Stevens, Director 1 ILF!WAA • NC ENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES December 2, 1999 Wake County DWQ Project #: 991240 APPROVAL OF 401Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules Mr. Steve Smith 125 Raleigh Street Fuquay-Varina, North Carolina 27526 Dear Mr. Smith: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 75 feet of streams for the purpose of developing the Wyndsong Subdivision near SR 2731 in Wake County, as you described in your application dated 9 November 1999. After reviewing your application, we have decided that this till is covered by General Water Quality Certification Number 3104. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that stormwater shall be directed to sheetflow at nonerosive velocities through the protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. At that time Mr. (Smith indicated that the only feature evaluated was stream feature 3 located directly west of (5122'731. This feature is a Bb-cam and as such is subject to the current Ncuse Qiver basin 12iparian 12u1e.5. This project is now referenced by the Qaleigh 12e8ional Office as NbQQO 99-240. At your request, an evaluation was performed to determine if the three other features present (actually two streams) on this tract would require compliance with the Neuse [liver Basin: Nutrient (Sensitive Waters Managemcnt (Stratey; Protection and Maintenance of Existing 12iparian Arca6, Administrative Code 'C 15A:02b.0233 (NCAC 0233). It was determined that there are two features present that are at least intermittent streams but they are located off property. The other feature is pr5cnt on the propcrty but is ephemeral in nature and not subject to riparian protection. This letter addresses only those issues involving the riparian area. BLILEY SOIL AND LAND USE CONSULTANT 614 SOUTH SECOND STREET SMITHFIELD, NORTH CAROLINA 27577 (919) 934-8610 October 4, 1999 Mr. Steve Mitchell Environmental Specialist Division of Water Quality 3800 Barrett Drive Raleigh, North Carolina 27609 Dear Steve, Attached with this letter is a copy of a preliminary subdivision plat for Wyndsong Subdivision located near the intersection of SR 2731 (Jordan Road) and SR 2732 (Brack Penny Road) in southern Wake County. Also attached is a copy of the preliminary soils sketch map that was prepared from field investigations in April of this year. Shown on the sketch map are various streams that border or cut through the property. These streams are shown as streams 1, 2 & 3 on the attached soils sketch map. The stream at the rear of the original property (stream 1)is not to be included in the current subdivision. It borders the rear of a 10 acre parcel reserved by the original property owners. The stream that lies along the southern edge of the subdivision (stream # 2)will classify as a perennial stream. Riparian buffers will be required under the Neuse Guidelines. The actual stream does not appear to be within the subdivision but the riparian buffer may affect some of the lots. Stream # 3 is an intermittent stream that drains from the pond on the adjacent property. This stream has characteristics of intermittent streams as defined in the guidelines dated 4/30/98 and in my opinion will qualify for riparian buffers.
