Box 550 Newton, NC 28658 Dear City of Newton: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.032 acre of wetlands for the purpose of sewer line installation as you described in your application received by the Division of Water Quality on November 22, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This certification allows you to use Nationwide Permit Number 12 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. The applicant is hereby reminded that with the exception of crossings, the sewer line construction corridor cannot be placed within 10 feet of the creek. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The project includes approximately 2,700 feet of 8 -inch gravity sewer, 7 7,235 feet of 18-inch gravity sewer, two pump stations, 11,815 feet of 8-inch force main 1 160 feet of 4-inch force main and 2,3 50 feet of access road. 13. PURPOSE OF PROPOSED WORK: To provide sanitary sewer service for new and proposed residential and commercial developments in the area of the new NC 10/US 321 interchange in Catawba County. The area currently has no sewer service and the sewer system was designed to accommodate future flows based on population and land use proiections. 14. STATE REASONS WHY IT 1S BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) Pipes will be installed so that the top is at least 1 foot below the stream bed bottom and stream crossings will be at or near 90° angles Stream banks will be restored to original contours and stabilized with a combination of ripray and vegetation plantings (silky willow, silky dogwood hazel alder). Sewers must be located in low-lying floodplains to allow wastewater to flow by gravity and minimize pumping needs. 15. City of Newton US 321/NC 10 Interchange Sewer System PROJECT DESCRIPTION The US 32I NC 10 Interchange Sewer System project consists of the following improvements: ¦ Approximately 2,740 feet of 8-inch gravity sewer along NC 10. This sewer will convey wastewater from the area around the US 321/NC 10 interchange and will be located within the North Carolina Department of Transportation's NC 10 right-of-way. ¦ Approximately 7,240 feet of 18-inch ravi sewer along the South Fork Catawba River from NC 10 to the location of the proposed pump station. The new 18-inch gravity sewer will serve the areas on both sides of the South Fork Catawba River. ¦ Approximately 13,500 feet of 8-inch force main along a tributary of the South Fork Catawba River from the proposed South Fork pump station to an existing pump station. The new 8-inch force main will convey wastewater to the existing Westside pump station near Betts Branch. ¦ Approximately 1,200 feet of 4-inch force main along Startown Road. The 4-inch force main will convey wastewater from the proposed Startown Road Elementary School pump station to the proposed 8-inch force main. ¦ South Fork Pump Station. The South Fork pump station is required to convey wastewater flows from the proposed service area to the Clark Creek WWTP. The pump station was designed to ultimately convey a peak wastewater flow of 1.97-mgd from the new gravity sewers into the new force mains, which carry the wastewater to the wastewater treatment plant. Dual pumps will be provided. ¦ Startown Road Elementary School Pump Station. A second pump station will be constructed at the Startown Road Elementary School in order to allow removal of an existing septic tank. It will convey flow from the school into the new 8-inch force main and will be equipped with two 140-gpm pumps. The South Fork Catawba River gravity sewer will cross two tributaries. The 8-inch force main will three tributaries and Betts Branch. At each stream crossing, the sewer will be grouted in a continuously welded steel casing laid in a trench crossing the stream. The casing pipe will be supported on each end by concrete collars placed against undisturbed earth. All crossings will be subaqueous, and original stream bank contours will be restored after construction. Rip rap will be used to stabilize the stream banks below the high water mark, and dormant cuttings of silky dogwood (Cornus amomum), silky willow (Salix sericea), and hazel alder (Alnus serrulata) will be used above the high water mark. The 8-inch force main will also cross one jurisdictional wetland area. In this area clay or concrete anti- seep collars will be placed at least every 150 feet. Original contours will be restored and the area will be reseeded with a wetland plant mix. Both pump stations will be located on upland sites. However, because this county has not been systematically inventoried, I cannot state definitively that no rare species exist in this area. The sewer lines will be placed along NC 10, the South Fork Catwaba River, and a tributary of the South Fork Catawba River. The proposed sewer line project would service the following areas: south of NC 10 to Rocky Ford Road between US 321 and Startown Road; the area north of NC 10 between Startown Road and US 321, and a section west of US 321. The project will enable the City of Newton to provide gravity sewer service to new residential and commercial growth being induced by the construction of US 321 west of the City of Newton. It is estimated that the interchange sewer system will transport .79 million gallons per day (MGD) in the year 2020. Wastewater will be conveyed to the Clark Creek Wastewater Treatment Plant (WWTP) which has a permitted capacity of 7.5 MGD. The plant's average monthly flow in 1997 was approximately 2.6 MGD. An expansion of the WWTP is not required to accommodate flows from this project. However, the City of Newton has agreed to contact the Division of Water Quality's Pretreatment Unit prior to connecting any industry to the sewer system, having nickel concentrations above domestic levels (see Appendix C). Although the route of the pipeline was chosen to minimize work in environmentally sensitive areas, the project will require the clearing of approximately five acres of land and will include ten stream crossings. Impact minimization efforts include maintaining a fifty-foot undisturbed vegetated buffer between streams and construction activities wherever possible, and limiting construction width in wetlands to 40 feet. Post construction activities will include restoring the site to previous grade and contours, and revegetating to control erosion. Anti-seep collars will also be installed at least every 150 feet along the stream segments of pipeline to control the migration of groundwater along the pipe bedding and avoid draining wetland areas. No instream activities will take place during April and May. Efforts will be made to avoid mowing between April 1st and September 30th. Dormant cuttings of silky dogwood (Corpus amomum) and silky willow (Salix sericea) and rooted stock of hazel alder (Alpus serrulata) will be used for restoration. The only expected permanent changes will be along the 25-foot wide right-of-way corridors, which will be maintained through mowing every three to four years. The "No Action" alternative was dismissed because growth in the area would still be expected to occur but less desirable wastewater treatment such as package treatment systems and individual septic systems would be used instead. Although the alternative of using smaller diameter pipelines would allow narrower trench widths and less construction impacts. However, this alternative was eliminated because the pipes would not convey the projected peak wasteater flows from the service area. Based on the findings of the EA and on the impact avoidance/mitigation measures contained therein, it is concluded that the proposed project will not result in significant impacts to the environment. This EA and Finding of No Significant Impact (FONSI) are prerequisites for the issuance of the 401 Water Quality Certification and Sewer Extension Permit by the Division of Water Quality. Pending approval by the State Clearinghouse, the environmental review for this project will be concluded. An environmental impact statement will not be prepared for this project.
