Vulcan discharges both process water and stormwater under the permit through outfalls 001 (mine de -watering) and 003 (stormwater discharge). Part IV, Section D of the permit requires Vulcan to sample its mine de -watering on a quarterly basis and comply with the following limits; Parameter Effluent Limits Units MonthlX Average' Daily Maximuml Turbidit -------- NIA — See note 2 NTU TSS 10 15 mg/1 H ------- 6.0 — 9.0 Standard Units Settleable Solids 0. 1 0.2 Mg/1- Note that for a semi-annual or quarterly sampling schedule, the sample result counts as both the Daily Maximum and Monthly Average value. More frequent samples may be conducted to calculate averages but must all be reported to NC DEQ. 2 No effluent limit for turbidity applies, but turbidity in the receiving waters shall not exceed the appropriate water quality standards listed in the permit (See Permit language following Permit Table 8). Vulcan performed sampling of its mine de -watering outfall 001 on May 13, 2019. As detailed in Attachment 1 of this letter, the TSS level measured in the May l3`h sample was 12 mgll, which is less than the daily maximum limit, but greater than the monthly average limit. However, as detailed in footnote I above, and in footnote 1 of the Permit Table 8, "...for a semi-annual or quarterly sampling schedule, the sample result counts as both the Daily Maximum and Monthly Average value. More frequent samples may be conducted to calculate averages but must all be reported to NC DEQ." As detailed attached, the TSS concentration in the second sample resulted in a non -detect value, at a detection level of 5 mg/l. Conservatively using the second sample detection level as the measured value, the monthly average TSS value for Outfall 001 is 8.5 mgA, which is less than the monthly average effluent limitation detailed in Permit Table 8. Since the average of the two samples is less than the monthly average effluent limitation, Vulcan does not believe that it has exceeded its effluent limitations under the Permit. Further, Vulcan does not believe that the exceedance reporting requirement detailed at Part IV.D.4 of the Permit applies. However, we are providing the attached DMR as a conservative measure to reflect the sampling results from its 2"d Quarter 2019 sampling event(s).
