This will continue to include
required analytical checks. These checks will be made in the proper intervals and
documented appropriately. This will be in affect by end of year 2012.
4. Existing stormwater plan will be evaluated and updated. This will include among
other things, (1.) updating pollution team member roster (2) training on spill
prevention and response, (3.) review of best management practices. These will be
in affect by end of year 2012.

Dear Mr. McMillan:
Mike Thomas of the Winston-Salem Regional Office of the North Carolina Division of Water Quality
(DWQ) conducted a compliance evaluation inspection at the subject facilities on 20 September 2012. Your
assistance and cooperation during the inspection was greatly appreciated. An inspection checklist is attached
for your records and the inspection findings are summarized below.
During the inspection you informed Mr. Thomas that there had been a change in personnel since the last
inspection and that you had taken over the responsibility from Mr. Miner. As a result some of the corrective
actions mentioned in the last inspection letter have not been addressed.
NCG020212 & NCG020218, Madison Pomona Mine
As discussed in the last inspection report both of these permits appear to be for the Madison Pomona
Mine. You indicated that mining activity no longer occurs at this mine and that the site is now used only for
equipment storage. Therefore, Pine Hall Brick Co. should request rescission of both permits. To do so, please
submit a letter to the Division's Stormwater Permitting Unit at the following address:

discharge related to mining activity can begin.
NCG020213 Dr. Martin Mine
This mine is located south of NC HWY 311 at the south end of Teague Rd., in Madison, NC. No
wastewater of any kind is produced at this mine and only stormwater runoff is discharged. The mine only has
one stormwater discharge outfall (SDO), which discharges to the Dan River. No issues were noted at the time
of inspection.
NCG020214, Young Webb Mine
This mine is located south of River Rd. at the south end of Lela Rd., in Madison, NC. No wastewater of
any kind is produced at this mine and only stormwater runoff is discharged. The mine currently has two active
SDOs, which discharge to an unnamed tributary of the Dan River. No issues were noted at the time of
inspection.
NCG020217, Galloway Mine
This mine is located north of HWY 311 at the north end of Price Rd., in Madison, NC. No wastewater
of any kind is produced at this mine and only stormwater runoff is discharged. The mine currently has two
SDOs that discharge to an unnamed tributary of Big Beaver Island Creek. No issues were noted at the time of
inspection.
NCG020219 Chilton Van No en Mine
. This mine is located south of River Rd., south of the intersection of River Rd. and Nightengale Rd. in
Madison, NC. No wastewater of any kind is produced at this mine and only stormwater runoff is discharged.
The mine has three SDOs that discharge to an unnamed tributary to the Dan River. No issues were observed
during at the time of inspection.
NCG020512, Klutz Mine
This mine is located north of HWY 311 approximately 4 miles west of the Rockingham/Stokes county
line, in Walnut Cove, NC. No wastewater of any kind is produced at this mine and only stormwater runoff is
discharged. The mine has one SDO that discharges to the Dan River. No issues were noted at the time of
inspection.
Pine Hall Production Plants #3 & #4 NCG070119
The facility is located at 634 Lindsey Bridge Rd. in Madison, NC. The facility currently has four SDOs,
all of which discharge to the Dan River. SDOs 1 through 3 discharge industrial stormwater only. SDO 4
discharges industrial stormwater and stormwater related to vehicle maintenance. Mr. Thomas reports that the
facility is exceptionally clean and well maintained. No issues were noted at the time of the inspection.

Documentation and Monitoring Review
The Stormwater Pollution Prevention Plan (SP3) is complete and partially implemented. Some portions
of the SPP3 have not been fully implemented such as keeping up with employee training sessions and yearly
revisions to the plan.
Qualitative monitoring and BMP inspection is being preformed routinely at all of the mine sites and at
the production plant. However, more detailed records need to be kept of these inspections. Analytical
monitoring is being conducted occasionally and at only certain outfalls. Please reference the attached copies of
the NCG02 and NCG07 permits to be aware of what analytical samples need to be collected at each facility and
at what interval.
We greatly appreciate your efforts to develop and implement an effective stormwater pollution
prevention plan. Please reply in writing to this letter within 30 days of receiving it. Your reply should detail
corrective actions and implementation schedules for each deficiency detailed above.

On 2/5/2010, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020212. In accordance with your request, Certificate of Coverage
Number NCG020212 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stonnwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit. -
If the faciiiiy is iii iile p,ucess of being sold, you will be perfornline a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

This letter is to acknowledge the receiving of your letter
dated January 8, 2010 concerning our Compliance Evaluation and
Notice of Deficiencies. It is our intention to comply fully
with these matters in a timely manner.
On December 29, 2009, Ron Boone inspected and found six (6)
items that needed to be addressed. They are listed here with
our progress at this time.
1. Permit #NCG020212 - Mine Rescission letter has been
sent to DWQ Stormwater Permitting Unit for this
inactive mine site (Madison Pomona).
2. Permit ##NCG020218 - Mine Rescission Request sent to
DWQ Stormwater Permitting Unit. This mine (Madison
Pomona) has had two Permit Numbers and as such, both
are requested Rescission action.
3. Permit #NCG020219 - Permit Renewal form mailed to request
reactivation (Van Noppen).
4. Permit #NCG020512 - (NOC) Form will be sent to DWQ
Stormwater Permit Unit for ownership change to correct
database error (Klutz). (NOC) will be mailed Friday,
February 5, 2010.
5. Permit #NCG070119 - Latitude/Longitude coordinates sub-
mitted to Mr. Boone (Plants 3 & 4).
6. No permit - Permit required for Plant 5 site. NCG07 (NOI)
for permit has been mailed to DWQ/SPU (Plant 5).
We will continue to rectify all deficiences and insure compliance
with both NCG02 and NCG07 permits.

This mine is located south of NC Hwy 311, at the south end of Teague Road, in Madison,
Rockingham County, NC. Triassic shale clay was formerly mined here but the mine has been
inactive for several years. No wastewater of any kind is produced at this mine and only
stormwater runoff is discharged. The mine currently has only one active stormwater discharge
outfall (SDO), which discharges to the Dan River, this section of which is currently classified as
Class WS-IV (water supply), CA (critical area) waters in the Roanoke River Basin. Mr. Boone
noted no issues at the mine. No secondary containment is currently required.
Documentation Review
SDO qualitative monitoring (QM) and Best Management Practice (BMP) inspection is normally
performed twice per month. Both QM and BMP inspection records are complete and current.
Analytical monitoring (AM) has not yet been accomplished.
5. NCG020214, Young Webb Mine
Site Review
This mine is located south of River Road, at the south end of Lela Road, in Madison, Rockingham
County, NC. Triassic shale clay is mined here. No wastewater of any kind is produced- at the
mine and only stormwater runoff is discharged. The mine currently has two active SDOs, which
discharge to an unnamed tributary (UT) to the Dan River, this section of which _ is currently
classified as Class WS-V waters in the Roanoke River Basin. Mr. Boone noted no issues at the
mine. No secondary containment is currently required.

SDOs, which discharge to a UT to Big Beaver Island Creek, which is currently classified as Class
C waters in the Roanoke River Basin. Mr. Boone noted no issues at the mine. No secondary
containment is currently required.

This permit expired in 1997 and was mistakenly deactivated in September 2009 but the
mine is still active. DWQ will reactivate the permit but Pine Hall Brick Co. must submit the

8. NCG020512, Klutz Mine
Site Review
This mine is located north of NC Hwy 311, approximately 4 miles west of the Rockingham/Stokes
county line, in Walnut Cove, Stokes County, NC. Triassic shale clay is mined here. No
wastewater of any kind is produced at the mine and only stormwater runoff is discharged. The
mine currently has only one active SDO, which discharges to the Dan River, this section of which
is currently classified as Class WS-V waters in the Roanoke River Basin. Mr. Boone noted no
issues at the mine. No secondary containment is currently required.
Documentation Review
SDO QM and BMP inspection is normally performed twice per month. Both QM and BMP
inspection records are complete and current. Analytical monitoring (AM) has not vet been
accomplished.
The owner of this mine is currently listed as "Klutz Mine" in the DWQ database. This must
be changed to "Pine Hall Brick Co.". Please submit a Name/Ownership Change (NOC) form
(attached) to DWQ/SPU to make this change.

9. Pine Hall Production Plants #3 & #4, NCG070119
Site Review
The facility is located at 634 Lindsey Bridge Road, in Madison, Rockingham County, NC. The
facility currently has four SDOs, all of which discharge directly to the Dan River. This section of
the Dan River is currently classified as WS-IV, CA waters in the Roanoke River Basin. SDOs 001
through 003 discharge industrial stormwater only, whereas SDO 004 discharges both industrial
stormwater and stormwater related to vehicle maintenance activities. The facility produces brick
using materials taken from the mines. Mr. Boone reports that the facility appeared exceptionally
clean and noted no issues at the site. For the purposes of this permit, the customer service area
and the former Madison Pomona mine, which are both on the east side of Lindsey Bridge Road,
opposite of plant #3/#4, are considered part of the plant #3/#4 property, and as such are also
regulated under this permit.
Documentation Review
The Stormwater Pollution Prevention Plan (SP3) for this plant needs some improvement. There is
currently no general location map and the site map does not meet all permit conditions. Individual
spill records are kept, so this meets all intent of the permit with regards to spill records (i.e. spill
list). The certification of the outfalls, as required by Part 11, Section A, para. le, has not been
accomplished. Finally, training has not been conducted and recorded annually, although initial
stormwater training has been provided to all employees that required it due to their duties.
Please review the permit in detail to ensure Pine Hall Brick Co. is meeting all requirements.
QM is currently being conducted at all four SDOs semi-annually and AM is being conducted at
SDO 004 semi-annually because it receives runoff from the vehicle maintenance area. All records
are current and complete. Please take special note of the new tiered requirements in the
permit, which tell the permittee what they have to do if any of the parameter benchmarks
are exceeded at any time during the permit cycle.
Mr. Boone has reported that the facility location latitude/longitude coordinates loaded in the DWQ
database are not accurate for the site (36.385000,-79.953333); these coordinates actually point
to the bridge that crosses the Dan River on the eastern side of Madison, just east of Water Street.
Please provide Mr. Boone with updated accurate coordinates for the site and he will see to it that
our database is updated.
10. Pine Hall Production Plant #5, No Permit
This facility is located on the south side of Hwy 311, at the south end of Teague Road, adjacent to
the Dr. Martin Mine on the northeast side and the Pine Hall Brick Co. Research and Development
facility on the northwest side. There is currently no permit for this site because Pine Hall Brick Co.
thought it was regulated under the Plant #31#4 permit. However, because the Plant #5 and Plant
#344 properties are not adjoining, Plant #5 should have its own permit. The Research &
Development facility can be regulated under the Plant #5 permit, because its property does adjoin
Pine Hall Brick Co.

the Plant #5 property. As such, please submit a NCG070000 Notice of Intent (NOI) to DWQISPU
as soon as possible for the plant #5/Research & Development facility.
11. The Division greatly appreciates Pine Hall Brick Co's efforts to maintain a well developed
stormwater program. Please continue with your efforts. However, you are strongly urged to
thoroughly review both the NCG02 and NCG07 permits in detail as soon as possible to help
ensure you meet all permit requirements. Both permits were recently rewritten and underwent
significant changes. Some of the more notable changes involve the frequency and rules for both
QM and AM and the tiered requirements that permittees must conduct when permit benchmarks
are exceeded. Mr. Boone can answer any questions you may have.
12.You are reminded that the Division may assess civil penalties of no more than $25,000 per day,
per violation of both the NCG02 and NCG07 stormwater permits. Please reply in writing to this
letter within 30 days of receiving it. Your reply should detail corrective actions and
implementation schedules for each deficiency detailed above. Thank you for your cooperation in
