On behalf of MI Homes, we are requesting authorization from the USACE to use NWP 29 for
0.021 acres of permanent wetland impacts, 0.026 acres of temporary wetland impacts, 118 If of
permanent stream impacts and 11 If of temporary stream impacts for construction of the proposed
project. We are also requesting a 401 WQC for the above referenced impacts, as well as a Riparian
Buffer Authorization from NCDWR for 18,216 sf of permanent riparian buffer impacts (Zone 1:
11,824 sf; Zone 2: 6,392 sf) and 833 sf of temporary riparian buffer impacts (Zone 1: 587 sf; Zone
2: 246 sf).
The project is ±12.4 acres in size and is located at 3803 Holly Lane in Raleigh, Wake County
(Latitude: 35.833294°N;
Longitude:-78.683321°W). The project consists of the following seven
parcels:

The project is located in the Neuse River basin (HUC: 03020201) and onsite waters drain to
Crabtree Creek (Stream Index: 27-33-(10); WQC: C;NSW).
Proposed Project
The purpose of the proposed project is to construct a residential townhome subdivision to meet
the need for residential housing in Raleigh. The proposed project consists of construction of an
88-unit townhome subdivision and associated infrastructure (roads, utilities, stormwater
management, etc.).

The project will be constructed using traditional commercial construction equipment and
techniques.
Project History
Ross Sullivan with the USACE field verified the wetland delineation for the project on 7/31/19
(SAW-2019-01218). As of the submittal of this PCN, the PJD has not been issued. WR is not
requesting issuance of a JD in conjunction with issuance of the NWP 29. The Approved
Wetland/Buffer Delineation Exhibit depicting the field verified delineation has been provided as
an Appendix.
NCDWR issued a Riparian Buffer Determination Letter for the project on 6/3/19 (NBRRO#19-
156). A copy of the buffer determination letter has been provided as an Appendix.
Proposed Impacts
The proposed impacts consist of 0.021 acres of permanent wetland impacts, 0.026 acres of
temporary wetland impacts, 118 If of permanent stream impacts, 11 If of temporary stream
impacts, 18,216 sf of permanent riparian buffer impacts (Zone 1: 11,824 sf; Zone 2: 6,392 sf) and
833 sf of temporary riparian buffer impacts (Zone 1: 587 sf; Zone 2: 246 sf) for construction of
the proposed project.
The majority of the proposed wetland, stream and buffer impacts are necessary for improvements
to the existing Holly Lane in order to bring the existing road into compliance with current City of
Raleigh standards for a public road, as required as part of the City of Raleigh site plan approval.
The existing Holly Lane is a very small, gravel driveway, which is not sufficient to support large
construction equipment or vehicles. Holly Lane must be improved and widened, to provide access
to the wet pond SCM that will provide stormwater management treatment for the site. Holly Lane
will be a public road, maintained by the City of Raleigh, which will be eventually extended when
additional future development to west warrants the extension.
The proposed improvements and widening of Holly Lane will require the replacement of the
existing dual 36" RCP culvert with a 10'x12' box culvert and construction of retaining wall #6. The
10'x12' box culvert is necessary to meet the flow requirements based on the drainage study of the
drainage basin. The construction of the culvert and retaining wall will result in 67 If of permanent
stream impacts (Impacts 3 & 5), 0.002 acres of permanent wetland impacts (Impact 6), 6 If of
temporary stream impacts (Impact 4).
A rip -rap plunge pool will be constructed on the below the culvert to dissipate velocity to prevent
erosion of the stream channel and undercutting of the culvert. The installation of the rip -rap
plunge pool will result in 51 If of permanent stream impacts (Impact 2) and 0.019 acres of
permanent wetland impacts (Impact 7). An additional 0.006 acres of temporary wetland impacts
(Impact 8) and 5 If of temporary stream impacts (Impact 1) will be required for temporary access
during construction. The rip -rap will be installed by burying the rip -rap such that the top of the rip -

rap matches the preconstruction contours of the streams, allowing for the passage of aquatic life
and preventing a functional loss of this section of stream.
The improvements and widening to Holly Lane will result in a total of 14,688 sf of permanent
riparian buffer impacts (Impacts 10 & 12), and 833 sf of temporary riparian buffer impacts (Impact
11).
The sewer crossing necessary to connect the internal sewer to the existing City of Raleigh sewer
line will result in 3,528 sf of permanent riparian buffer impacts (Impact 9). Please note this will be
an aerial sewer crossing and will not result in impacts to the stream.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Proposed impacts to wetlands and streams have been minimized to only those necessary for
improvements and widening of Holly Lane. Impacts have been minimized by utilizing the existing
alignment of Holly Lane in the road design. Retaining walls have been incorporated into the design
to stabilize both road fill and site fill to further minimize impacts.
The sewer crossing to connect the internal sewer system to the existing City of Raleigh sewer line
has been designed as an aerial crossing to avoid impacts to the stream. Riparian buffer impacts
have been minimized to those necessary to construct the improvements to the road crossing and
a sewer crossing. There are no proposed impacts for lot fill.
Furthermore, the rip -rap plunge pool dissipator has been designed for the rip -rap will be installed
so that the top of the rip -rap matches the pre -construction elevation of the stream bed. This
design allows for the impacted segment of stream to continue functioning as a natural stream by
maintaining natural water depths and allowing for passage of aquatic life.
The proposed box culvert will be installed so that bottom of the culvert is at least 12-inches below
the stream bed to maintain aquatic life passage during periods of low flow. Additionally, the stream
channel is approximately 12-ft wide at the location of the proposed box culvert. Therefore, the
installation of the 10'x12' box culvert will not result in widening of the channel and the OHW
depth will be maintained.
The proposed buffer impacts are necessary to construct a perpendicular road crossing and
perpendicular sewer crossing, which are both classified as "Allowable" uses in the Neuse River
Riparian Buffer Rules Table of Uses.

M itigation
Stream Mitigation
The proposed permanent stream impacts consist of a total of 118 If (Functional Loss - 67 If; No
functional Loss - 51 If). Since the proposed permanent stream impacts are less than 150 If, the
applicant does not propose any stream mitigation.
Wetland Mitigation
The proposed permanent wetland impacts are less than 0.10 acres (0.021 acres) and therefore the
application does not proposed any wetland mitigation.
Buffer Mitigation
All proposed buffer impacts are classified as "Allowable" uses in the Neuse River Riparian Buffer
Rules Table of Uses, and therefore buffer mitigation is not required.
The current request is for 0.021 acres of permanent wetland impacts, 0.026 acres of temporary
wetland impacts, 118 If of permanent stream impacts and 11 If of temporary stream impacts,
18,216 sf of permanent riparian buffer impacts (Zone 1: 11,824 sf; Zone 2: 6,392 sf) and 833 sf

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if
there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any recent
occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see
attached NCNHP project review letter.
Site reviews did not identify any potential habitat for bald eagle, red -cockaded woodpecker or Michauxis sumac.
The project is located in the Neuse River Basin, and therefore is not located within the known range of the Cape Fear Shiner. Additionally, the project
is not located within the known range of the Tar River spinyrrussel.
The project site is Within the known range of the Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf wedgemussel and yellow lance. The
proposed project is located Within the lower reach the UT to Crabtree Creek. The onsite perennial stream was historically impounded prior to failure of
the pond dam in 2016. The onsite perennial stream is now located between two existing impoundments (ponds), which was historically a chain of four
impoundments. The presence of these impoundments would prevent the migration of these species to sustain viable populations. Therefore, the
perennial stream within the project area was not considered potential habitat for Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf
wedgemussel and yellow lance. Therefore, WR concludes that the proposed project will have "No Effect" on federally listed species.
