In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit

PART IV - EVALUATION AND RECOMMENDATIONS
Buffalo Valley Mine requests an NPDES General Permit for the
discharge of stormwater collected at a fill dirt mining facility.
On -site investigation revealed that the mining facility does
not engage in any process operation. Stormwater collected at the
facility is to be diverted into an existing settling basin and
discharged into a segment of Buffalo Creek via a drain. It should
be pointed out that there is an existing maintenance shop without
on -site fuel pump facility. Mr. Robert E. Lee, Owner and Operator
of the mining facility advised that waste oil generated from the
maintenance shop is collected and stored in 55 gallon drums to be
used as heating fuel.
It is recommended that a General Permit be issued for the
facility as requested by the applicant.

Dear Gene:
Mining operations are required to file a Notice of Intent
requesting coverage under the Mining Activities General NPDES
Permit NCG020000. Enclosed is a copy of the Notice of intent and
a copy of the General Permit.
Based upon our discussions with the staff in Raleigh concerning
these General NPDES Permits, the Notice of Intent must be filed
as soon as possible and any additional mapping or testing shall
be deferred until a response has been received from the State.
This response will be after the State has reviewed the many
Letters of Intent. The State will then schedule a seminar to
explain the amount of data, mapping, and testing required and the
submittal format. This seminar could be six to nine months from
now.
Enclosed is a complete Notice of Intent and an addressed
envelope. Please sign on page 3 where requested and forward this
signed form with a $400.00 check to the NCDEM. Please make
copies of the signed from and return one copy to this office.

under this permit will constilute the permit requirements for the discharge(s) and is
enforceable in the same manner as an Individual permit.
I agree to abide by the following as a part of coverage under this General Permit:
1. 1 agree to abide by the approved Mining Permit for this mining activity. ( A copy of the valid mining
permit must be attached to this request.
2. 1 agree to not. discharge any sanitary wastewater from this mining activity except under the
provisions of another NPDES permit specifically Issued therefore.
3. 1 agree that bulk storage of petroleum products and other chemicals shall have adequate protection so
as to contain all.spilis on the site.
4, t agree that solid wastes will be disposed of in accordance with N.C. statutes and rules governing
solid waste disposal.
5. 1 agree that maintenance activities for vehicles and heavy equipment will be performed so as to not
result in contamination of the surface or ground waters.

as enforceable requirements of the General Permit.
