PROJECT SUMMARY: The North Carolina Department of Cultural Resources has proposed to construct an office, classroom, and docking facility on property it owns at 310 Front Street in Beaufort. This project has received a variance from the Coastal Resources Commission previously, but has now modified its plan due to concerns regarding restrictions within the Beaufort Historic District, which is also listed in the National Register of Historic Places. FIELD INVESTIGATION REPORT: North Carolina Department of Cultural Resources PAGE #2 --------------------------- 9. NARRATIVE DESCRIPTION: The project site is located adjacent to Taylor's Creek within the Town of Beaufort, at 310 Front Street, in Carteret County. The site was previously the location of classroom and office facilities for the North Carolina Maritime Museum, which has since been demolished. Amenities for the museum were in the form of a large, two story observation deck and a 4 slip docking facility, both over the waters of Taylor's Creek. In 1996, the museum requested a permit to reconstruct this facility. Because of inconsistencies which arose from the elevator shaft and the mechanical room of the building being requested over public trust waters, the request was partially denied. The observation decks and docking areas were authorized to be replaced. Another non- conforming aspect of the proposal was the 80% coverage of the estuarine shoreline, ultimately deemed consistent with the non-conforming re-development rule found in T15A: 07J .0211. The applicant sought a variance from the North Carolina Coastal Resources Commission to allow for the enclosed area over public trust waters, and was ultimately granted a variance. An amended permit, #144-96, was issued in February of 1997 and is set to expire on December 31, 1999. The amended permit allowed for the construction of approximately 60 square feet of building and 3782 square feet of deck footprint over the water. The authorized facility had a total of 3584 square feet of enclosed heated space in the form of a 3 story building, with 3 stories of open decking. The permit also authorized the construction of a bulkhead 2' waterward of the high water line, filling approximately 142 square feet of shallow bottom area. The permit was issued contingent upon the applicant (at that time within the NC Department of Agriculture) coming into compliance with Section 106 of the National Historic Preservation Act, by incorporating recommendations of the NC Department of Cultural Resources. These recommendations included structural as well as aesthetic modifications to the approved facility. It is the effort to comply with Section 106 of the NHPA that has resulted in the re-design of this facility, which necessitates a major modification to the permit. The Maritime Museum has since been relocated to the NC Department of Cultural Resources, which is now the applicant. The project site is approximately .29 acres in size, and is located within the Beaufort Historic District, which is listed in the National Register of Historic Places. This area is classified within the Beaufort Land Use Plan as Developed, with all areas falling within CAMA Areas of Environmental Concern classified as Conservation. The property averages 9' above mean sea level, and utilizes municipal water and sewer services. The normal high water line is approximately 23' from the sidewalk bulkhead. The bottom composition in this area is sandy and underlain with bricks and debris. The waters of Taylor's Creek are classified SC by the Division of Water Quality, and are not designated as Primary Nursery Area. The new facility has been designed to be less imposing visually, and more amenable to the historic flavor. The building has a footprint of 60' x 46', and is two story in elevation. There is a ±13' x 26' handicapped accessible ramp on the east side of the building. The first floor of the building consists of a heated footprint of approximately 1702 square feet over the water, with 1904 square feet of open decking (56' x 34') and an associated 394 square feet of accessways connecting around the building. The second story consists of approximately 1439 square feet of enclosed area waterward of the high water line, within the footprint of the first floor. There is no decking associated with the second level. The total square footage of the heated building area, to FIELD INVESTIGATION REPORT: North Carolina Department of Cultural Resources PAGE #3 include first and second floors, is ±4222 square feet, with approximately 3141 square feet of this, or 74%, over the water. The observation decks and associated accessways represent another 2298 square feet over water. There is no intent to stabilize the shoreline with a bulkhead in this application. Lastly, the proposed piers incorporate ±576 square feet in the form of two 6' x 48' structures. There are no mooring pilings associated with the piers, which are intended to moor up to 4 museum vessels. The body of water within Taylor's Creek at the project location is approximately 600' across. The docking facility as proposed terminates approximately 61' short of the US Army Corps of Engineers pier head line, in -10' of water. The portion of this facility that is over the limited high ground has been reduced from 80% to 66%, or 1081 square feet within the 1639 square foot estuarine shoreline area. This was accomplished by increasing the side setbacks to provide better visibility to the waterfront, and moving the built-upon area over the water. 10. ANTICIPATED IMPACTS: The proposed structure is modified from that approved by CRC variance in the following ways: The coverage of the estuarine shoreline is reduced from 1438 square feet to 1081 square feet; the observation decks have been reduced from 3782 square feet to 2298 square feet; and the area enclosed over the public trust waters has been increased from 60 square feet to 3141 square feet. The bulkhead and associated bottom fill has been deleted. The docks were in existence when the previous structure was proposed, but are now newly proposed as 2 piers of 6' x 48' each. The building has been reduced in width in order to provide sideline visibility, as well as being reduced in height. The overall impact to the public trust system is the incorporation of approximately 4576 square feet of public waters, which also impairs the estuarine system through shading. A couple of mooring pilings are the only remaining items left from the original construction. A previous variance and ultimately a MAJOR CAMA PERMIT were issued for a previously proposed structure. The variance involved use of public trust waters for the reconstruction of the proposed educational facility, so that the facility could meet life safety issues for the ingress and egress from the structure. Issues developed with regard to the architecture of the structure and the owner has had a new design prepared by the architectural firm of Burnette Architecture & Planning, P.A. PUBLIC TRUST AREAS Prior to demolition, the facility contained an approximate footprint of heated space of 1503 sf and additional deck coverage of approximately 4000 sf. Since the mean high water was about 2' landward of the waterward edge of the original building, public trust waters were encumbered by approximately 3900 sf of building and decking not counting the two piers that existed. The mean high water line has moved landward approximately 2 feet since the previous permit. PROJECT SUMMARY: The North Carolina Department of Cultural Resources has proposed to construct an office, classroom, and docking facility on property it owns at 310 Front Street in Beaufort. This project has received a variance from the Coastal Resources Commission previously, but has now modified its plan due to concerns regarding restrictions within the Beaufort Historic District, which is also listed in the National Register of Historic Places. FIELD INVESTIGATION REPORT: North Carolina Department of Cultural Resources PAGE #2 9. NARRATIVE DESCRIPTION: The project site is located adjacent to Taylor's Creek within the Town of Beaufort, at 310 Front Street, in Carteret County. The site was previously the location of classroom and office facilities for the North Carolina Maritime Museum, which has since been demolished. Amenities for the museum were in the form of a large, two story observation deck and a 4 slip docking facility, both over the waters of Taylor's Creek. In 1996, the museum requested a permit to reconstruct this facility. Because of inconsistencies which arose from the elevator shaft and the mechanical room of the building being requested over public trust waters, the request was partially denied. The observation decks and docking areas were authorized to be replaced. Another non- conforming aspect of the proposal was the 80% coverage of the estuarine shoreline, ultimately deemed consistent with the non-conforming re-development rule found in T15A: 07J .0211. The applicant sought a variance from the North Carolina Coastal Resources Commission to allow for the enclosed area over public trust waters, and was ultimately granted a variance. An amended permit, #144-96, was issued in February of 1997 and is set to expire on December 31, 1999. The amended permit allowed for the construction of approximately 60 square feet of building and 3782 square feet of deck footprint over the water. The authorized facility had a total of 3584 square feet of enclosed heated space in the form of a 3 story building, with 3 stories of open decking. The permit also authorized the construction of a bulkhead 2' waterward of the high water line, filling approximately 142 square feet of shallow bottom area. The permit was issued contingent upon the applicant (at that time within the NC Department of Agriculture) coming into compliance with Section 106 of the National Historic Preservation Act, by incorporating recommendations of the NC Department of Cultural Resources. These recommendations included structural as well as aesthetic modifications to the approved facility. It is the effort to comply with Section 106 of the NHPA that has resulted in the re-design of this facility, which necessitates a major modification to the permit. The Maritime Museum has since been relocated to the NC Department of Cultural Resources, which is now the applicant. The project site is approximately .29 acres in size, and is located within the Beaufort Historic District, which is listed in the National Register of Historic Places. This area is classified within the Beaufort Land Use Plan as Developed, with all areas falling within CAMA Areas of Environmental Concern classified as Conservation. The property averages 9' above mean sea level, and utilizes municipal water and sewer services. The normal high water line is approximately 23' from the sidewalk bulkhead. The bottom composition in this area is sandy and underlain with bricks and debris. The waters of Taylor's Creek are classified SC by the Division of Water Quality, and are not designated as Primary Nursery Area. The new facility has been designed to be less imposing visually, and more amenable to the historic flavor. The building has a footprint of 60'x 46', and is two story in elevation. There is a ±13' x 26' handicapped accessible ramp on the east side of the building. The first floor of the building consists of a heated footprint of approximately 1702 square feet over the water, with 1904 square feet of open decking (56' x 34') and an associated 394 square feet of accessways connecting around the building. The second story consists of approximately 1439 square feet of enclosed area waterward of the high water line, within the footprint of the first floor. There is no decking associated with the second level. The total square footage of the heated building area, to FIELD INVESTIGATION REPORT: North Carolina Department of Cultural Resources PAGE #3 include first and second floors, is ±4222 square feet, with approximately 3141 square feet of this, or 74%, over the water. The observation decks and associated accessways represent another 2298 square feet over water. There is no intent to stabilize the shoreline with a bulkhead in this application. Lastly, the proposed piers incorporate ±576 square feet in the form of two 6' x 48' structures. There are no mooring pilings associated with the piers, which are intended to moor up to 4 museum vessels. The body of water within Taylor's Creek at the project location is approximately 600' across. The docking facility as proposed terminates approximately 61' short of the US Army Corps of Engineers pier head line, in -10' of water. The portion of this facility that is over the limited high ground has been reduced from 80% to 66%, or 1081 square feet within the 1639 square foot estuarine shoreline area. This was accomplished by increasing the side setbacks to provide better visibility to the waterfront, and moving the built-upon area over the water. 10. ANTICIPATED IMPACTS: The proposed structure is modified from that approved by CRC variance in the following ways: The coverage of the estuarine shoreline is reduced from 1438 square feet to 1081 square feet; the observation decks have been reduced from 3782 square feet to 2298 square feet; and the area enclosed over the public trust waters has been increased from 60 square feet to 3141 square feet. The bulkhead and associated bottom fill has been deleted. The docks were in existence when the previous structure was proposed, but are now newly proposed as 2 piers of 6' x 48' each. The building has been reduced in width in order to provide sideline visibility, as well as being reduced in height. The overall impact to the public trust system is the incorporation of approximately 4576 square feet of public waters, which also impairs the estuarine system through shading. A couple of mooring pilings are the only remaining items left from the original construction. A previous variance and ultimately a MAJOR CAMA PERMIT were issued for a previously proposed structure. The variance involved use of public trust waters for the reconstruction of the proposed educational facility, so that the facility could meet life safety issues for the ingress and egress from the structure. Issues developed with regard to the architecture of the structure and the owner has had a new design prepared by the architectural firm of Burnette Architecture & Planning, P.A. PUBLIC TRUST AREAS Prior to demolition, the facility contained an approximate footprint of heated space of 1503 sf and additional deck coverage of approximately 4000 sf. Since the mean high water was about 2' landward of the waterward edge of the original building, public trust waters were encumbered by approximately 3900 sf of building and decking not counting the two piers that existed. The mean high water line has moved landward approximately 2 feet since the previous permit.
