'All mines must monitor WW discharges for TSS. Only industrial sand mine discharges are subject to TSS limts.
2I f an effluent limit is exceeded, the permittee is required to institute monthly monitoring for that parameter for the remaining permit term.
3The discharge shall not cause an instantaneous measurement of the turbidity of the receiving water to exceed: 10 NTU for freshwater streams, lakes, and reservoirs
designated as trout waters; 25 NTU for all lakes and reservoirs, and all salt waters; 50 NTU for all other streams and surface waters. Turbidity may be monitored at the
Stormwater Discharge Outfall. Alternatively, the permittee may choose to monitor turbidity in the receiveing water, directly upstream and downstream of the discharge.
°Only facilities discharging to SA waters are required to monitor for Fecal coliforms.

Re: Monthly Wastewater Sampling at Martin Marietta's Reidsville Quarry
Dear Mr. Thomas:
As discussed during the stormwater inspection conducted at our quarry on 4/12/11, we would
like to request that DWQ alleviate the monthly monitoring requirement currently being
conducted at our site. The monthly monitoring was implemented because we exceeded the
monthly effluent limit of .1 ml/1 on our quarterly sample for Settleable Solids. We did not
exceed the daily maximum limit of .2 ml/l, but unfortunately have been required to continue this
monthly sampling. We have conducted this monthly sampling for 12 months, and have not
exceeded the monthly limit. As noted in the enclosed July 1, 2010 memo from Bradley Bennett,
we infer that the regional offices have the authority to relieve a permittee from monthly
sampling, should DWQ conclude the change is justified for either monthly stormwater or
wastewater sampling.
Enclosed, you will find our annual DMR summary and a copy of the DMR's submitted to your
office showing we indeed have not exceeded our daily maximum Settleable Solids limit since
implementing monthly monitoring. We now collect these samples early enough in the month
such that this daily exceedence is not an issue. As required by the general permit, we have
submitted the monthly results to your office, as well as, submitting the annual DMR's to the
Central Office. Also enclosed, please find our monthly sample results for April.

Subject: Guidance for Monthly Monitoring Triggers under General Permit NCG020000
This memo provides guidance on the provisions in the recently renewed NCG020000 General
Permit for Mining Activities that increase monitoring as a result of failure to monitor according to
permit terms. The guidance addresses how the Division of Water Quality (DWQ) will implement the
provision for mining operations that come under coverage of the permit in the muddle of a semi-
annual (for stormwater) or quarterly (for wastewater) monitoring period. This guidance also clarifies
how permittees may be relieved of monthly monitoring.
The new NCG020000 permit became effective on January 1, 2010. Changes from the previous
permit include a provision that triggers monthly monitoring for the remainder of the permit term in
the event the permittee fails to comply with the monitoring schedule in accordance with permit terms
(Footnote I in Tables 1, 4, and 7 of Part III). This trigger applies to circumstances other than
instances of no discharge during the monitoring period or adverse weather conditions that prevent a
sample from being collected during the period.
In the permit, DWQ did not clarify what happens if a permittee obtains coverage mid -cycle
and has less time to take a sample before the end of the scheduled period (for example, a Certificate of
Coverage (COC) effective in mid -May and a sampling period ends June 30`t'). That permittee is
unfairly put at a higher risk of being "kicked into" monthly monitoring for the entire permit term.
The Stormwater Permitting Unit (SPU) will address the shortfall at the time of COC issuance
in the following way: When staff determines that a COC effective date means the permittee may
not have enough time to reasonably collect a stormwater and/or wastewater sample, the SPU may
advise the permittee that the first compliance sampling period begins on the date of the upcoming
monitoring event period. That extension will be communicated in the cover letter.
What is also unclear in the permit is that the Regional Office (RO) may still relieve a permittee
from monthly sampling after an earlier failure to sample during a scheduled period, EITHER as part
of Tier 3—in the event that a permittee is also sampling monthly because of four benchmark
exceedances (stormwater)—OR independently, should DWQ conclude the change is justified
(stormwater or wastewater). The RO may alleviate the monthly monitoring requirement in either
case, if the RO and SPU determine it appropriate. The permit text inadvertently conflicts with
DWQ's intent on this point.
