9. NARRATIVE DESCRIPTION:
PROJECT SETTING:

The applicant's property is located at lot # 6 on 186 Oakleaf Drive, adjacent to Bogue
Sound, in the Town of Pine Knoll Shores, in Carteret County. The property is approximately
35,000 sq. ft. in size and is unimproved except for an existing pier, "T"-shaped, a boatlift and
a personal watercraft lift.
Water depths at the end of the pier average approximately -1' to -2' deep at mean low
water (MLW). McNeil Inlet Channel is located approximately 30 to 40' waterward of the
applicant's dock. The substrate in and adjacent to the project area is sandy in nature. There
does not appear to be any SAVs in the project area and it is not known whether there are any
shellfish in the project area. The waters along this section of Bogue Sound are classified as SA
and are open to shellfishing. The property is located near known historic/archeological sites.
PROJECT DESCRIPTION:
The applicant is proposing to excavate a boat basin measuring approximately 45' long x
18' wide and -3' deep in order to connect to the existing McNeil Inlet Channel. The sandy
material would be removed by a clamshell bucket on a barge, transported to an off loading site
then placed in a truck and disposed of on high ground off the site.
ANTICIPATED IMPACTS:
Approximately 810 ft' of shallow estuarine habitat bottom would be affected by the
proposed project. During excavation, approximately 90 cubic yards of sandy material would
be removed from the system. Given the limited scope of the project and with no SAVs noted
in the project area, there should be negligible impacts to aquatic resources. Short-term
increases in turbidity would be expected during actual excavation. Since no new construction
is proposed, there should be no adverse impact to the boating public using the adjacent McNeil
Inlet Channel.

9. NARRATIVE DESCRIPTION:
PROJECT SETTING:
The applicant's property is located gat lot # 6 on 186 Oakleaf Drive, adjacent to Bogue
Sound, in the Town of Pine Knoll Shores, in Carteret County. The property is approximately
35,000 sq. ft. in size and is unimproved except for an existing pier, "T"-shaped, a boatlift and
a personal watercraft lift.
Water depths at the end of the pier average approximately -1' to -2' deep at mean low
water (MLW). McNeil Inlet Channel is located approximately 30 to 40' waterward of the
applicant's dock. The substrate in and adjacent to the project area is sandy in nature. There
does not appear to be any SAVs in the project area and it is not known whether there are any
shellfish in the project area. The waters along this section of Bogue Sound are classified as SA
and are open to shellfishing. The property is located near known historic/archeological sites.
PROJECT DESCRIPTION:
The applicant is proposing to excavate a boat basin measuring approximately 45' long x
18' wide and -3' deep in order to connect to the existing McNeil Inlet Channel. The sandy
material would be removed by a clamshell bucket on a barge, transported to an off loading site
then placed in a truck and disposed of on high ground off the site.
ANTICIPATED IMPACTS:
Approximately 810 ft2 of shallow estuarine habitat bottom would be affected by the
proposed project. During excavation, approximately 90 cubic yards of sandy material would
be removed from the system. Given the limited scope of the project and with no SAVs noted
in the project area, there should be negligible impacts to aquatic resources. Short-term
increases in turbidity would be expected during actual excavation. Since no new construction
is proposed, there should be no adverse impact to the boating public using the adjacent McNeil
Inlet Channel

Reference the application of Felix Miller for Department of the Army
authorization and a State Water Quality Certification to excavate a boat basin
adjacent to an existing dock in Bogue Sound, Pine Knoll Shores, Carteret
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
10 of the Rivers and Harbors Act but we have determined that a water quality
certification is required under the provisions of Section 401 of the Clean
Water Act. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by January 14, 2000, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE DESCRIPTION:
PROJECT SETTING:
The applicant's property is located 'at lot # 6 on 186 Oakleaf Drive, adjacent to Bogue
Sound, in the Town of Pine Knoll Shores, in Carteret County. The property is approximately
35,000 sq. ft. in size and is unimproved except for an existing pier, "T"-shaped, a boatlift and
a personal watercraft lift.
Water depths at the end of the pier average approximately -1' to -2' deep at mean low
water (MLW). McNeil Inlet Channel is located approximately 30 to 40' waterward of the
applicant's dock. The substrate in and adjacent to the project area is sandy in nature. There
does not appear to be any SAVs in the project area and it is not known whether there are any
shellfish in the project area. The waters along this section of Bogue Sound are classified as SA
and are open to shellfishing. The property is located near known historic/archeological sites.
PROJECT DESCRIPTION:
The applicant is proposing to excavate a boat basin measuring approximately 45' long x
18' wide and -3' deep in order to connect to the existing McNeil Inlet Channel. The sandy
material would be removed by a clamshell bucket on a barge, transported to an off loading site
then placed in a truck and disposed of on high ground off the site.
ANTICIPATED IMPACTS:
Approximately 810 ftz of shallow estuarine habitat bottom would be affected by the
proposed project. During excavation, approximately 90 cubic yards of sandy material would
be removed from the system. Given the limited scope of the project and with no SAVs noted
in the project area, there should be negligible impacts to aquatic resources. Short-term
increases in turbidity would be expected during actual excavation. Since no new construction
is proposed, there should be no adverse impact to the boating public using the adjacent McNeil
Inlet Channel.

wetlands or waters for the purpose of conducting maintenance excavation of a boat basin at 186 Oakleaf Drive, as you
described in your application dated November 8, 1999. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must

We contacted the phone numbers provided in the application for the consultant, Richard Douglas (252)
726-2191 - the number was a hotel whose voice mail indicated they were closed for the season and the
applicant (800) 438-4324 - the receptionist said there were 3 members of the company named Felix Miller
(Sr., Jr., and III) she did not know which of them was connected to the project. Since she did not expect
any of the Mr. Millers to return prior to Wednesday, she took a message for them to call our office and let
us know where the Certificate should be mailed.
