Please find enclosed a copy of our Stormwater Tier One Response associated with our semi-
annual sampling event conducted on September 23, 2011. Our samples are collected at the
stormwater discharge outfall (end of pipe), and we have no in stream data to indicate that there
was an exceedence to the stream standard for Turbidity as a result of our discharge. However,
our Total Suspended Solids result was 157 mg/l, and therefore above the 100 mgll benchmark
value. We have conducted a stormwater management inspection, identified possible causes of
the exceedence, and implemented our actions to prevent another exceedence.

Inspection Attendees: Stephanie Graham, Vance Allred, and John Hawley
Inspection Observations: We began our inspection by discussing the rain event in which
the sample was collected. The event lasted approximatelyl3 hours, raining off and on, during
which we recorded 2.5" of rain at the site. The Land Disturbance Outfall known in our SPPP as
Riser Basin #30, appeared to be completely stabilized. Upon further inspection, it was noted
that a small area inside the basin has eroded, and this area is close to the discharge of the basin.
It appears that stormwater flows into the basin above this point and is causing minor erosion to
the structure in this area.
We determined that we will repair the small area that is eroding by placing riprap inside the
basin wall and immediately stabilizing the area. At the same time, we will create a small check
dam above the basin to provide additional settling and slow the velocity of the runoff coming to
the basin in this area. We also determined that we need to provide a channel to capture the flow
of stormwater entering the basin and direct this flow more to the back of the structure. A riprap
lined diversion ditch currently exists for this purpose, but allows flow to enter the basin about
half way up the structure instead of entering at the back.

conducted a compliance evaluation inspection (CEI) at the subject facility on December 1, 2010.

3. The Stormwater Pollution Prevention Plan (SP3) is under development. All required components
were available at various stages of completion. You stated that you intend to have the entire plan
completed no later than February, 2011. Please make it a high priority to complete the entire plan
within the above specified timeframe.
4. The site currently has representative outfall status (ROS), which was originally granted by the
region in June 2008. The ROS allows you to monitor only Stormwater Discharge Outfall (SDO)
001 as representative of all other stormwater outfalls. The site also has a wastewater discharge
from the pit wastewater clarification pond, which also receives the stormwater runoff from the
vehicle maintenance area. Analytical monitoring of both of these outfalls is being accomplished

discrepancies were noted. All above ground storage tanks are within secondary containments
each of which had a locked drain valve. All containment areas were in excellent condition and no
signs of spillage were noted. Please ensure that the site's SP3 and monitoring plans continue to
be updated along with any physical changes at the site.

is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15,
2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage

• Two copies of the Tier 21 Exceedence Discharge Monitoring Report (DMR) Form for stormwater

The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with
respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all the changes in the reissued permit. If your Certificate of Coverage (COC) restricts
authorization to discharge stormwater only (or other limited terms) based on your original application, or
subsequent modifications to your COC, you must continue to meet these requirements or contact the Stormwater
Permitting Unit to request a modification of this renewal COC-
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
Part iI:
• Section B — Language referencing PAMS has been changed. Flocculants may now be used if evaluated
by the Division and administered in accordance with maximum application doses and other requirements.
Part iII:
• Section A -- The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the
mining industry, in lieu of a Stormwater BMP Plan.
• Section A - inactive mines may be inspected on a reduced schedule: at least once per month and after
05' (or more) of rain. To qualify, inactive mines must possess an "Inactive Renewal" from DLR or certify
to DWQ the site has been stabilized. The permittee must notify the DWQ Regional Office of inactive
status. Discharges from inactive mines must still be monitored on the same schedule as active mines.

• Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of
annually), and that the sampling results be compared to new benchmark values. (The previous
cut-off
concentrations have been removed.)
• Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three
response actions, based on the first benchmark exceedence (Tier One) and the second consecutive
benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
(reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring
shall be done until three consecutive monitoring events show no benchmark exceedences. l!
• Section B — This part contains a new provision that four exceedences of any benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may
direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the
implementation or installation of specific stormwater control measures. 1
• Section B — The definition of "Representative Storm Event' (RSE) now allows 48 hours (instead of 72
hours) of little or no precipitation to precede an RSE.
• Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be
monitored.
• Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the -
remainder of the permit.
• Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil, & Grease
parameter in the previous permit.
• Section D — Qualitative monitoring must now be conducted during the same representative storm event
as the analytical monitoring. i
• Section D -- The permittee is required to keep a written record of his response to problems identified by
his qualitative monitoring observations.
• Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the
permittee may be required by DWQ to perform corrective action. I
• Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for
some Stormwater Discharge Outfalls (SDOs). i
• Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that
mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring,
install or modify structural stormwater controls, or implement other controls.
• Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP aInd
recorded in the Annual Summary DMR. i
• Section E — A lower TSS Wastewater limit for PNA waters is included in the permit. I
• Section E -- All mining operations are now required to monitor TSS in wastewater effluent discharges (not
only industrial sand mines). However, TSS limits only apply to industrial sand mining operations.
• Section E —Turbidity limits on effluent discharges have been removed; however, turbidity standards still
apply in the receiving waters.
• Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with
dewatering activities that have the potential to drain wetlands or other surface waters).
• Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for
Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle
Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR).
• Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform
monitoring is now required for all process and mine dewatering wastewater discharges to SA waters_
Part IV: i
• Section E — Items 1. and 2. require submittal of a new reporting form: the Annual Summary DMR! This
annual summary of the analyticamonitoring results should be submitted to the DWQ Central Office by
March 1 of each year.
• Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30
days of receipt from the lab.
• Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling
period in the SPPP. "No flow" or "No Discharge" must also be reported on the Annual Summary DMR

Enclosed please find a copy of the Compliance Evaluation Inspection form from the inspection
conducted on June 5, 2008. The Compliance Evaluation Inspection was conducted by Rose Pruitt
of the Winston-Salem Regional Office. The inspection consisted of two parts: anon -site
inspection of the treatment facility and a file review. The following are the findings from the
subject inspection.
The facility was found to be in Compliance with permit NCG020096.
I. Permit
Coverage under this permit is applicable to:
• Stormwater point source discharge outfalls associated with mining and quarrying of
nonmetallic minerals, land disturbance and vehicle maintenance.
C Mine dewatering wastewater discharge outfalls.
• Wastewater discharge outfalls from sand and/or gravel operations.

The General Permit became effective on January 19, 2005 and expires on December 31, 2009.

II. Stormwater BMP Plan
The Permittee is responsible for developing and implementing a Stortwater Best Management
Practices Plan. All Stormwater BMPs should be inspected at least once every seven calendar days
and within 24 hours after a storm event that results in a discharge. Stormwater BMPs should be
properly operated and maintained. A signed copy of the erosion and sedimentation control permit
issued by the Division of Land Resources should be kept on site. Compliance with the issued
permit is a requirement of this general permit.

A Stormwater BMP Plan has been developed for this facility. Stormwater BMP inspections
were current. A signed copy of the erosion and sedimentation control permit issued by the
Division of Land Resources was available at the inspection.
IIL Analytical and Qualitative Monitoring of Stormwater
Annual grab samples for settleable solids, total suspended solids, and turbidity are required for
Analytical monitoring for Stormwater discharges from Land Disturbance and Process Areas as
well as pH, oil and grease, and total suspended solids for Analytical monitoring for On -Site
Vehicle Maintenance Areas. Samples should be collected at each outfall unless Representative
Outfall Status has been established.
Qualitative monitoring for color, odor, clarity, floating and suspended solids, foam, oil sheen,
deposition or erosion at or below an outfall and other obvious indicators of stormwater pollution
are required semi-annually at all stormwater outfalls. Qualitative monitoring is required at each
outfall regardless of Representative Outfall Status or cut-off concentrations.
This facility is compliant with Analytical and Qualitative monitoring requirements.
Representative Outfall Status (ROS) was established during this inspection, a separate letter
confirming ROS will be forthcoming and should be attached to your permit for future
reference.
IV. Effluent Limitations and Monitoring Requirements For Mine Dewater_ing and Process
Wastewater.
Analytical monitoring for pH, settleable solids,,total suspended solids, turbidity and fecal coliform
is required quarterly for mine deNi,atering and/or sand/gravel mining unless effluent limits are
exceeded at which time monthly monitoring will be required for that parameter for the remaining
permit term. Additional monitoring requirements may apply to facilities with overflow from a
closed loop process wastewater system and overflow from process recycle wastewater systems.
This facility was found to be in compliance with analytical monitoring requirements for mine
dewatering and process wastewater. Monthly monitoring was performed for parameters
that exceeded cut-off concentrations.

Dear Mr. Tedder:
Thank you for meeting with me Tuesday morning to discuss and clarify the upcoming stormwater
inspections at our quarries on June 5. As we discussed, a request was received from Ms. Rose Pruitt on
June 2 that copies of all requested documents from the stormwater inspection checklist be available for
the inspector at the scheduled inspection. Every attempt has been made to have copies of all items on
the checklist available by the inspection date, however, due to the volume of the information requested,
we will not be able to provide copies of all of the documents requested.
At this time, copies of the SPCC Plan, the BMP Plan, the Mining Permit issued by the Division of Land
Resources, and DMR records from January 2005 through the first quarter of 2008 are available for you.
Please note that a complete set of all of the requested information is on -site at each quarry office, as
required by our NPDES Permit.
All of the analytical results for each sample that has been submitted to Pace Analytical for each of our
quarries will be available for your review. Should you or Ms. Pruitt need copies of these results, or any
other information, I will mail them to you no later than Tune 17, 2008 per your request.

Stone Quarry. Our last modification indicated that we would not impact the southern portion of
the site until approval was received from the USACE and the Division of Water Quality to
impact the tributaries of Spurgeon Creek. Please find enclosed the cover letters from the Corps
and DWQ to confirm we have received our 404 and 401 permits. All erosion control has been
addressed for the 82.6 acres to be impacted, which will include future pit area and perimeter
berm.
It is our understanding from conversations that took place on May 15, 2007 at the NCAA
Environmental Committee Meeting between Jim Simmons and Brian North, that no additional
fee will be required for this modification request to impact this area.

record, -enclosed are two copies of a Department of the Army permit authorization to impact
approximately 3,527 linear feet of stream channels (2,872 linear feet of important stream channel
and 655 linear feet of un-important stream channel) of the jurisdictional waters of two unnamed
tributaries of Spurgeon Creek associated with the proposed expansion of your existing Salem
Quarry facility located off of High Point Road, south of the intersection with US 311, southeast
of Winston-Salem, in Forsyth County, North Carolina. Coordinates (in decimal degrees) for the
site are 36.0262382 North,-80.1103207 Nest. The site is adjacent to two unnamed tributaries of
Spurgeon Creek in the Yadkin River Basin (8-Digit Cataloging Unit 03040101).
You should acknowledge that you accept the terms and conditions of the enclosed permit
by signing and dating each copy in the spaces provided ("Permittee" on page 3). Your signature,
as permittee, indicates that, as consideration for the issuance of this permit, you voluntarily
accept and agree to comply with all of the terms and conditions of this permit. All pages of both
copies of the signed permit with drawings should then be returned to this office for final
authorization. A self-addressed envelope is enclosed for your convenience.
Title 33, Part 325.1(f), of the Code of Federal Regulations reads, in part, that, "A $10 fee
will be charged for permit applications when the work is noncommercial in nature and provides
personal benefits that have no connection «nth a commercial enterprise...", and "A fee of $100
`vill be charged for permit applications when the planned or ultimate purpose of the project is
commercial or industrial in nature and is in support of operations that charge for the production,
distribution, or sale of goods or services." As your application fits the latter category, you are
requested to remit your check for $100.00 made payable to the Finance and Accounting Officer,
USAED, Wiltmington. ' The check should accompany the signed and dated copies of your permit.

This correspondence contains a proffered permit for the above described site. If you object
to this decision, you may request an administrative appeal under Corps regulations at 33 CFR
part 331. Enclosed you will find a Notification of Appeal Process (NAP) fact sheet and request
for appeal (RFA) form. If you request to appeal this decision you must submit a completed RFA
form to the Raleigh Regulatory Field Office at the following address:

Thank you for email concerning our meeting at the Martin Marietta Office. Your summary, which 1.
have pasted below, captures most of the points we discussed. There are three points listed below that I
felt we needed to clarify. These should be the same points as on the document that I gave you at the
meeting with the Environmental Committee of the NCAA on May 15, 2007.
1. If a mine application is submitted showing a parcel with wetlands that have not been delineated and
protected, then we will ask for the delination before we act on the application or await 401 permitting
from DWQ.
2. In some special cases, Land Resources may have to await DWQ evaluation before permitting, even if
buffers are shown because of the potential impact that mining could have on the wetland areas. The
potential for mine dewatering in karst areas drying up adjacent wetland areas is an example where mine
permitting may have to be coordinated with DWQ permitting.
3. If the DWQ permit required changing the proposed mining, reclamation or other environmental
protection provisions that were either contrary to or inconsistent with the previously approved
conditions in the mining permit, then the mining permit would have to be amended to be consistent with
the DWQ requirements.

On behalf of Martin Marietta, thank you for your willingness to meet
with Steve, Jay, and I this morning to discuss the recent mining
permitting issues related to proposed impacts to potential
jurisdictional wetlands and streams that exist at a few of my locations.
Martin Marietta continues to strive to improve the quality of our reining
permit submittals, while reducing the number of revisions that may take
place within the permitting process.
Referring to both letters received from your Department for Maiden dated
February 28, 2007 and the most recent request for additional information
for Salem Stone (no date provided), both letters requested, "Provide
proof you have obtained any necessary approvals from the Division of
Water Quality to (1) impact the wetlands (Maiden) and (2) regarding
mining trough the stream within the future pit limits (Salem Stone)". I
had expected to see typical conditions provided in each of these permits
that would "require proper approvals from the Division of Water Quality
shall be obtained prior to impacting or mining through these arras".
Thus my desire to discuss Land Qualities position and try to come to an
understanding that would ensure that 401 Certifications are obtained
prior to any disturbances while addressing the requirements within the
Mining Act and subsequent approval from your Department.
As stated in the meeting, I offered to summarize our conversation and
outline the requirements of fiiture mining modification submittals that
may propose impacts to wetlands or streams. They are as follows:
1. Adequate undisturbed buffers will be provided around all streams
and wetland limits that may be subject to future mining impacts and will
be clearly identified as such and noted that no impacts of these areas
will be conducted until approvals from the North Carolina Division of
Water Quality have been obtained. Copies of these approvals will be
sent to the Division of Land Resources, Land Quality Section for their
records.. 2. Assuming all erosion and sedimentation issues have been
addressed and have been reviewed and approved, Land Quality will allow
the disturbance of all proposed impacts to streams and wetlands that are
shown on the most recent revised mine map once the Division of Water
Quality approval is obtained. 3. A note shall be provided on the most recent revised mine map
that clearly indicates that "No impacts will be conducted in wetlands or
streams until such time that the Division of Water Quality issues their
approval" or similar language to this extent. 4. No additional submittal of revised aline maps will be
provided or
required by Land Quality after the Division of Water Quality issued
their approval. Again, only the approval from the Division of Water
Quality is required to be submitted to Land Quality. 5. Typical or specific Ianguage may be included
in Section 3 Buffer
Zones (or other areas as deemed necessary by the Department) of the
approved mining permit that describes or indicates the above language
related to proper approvals prior to any impact to streams or wetlands
and the requirement of those approvals to be submitted to Land Quality

upon receipt from the Division of Ware Quality.
Related to Salem Stone Quarry (Mining Permit # 34-09), once N \4A has
revised the rnifte map to reflect the revised design of sediment and
—y— erosion control measures outside of the clearly defined buffers along
all potential. streams within the proposed future pit limits that are
located south of the existing pit boundary, no additional fee will be
required within the future modification request to disturb this parcel
for future mining purposes. The Salem Stone mine neap currently under
review by your Department was last revised on March 19, 2007 and was
submitted for approval on march 20, 2007.
This information is provided for your review and approval. Please feel
free to modify or revise as you feel necessary and forward back to all
parties involved for peer review and agreement. If all of the
information is correct, based on your notes and our discussions, please

Construction Sequence
1. Obtain mining permit.
2. Contact NCDENR Winston-Salem Regional Office at [phone]
before new construction begins.
3. Install erosion control measures as specified. Clean only as
necessary to install these measures. Diversion ditches and
sediment basins along the edge of the initial clearing limits
are to be installed before the clearing of these areas begins.
Stabilize proposed ditches as specified in the ditch lining table.
4. When constructing sediment basins adjacent to existing Spurgeon Creek.
Install the velocity dissipater at outlet of the barrel before sediment
laden water routed through the basin.
5. Erosion control measures are shown adjacent to each proposed land
disturbing activity. Before any of the proposed construction begins,
all measures associated with the particular construction are to be
installed. (For example: before the existing berm just west of the
existing shop is removed, the relocated riser basin S.T. #7 and S.T. #9
shall be installed as well as the diversion ditches leading to each of
the measures.)
6. Specific sequence for installation of the 72" culvert or additional culverts:
A. If placement of fill adjacent to Spurgeon Creek begins before the
culvert installation is completed. The temporary ditches and
sediment traps adjacent to the creek must be inspected as shown
before any fill is placed.
B. Install rock check dam in Spurgeon Creek downstream of the proposed
pipe before pipe installation begins,
C. Beginning downstream, lay sections of pipe in the existing stream
bed. Minimizing disturbance when the entire culvert has been
installed and flow is directed into the pipe, begin placing fill
over the pipe. Install silt fence on the fill slope just above
both inverts as soon as physically possible. Remove rock check dam
downstream. The diversions and traps located adjacent tot he existing
creek are to be installed at the end of each work day. Any damages to
be repaired on the day it occurs.
D. Before fill is placed over the pipe, the sediment basins and corresponding
diversions are to be installed. As fill placement is performed in
future plant area, permanent slope drains and their corresponding -
diversions and velocity dissipators are to be installed.
Specific sequence for area adjacent to existing pond southeast of site
(Before placement of fill in berm).
A. Install velocity dissipator at downstream end of proposed 6"
drainage pipe. Install diversion ditch and sediment trap #26.
Extend 6" drainage pipe from existing standpipe outlet.
B. Construct diversion from outlet of proposed overflow pipe to
existing drainageway. Install riprap apron at confluence and
stabilize diversion with riprap as specified. Install velocity
dissipator at outlet of proposed 48" culvert and then install
48" culvert.
C. Construct velocity dissipator at downstream end of proposed 42"
pipe. Install pipe.
D. Construct remainder of traps and diversions surrounding the
proposed berg before berm construction begins.
7. All existing measures which receive sediment -laden flow are to be
maintained. Measures which may have been covered up shall be
uncovered or reinstalled if they receive sediment -laden flow.
8. Clean out all basins and traps when half full.
9. Maintain all measures as needed.
10. When site is approved, remove measures. Sediment basins and diversion
ditches adjacent to the plant area. Haul road, and the proposed berm
adjacent to the existing pond are to remain as well as all velocity
dissipators.

care will be taken to prevent sediment from entering Spurgeon Creek during
basin installation.
