Post Office Box 18S6S Greensboro, North Carolina 27419 Subject: NPDES Stormwater Permit No. NCG020187 Representative Outfall Status Request Martin Marietta Materials, Central Rock Quarry Guilford County Dear Ms. Graham: Resources Dee Freeman Secretary The Winston-Salem Regional Office staff have reviewed your request dated April 4, 2010 for a determination that stormwater discharge outfall Pit Discharge (ww, sw land) be granted representative outfall status for stormwater outfalls Office Stockpile Area, Haul Road, and Dirt Haul Road and that stormwater discharge outfall Haul Road Basin (sw shop) be granted representative outfall status for stormwater outfall Upper Shop Basin. Based on Jenny Graznak and Corey Basinger's site inspection on May 4, 2010, we are approving this request. In accordance with 40 CFR §122.21(g) (7), you are authorized to sample outfall Pit Discharge and Haul Road Basin as the representative outfalls. This approval is effective with the next sampling event. However, this approval is contingent on the following requirements: (1) All outfalls, regardless of representative status, must have a cleared path and the right of way to the outfall must be properly maintained. (2) The permit still requires Qualitative Monitoring be performed at all Stormwater Discharge Outfalls, regardless of representative status. In addition, please remember that any actions you initiate in response to benchmark exceedences as directed in the tiered response provisions of your permit must address all drainage areas represented by the Pit Discharge Outfall, where appropriate. Please append this -letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that representative outfall status has been approved. If changes in drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfall status may no longer be valid. You should either resume sampling at all storm water discharge outfalls, or reapply to this office for representative outfall status based on updated information. For example, describe how activities and/or materials are similar. Several areas exist onsite in which stormwater comes into contact with crushed stone that is stockpiled for sale, and used around the site for maintenance or control purposes. Other areas exist in which we are grading to expose the rock, stockpiling pond fines, or have existing haul roads. Most of the stormwater from our crushing operation and grading activities drain to the pit and is held in the sump for settling. This water is then pumped out of the pit and discharged offsite. Since no unique characteristics exists for the outfall locations we are requesting representative status for the semi-annual sw land discharge to be collected at the pit discharge location, the same location we collect the quarterly wastewater discharge. We will take_ the semi-annual sw onsite maintenance sample at the Haul Road Basin closest to the shop, given that most of the shop and maintenance area drains that direction prior to leaving the site. 5) Certification: North Carolina General Statute 143-215.6 B(i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($10,000). I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are still subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit and regional office approval. Sullins, Director Division of Water Quality On September 11, 2008 George Smith, of this office performed a Compliance Inspection. Ms. Stephanie Graham, Environmental Engineer and Mr. Steven Whitt, Director, Environmental Services, were present for the inspection. The attached inspection form evaluates sir (6) areas as noted in this letter of the attached EPA inspection report, and the observations and comments during the inspection are addressed below: Permit The NPDES general permit became effective on January 19, 2005 and expires on December 3)1, 2009. Your certificate of coverage became effective on February 7, 2005. The inspection covered the following Terms and Conditions in the permit: I . Authorization to Construct and Operate a Treatment Facility per Part 1I, Section A. 2. Operation of a Treatment Facility per Part II, Section B 1 Monitoring, Controls, and Limitations for Permitted Discharges per Part III, Section A. 4. An Authorization to Construct is not needed at this time per Part 1I, Section A, since the treatment facilities are not being expanded. 2. Operation of the treatment facility per Part 1I, Section B, states that process wastewater shall be monitored. There was a discharge of water from Outfall 001. The discharge enters Little Alamance Creek, Class WS-IV; NSW waters, which did not have any noticeable adverse impacts. 3. Monitoring, Controls, and Limitations for Permitted Discharges per Part I11, Section A requires that Best Management Practices (BMPs) be implemented. Please insure that all stormwater BMPs are inspected and documented at defined per paragraph 3. 4. Analytical Monitoring for Discharges Composed .Entirely of Stormwater per Part III, Section B were performed as required per Tables i & 2. The vehicle maintenance Area was monitored at Outfall 002 per Tables 3 & 4. 5. Mine dewatering & Recycle wastewater discharges per Part 11I, Section C (Quarterly Monitoring) were performed at Outfall 001. Facility Site Review The vehicle maintenance area contains various types of petroleum products in drums and storage tanks. They all have secondary containment measures. The contairunent structures were well maintained and structurally sound. Laboratory Analytical tests, such as, Settleable solids, Total Suspended Solids, Turbidity, pH, Oil & Grease, etc. are all performed using approved analytical methods by a certified lab. All tests are properly performed and documented. Self -Monitoring Prop,ram The facility had monitoring records on -site, as required in the records & reports section of this report. The analytical qualitative monitoring was performed.
