Our samples are collected at the stormwater discharge outfall (end of pipe), and we have no in stream data to indicate that there was an exceedence to the stream standard for Turbidity as a result of our discharge. However, our Total Suspended Solids result was 157 mg/l, and therefore above the 100 mgll benchmark value. We have conducted a stormwater management inspection, identified possible causes of the exceedence, and implemented our actions to prevent another exceedence. Enclosures cj Tier One Stormwater Management Inspection Site: Salem Stone Quarry Sample Date: September 23, 2011 Benchmark Exceedence: Total Suspended Solids-157 mg/1 Outfall: Riser Basin 430 Inspection Date: October 4, 2011 Inspection Attendees: Stephanie Graham, Vance Allred, and John Hawley Inspection Observations: We began our inspection by discussing the rain event in which the sample was collected. The event lasted approximatelyl3 hours, raining off and on, during which we recorded 2.5" of rain at the site. The Land Disturbance Outfall known in our SPPP as Riser Basin #30, appeared to be completely stabilized. Upon further inspection, it was noted that a small area inside the basin has eroded, and this area is close to the discharge of the basin. It appears that stormwater flows into the basin above this point and is causing minor erosion to the structure in this area. We determined that we will repair the small area that is eroding by placing riprap inside the basin wall and immediately stabilizing the area. At the same time, we will create a small check dam above the basin to provide additional settling and slow the velocity of the runoff coming to the basin in this area. We also determined that we need to provide a channel to capture the flow of stormwater entering the basin and direct this flow more to the back of the structure. A riprap lined diversion ditch currently exists for this purpose, but allows flow to enter the basin about half way up the structure instead of entering at the back. The facility is located at 4572 High Point Road, in Kernersville, Forsyth County, North Carolina. Stormwater and wastewater related to mining activity is discharged to Spurgeon Creek, which is classified as Class WS-III waters in the Yadkin River Basin. Documentation & Monitoring Review 3. The Stormwater Pollution Prevention Plan (SP3) is under development. All required components were available at various stages of completion. You stated that you intend to have the entire plan completed no later than February, 2011. Please make it a high priority to complete the entire plan within the above specified timeframe. 4. The site currently has representative outfall status (ROS), which was originally granted by the region in June 2008. The ROS allows you to monitor only Stormwater Discharge Outfall (SDO) 001 as representative of all other stormwater outfalls. The site also has a wastewater discharge from the pit wastewater clarification pond, which also receives the stormwater runoff from the vehicle maintenance area. Your summary, which 1. have pasted below, captures most of the points we discussed. There are three points listed below that I felt we needed to clarify. These should be the same points as on the document that I gave you at the meeting with the Environmental Committee of the NCAA on May 15, 2007. 1. If a mine application is submitted showing a parcel with wetlands that have not been delineated and protected, then we will ask for the delination before we act on the application or await 401 permitting from DWQ. 2. In some special cases, Land Resources may have to await DWQ evaluation before permitting, even if buffers are shown because of the potential impact that mining could have on the wetland areas. The potential for mine dewatering in karst areas drying up adjacent wetland areas is an example where mine permitting may have to be coordinated with DWQ permitting. 3. If the DWQ permit required changing the proposed mining, reclamation or other environmental protection provisions that were either contrary to or inconsistent with the previously approved conditions in the mining permit, then the mining permit would have to be amended to be consistent with the DWQ requirements. Jim Tim, <mailto_N4ell.Nevilsacinail.net> Floyd, and Mell, 1/29/2008 Page 2 of 3 On behalf of Martin Marietta, thank you for your willingness to meet with Steve, Jay, and I this morning to discuss the recent mining permitting issues related to proposed impacts to potential jurisdictional wetlands and streams that exist at a few of my locations. Martin Marietta continues to strive to improve the quality of our reining permit submittals, while reducing the number of revisions that may take place within the permitting process. Referring to both letters received from your Department for Maiden dated February 28, 2007 and the most recent request for additional information for Salem Stone (no date provided), both letters requested, "Provide proof you have obtained any necessary approvals from the Division of Water Quality to (1) impact the wetlands (Maiden) and (2) regarding mining trough the stream within the future pit limits (Salem Stone)". I had expected to see typical conditions provided in each of these permits that would "require proper approvals from the Division of Water Quality shall be obtained prior to impacting or mining through these arras". Thus my desire to discuss Land Qualities position and try to come to an understanding that would ensure that 401 Certifications are obtained prior to any disturbances while addressing the requirements within the Mining Act and subsequent approval from your Department. As stated in the meeting, I offered to summarize our conversation and outline the requirements of fiiture mining modification submittals that may propose impacts to wetlands or streams. They are as follows: 1. Adequate undisturbed buffers will be provided around all streams and wetland limits that may be subject to future mining impacts and will be clearly identified as such and noted that no impacts of these areas will be conducted until approvals from the North Carolina Division of Water Quality have been obtained. Copies of these approvals will be sent to the Division of Land Resources, Land Quality Section for their records.. 2. Assuming all erosion and sedimentation issues have been addressed and have been reviewed and approved, Land Quality will allow the disturbance of all proposed impacts to streams and wetlands that are shown on the most recent revised mine map once the Division of Water Quality approval is obtained. 3. A note shall be provided on the most recent revised mine map that clearly indicates that "No impacts will be conducted in wetlands or streams until such time that the Division of Water Quality issues their approval" or similar language to this extent. 4. No additional submittal of revised aline maps will be provided or required by Land Quality after the Division of Water Quality issued their approval. Again, only the approval from the Division of Water Quality is required to be submitted to Land Quality. 5. Typical or specific Ianguage may be included in Section 3 Buffer Zones (or other areas as deemed necessary by the Department) of the approved mining permit that describes or indicates the above language related to proper approvals prior to any impact to streams or wetlands and the requirement of those approvals to be submitted to Land Quality 1/29/2008 Page 3 of-3 , upon receipt from the Division of Ware Quality. Related to Salem Stone Quarry (Mining Permit # 34-09), once N \4A has revised the rnifte map to reflect the revised design of sediment and —y— erosion control measures outside of the clearly defined buffers along all potential. streams within the proposed future pit limits that are located south of the existing pit boundary, no additional fee will be required within the future modification request to disturb this parcel for future mining purposes. Clean only as necessary to install these measures. Diversion ditches and sediment basins along the edge of the initial clearing limits are to be installed before the clearing of these areas begins. Stabilize proposed ditches as specified in the ditch lining table. 4. When constructing sediment basins adjacent to existing Spurgeon Creek. Install the velocity dissipater at outlet of the barrel before sediment laden water routed through the basin. 5. Erosion control measures are shown adjacent to each proposed land disturbing activity. Before any of the proposed construction begins, all measures associated with the particular construction are to be installed. (For example: before the existing berm just west of the existing shop is removed, the relocated riser basin S.T. #7 and S.T. #9 shall be installed as well as the diversion ditches leading to each of the measures.) 6. Specific sequence for installation of the 72" culvert or additional culverts: A. If placement of fill adjacent to Spurgeon Creek begins before the culvert installation is completed. The temporary ditches and sediment traps adjacent to the creek must be inspected as shown before any fill is placed. B. Install rock check dam in Spurgeon Creek downstream of the proposed pipe before pipe installation begins, C. Beginning downstream, lay sections of pipe in the existing stream bed. Minimizing disturbance when the entire culvert has been installed and flow is directed into the pipe, begin placing fill over the pipe. Install silt fence on the fill slope just above both inverts as soon as physically possible. Remove rock check dam downstream. The diversions and traps located adjacent tot he existing creek are to be installed at the end of each work day. Any damages to be repaired on the day it occurs. D. Before fill is placed over the pipe, the sediment basins and corresponding diversions are to be installed. As fill placement is performed in future plant area, permanent slope drains and their corresponding - diversions and velocity dissipators are to be installed. Specific sequence for area adjacent to existing pond southeast of site (Before placement of fill in berm). A. Install velocity dissipator at downstream end of proposed 6" drainage pipe. Install diversion ditch and sediment trap #26. Extend 6" drainage pipe from existing standpipe outlet. B. Construct diversion from outlet of proposed overflow pipe to existing drainageway. Install riprap apron at confluence and stabilize diversion with riprap as specified. Install velocity dissipator at outlet of proposed 48" culvert and then install 48" culvert. C. Construct velocity dissipator at downstream end of proposed 42" pipe. Install pipe. D. Construct remainder of traps and diversions surrounding the proposed berg before berm construction begins. 7. All existing measures which receive sediment -laden flow are to be maintained. Measures which may have been covered up shall be uncovered or reinstalled if they receive sediment -laden flow. 8.
