Fortunately, he has agreed that monthly sampling be waived as long as there is no mine dewaterin taking place. Now that I know this, I can write the inspection report today, which will be in the form of a Notice of Violation (NOV) for failure to monitor as per the stormwater permit. I will cc you, Rohit, on the report. The NOV will demand that: • The SPPP be updated annually (with the need or lack of the need being documented). This should cover any changes to the site plan, significant spills, etc. • Documentation of annual employee training be documented and kept with the SPPP. • Analytical (laboratory) monitoring be done quarterly during a rain event from pit #1, as required by the permit. Results are required to be submitted on a Discharge Monitoring Report (DMR) form, and submitted as per the permit (Part IV E-1). In addition, copies of the results for the next two (2) monitoring events should be submitted to me at the address below. • Qualitative (visual) monitoring be done semi-annually, during analytical monitoring events (above), as required by the permit. Copies of the monitoring forms do not need to be submitted to the central office, and should be kept with the SPPP. However, in as a response to the NOV, please submit a copy of the next report to me, along with the lab results. Failure to comply with the permit from this point forward will result in a monthly monitoring requirement, as well as other possible enforcement actions that may include penalties. Technically, since the monitoring as noted above has not been done as required, DWQ is supposed to require monthly monitoring (Qualitative and Analytical) for the remainder of the permit. I will see if I can convince my supervisor that this is pointless since there is no mine-dewatering taking place right now. However, the mine does not possess an 'inactive permit renewal' from DLR, so he may not be able to call the mine 'inactive' without DLR's approval. I hope this helps to get you started anyway. Inc. — Davidson Mine Notice of Violation Davidson County Yadkin -Pee Dee River Basin Certificate of Coverage No. NCG020206 Dear Ms. Carter: The purpose of this correspondence is to provide the information that you requested in your correspondence dated June 17, 2008 and received on June 23, 2008 for the above referenced site. As we discussed during our site visit on May 29, 2008 as well as subsequent telephone conversations in June 2008, Geological Resources, Inc. (GRI) is in the process of completing the Stormwater Pollution Prevention Plan (SPPP) for the site. A draft of the plan will be submitted to you by July 24, 2008 for your comments and a finalized SPPP will be implemented and a copy of the plan will be located at the facility office within 5 business days of your approval of the plan. As you correctly noted in your June 2008 correspondence, the site drains to Beaverdam Creek. The two sediment basins closest to the creek (Basin #1 and Basin #3) are located immediately upgradient of Beaverdam Creek and are old mine pits. Basin #1 has a small drainage area since a temporary diversion channel sends most updrainage runoff to Basin #3, resulting in it having excess water -holding capacity before it begins to overflow. When water from the active mine pit is occasionally pumped, it is sent to Basin #1. If enough water is pumped to Basin 41 to cause it to overflow, the water would follow a pre -mining, natural drainage route to Beaverdam Creek. Basin #1 does not have an outfall that can be sampled. Surface water that collects in Basin #1 could reach the creek only if it overflows the banks and travels to the creek as surface flow. Basin #3 receives runoff from on -site mine haul roads and some active raw material stockpile areas. It is sometimes dry. As with Basin #1, storm water that collects in Basin #3 could reach the creek only if it overflows the banks and travels as surface flow. Basin #3 also does not have an outfall that can be sampled. All the old mine pits (including Basins #1 and #3) have large storage capacities as previously mentioned in the mining permit application for the site. The prevailing drought conditions have also resulted in the basins having lower than normal water volumes. After meeting with you on -site and our subsequent discussions, it became evident that Jacob's Creek would still be required to collect surface water samples from at least Basin #1 as a "worst case" representative sample of water quality in the basin. The sampling frequency would be in accordance with the permit. To correct the inadvertent sampling deficiencies of the past, GRI collected two surface water samples on June 25, 2008, one from each basin (Basins #1 and #3) to satisfy the analytical monitoring requirement of the permit. The samples were submitted to a North Carolina certified laboratory for analyses and the results are currently pending. As soon as the results are available, a copy of the laboratory analytical report will be submitted to your office with a completed Stormwater Discharge Monitoring Report Form. During the site visit, a Qualitative Monitoring Report (QMR) form was also completed for each basin sample and as we discussed, characteristics of color, odor, clarity, floating solids, suspended solids, etc. were noted. On each QMR form it was also noted that there was no outfall. Completed QMR forms will be submitted to your office with the laboratory analytical report. In accordance with the permit, records of each analytical and qualitative monitoring event will be maintained on -site. Going forward, analytical and qualitative monitoring will be conducted for Basin 41 and Basin #3 in accordance with the schedule we discussed and the NPDES permit. The next monitoring event is scheduled for September 2008. To prevent such deficiencies from occurring in the future, a SPPP will be in place with a schedule for on -site inspections of sediment and erosion control structures as well as a schedule of analytical and qualitative monitoring. Records for each inspection by the site manager as well as monitoring records will be maintained diligently on -site. Communication with your office will be a critical element of the SPPP to ensure that Jacob's Creek remains in compliance of all permit requirements at all times in the future. Jacob's Creek and GRI are taking all the necessary steps to ensure that a SPPP is in place before July 31, 2008 and that all permit requirements for sampling and inspections are followed in the future, in accordance with the schedules set forth in the permit. By the permits definition this is a closed -loop system. Due to the capacity of the pond, no analytical or qualitative monitoring is required of the process recycle wastewater or stormwater. The two ponds near the active quarry are also situated in such a way that one, the upper pond, overflows to the other lower pond. The lower pond overflows to Beaverdam Creek. These ponds capture stormwater from the majority of the land disturbing areas, as well mine dewatering wastewater. Annual and quarterly analytical monitorin- is required of the discharge from the lower pond (Part III Sections B-1 and C-1 of the permit). The requirements for both overlap to some degree, but are not identical. In cases where both require monitoring of the same parameter (i.e. suspended solids), you may use one of the quarterly sampling events each year to fulfill the annual monitoring requirements. Please observe the footnotes in the permit regarding increased sampling frequency in the event that effluent limits are exceeded. A written response was received via fax on July 9, 2008, and a Stormwater Pollution Prevention Plan (SPPP) was received on July 23, 2008. It is our understanding that monitoring requirements have been implemented and lab results are pending for the required analytical monitoring.
