The Mooresville Regional Office received your stormwater monitoring report for the above
referenced site on October 22, 2018. Based on the letter and our discussions on October 31,
the Mooresville Regional Office advises Vulcan to disregard the monitoring results from the .
September 17, 2018 sample event and use the results from the October 5, 2018 sample event

Dear Sir/Madam:
Vulcan Construction Materials, LLC (Vulcan) currently operates its Cabarrus Quarry in Cabarrus
County under North Carolina NPDES General Permit COC No. NCG020172. Vulcan discharges both
process water and stormwater under the permit through outfalls 001 (mine de -watering) and 002
(stormwater discharge).
Part IV, Section D of the permit requires Vulcan to sample the following parameters on a semi-annual
basis, unless an effluent limit in Permit Table 8 is exceeded, at which point, sampling frequency must
return to quarterly until all results are below the effluent limits for four consecutive quarters are below
the effluent limits:

Standard Units
No effluent limit for turbidity applies, but turbidity in the receiving waters shall not exceed the appropriate water quality
standards listed in the permit (See Pen -nit language following Permit Table 8). Exceedances of the water quality
standard in the effluent sample are not considered an exceedance of an effluent limit; but rather, require the facility to
commence sampling of turbidity in the receiving stream, both upstream and downstream of the effluent outfall, in
addition to the effluent, upon the next monitoring period (See Permit Table 7, footnote 3).
Vulcan is required to sample TSS but is not subject to the TSS limitations in Permit Table 8 since it is not an Industrial
Sand Mine and does not discharge to a HQW, ORW, HQW/ORW Trout, or PNA water (See Table 7 footnote 5 and
Table 8 footnote 2).
Vulcan performed sampling of its mine de -watering outfal1 001 on September 17, 2018, immediately
after the storm effects of Hurricane Florence passed through the area of the facility. As a result, the
turbidity in the sample was reported as 86.6 NTU, a value significantly higher than normal and in excess
of the receiving water quality standard of 50 NTU (See Attachment 1 for the analytical results for this
sample). Again, we believe that the higher than normal value was a direct result of the historic rainfall
that had occurred in the days prior to the sample being taken and was not representative of normal mine
pit de -watering activities. Vulcan did take a second sample on October 5, 2018 and the turbidity results

were significantly less than 50 NTU (See Attachment 2 for the analytical results for the second
sample).
Therefore? Vulcan-requests_that the-DEQ_allow Yu_ lcanto_disregard th"e sample taken at the -ends
of the-HurrieaneFlofence event-(Septemberl7, 2018) and use the October 5, 2018 sample_as_its
semi-annual sainple result._

In addition, as detailed under the "Monitoring for Mine Dewatering and Authorized Process
Wastewater Discharges" section of the permit (See Part IV, Page 10 of 12), the permit requires
that "Sample results that exceed an effluent limitation must be submitted to the Regional Office
no later than 30 days from the date that the facility receives the sample result and the results be
included in a DMR. However, as detailed in the language following Table 8, "This General
Permit requires the measurement of turbidity in the permittee's discharge but does not impose a
turbidity effluent limit." In addition, Permit Table 7, footnote 3 reads as follows:
"Turbidity must be monitored at the effluent (E). If effluent levels exceed the Water
Quality Standard of the receiving water, the permittee must begin sampling turbidity
directly upstream (U) and downstream (D) of the effluent outfall..., in addition to the
effluent, upon the next monitoring period."
Based on our review of the permit, -we do not believe that the September 2018 turbidity sample
iresult of 86:6-_NTU represented an exceedance of an -"effluent limit" -of the=permit and -therefore,
Vulcan is not necessarily required to report'this result "within 30 days.'' N6twithstandih_ - we
are providing this notice to the DEQ as_a conservative measure (note also that if the D_EQ allows
Vulcan-.to-disregard"the-initial September"sample, this -issue may be -moot).

In addition, in the event that the DEQ does not allow Vulcan to "disregard" the initial September
sample, since the turbidity results from the first sample resulted from circumstances that we
believe were out of our control (i.e.- Hurricane Florence), we -are also -requesting that Vu! an -not
be- required -to - commence- upstream and downstream sampling -of the receiving water as _would
normally -be required under the General Permi� _ ~�

This letter accompanies the discharge monitoring report for the above referenced
facility. The result from our second quarter process water sample was found
undetermined.
We determined that the lab didn't analyze the sample for the second quarter for
outfall 001, due to documentation error. We didn't realize this until the third quarter. The
guy that normally takes water samples had been out on personnel leave. A third quarter
outfall 001 process water sample had been taken and everything was well within the
parameters. We contacted Samar Bou-Ghazale in the Mooresville Regional Office to give
notice.
Vulcan has implemented a checking process and completed refresher training with the
plant personnel to keep this from happening again.

facility. The result from our first period storm water sample oil and grease parameters
was found undetermined.
We determined that the lab didn't analyze the sample oil and grease parameters
for the first period for outfall 003, due to a documentation error. We didn't realize this
until the year end. The guy that normally takes water samples had been out on personnel
leave. The previous period and the 2nd period oil and grease samples that had been taken
have been well within the parameters. We have no reason to believe that it was out of
spec during that time, due to the fact of these previous and post results.
Vulcan has implemented and upgraded our documentation process with a new form and
completed refresher training with the plant personnel to keep this from happening again.

While this is primarily in response to the above NOV, let me begin by saying we appreciate your
and your staff's time and assistance during our recent meeting. The helpful comments and
cooperative spirit will be invaluable as we move forward.
Regardipg the NOV, the following statement will address the cited deficiencies:
. Improper timing of stormwater sampling: Although specified in our BMP Plan and
addressed in personnel training, we had apparently failed to adhere to this requirement, in
part due to personnel changes. To avoid reoccurrences, we have reviewed this — Part III,
Section B - and other permit requirements with site personnel.
2. Reporting of noncompliance: We erred in our understanding that the Division's
inspection on November 3 was sufficient notification of noncompliance conditions we
first became aware of on November 2. To avoid reoccurrences, we have reviewed this —
Part IV, Section E. 8. - and other permit requirements with site personnel.
As further follow-up to the above, we have shared the proper procedures with our other locations
within the Mooresville Regional Office area as wel I of our other locations throughout the state.
In so doing, we have maximized the lessons.,pj%r d from this regretful event and help ensure
there will not be similar reoccurrences.

Dear Mr. Poplin:
Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the
Environmental Management Commission of the Department of Environment & Natural Resources to
protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the
delegated authority to enforce adopted pollution control rules and regulations.
On November 13, 2009, Ms. Barbara Sifford and Mr. Samar Bou-Ghazale of this Office conducted
an investigation at the subject facility. During this inspection, it was learned that this facility is conducting
the analytical monitoring in violation of the subject permit condition. Please note that the analytical sample
for the stormwater permit is to be collected within the first 30 minutes of discharge. It was learned during
the investigation that the analytical samples were being collected after 24 hours period. Also, the permittee
shall report to the DWQ Mooresville Regional Office any noncompliance which may endanger health or
the environment. During the investigation it was learned that a sediment basin had failed approximately 60
days prior to this inspection and impacted a tributary downstream of the property.
Please be advised that G.S. 143 -215.6A provides for a civil penalty assessment of not more than
twenty-five thousand dollars ($25,000.00), against any person who is required but fails to act in
accordance with the terms, conditions, or requirements of such permit.- Penalties may also be assessed
for any damage to the surface waters of the State that may result from the above violations.

This certificate of coverage shall become effective February 22, 2000.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
