On behalf of the Town of Cary, we are requesting 404 authorization and 401 Certification for
wetland and stream impacts associated with the installation of a greenway connector trail.
The proposed impacts consist of 0.0014 acres of wetland impacts and 39 if of stream
impacts.
The project area is located south of the terminus of Mills Park Drive, at Latitude
35.8o89610N, and Longitude 78.899194°W, in Wake County, North Carolina. The Greystone
Greenway Trail Connector corridor is located in the Cape River Basin and surface waters on-
site flow into Panther Creek. The Water Quality Classification for Panther Creek is "WS-
IV;NSW", the Stream Index Number is: 16-41-1-17-3, and the Cataloging Unit for the site is
03030004.
Project Description
The proposed project consists of the construction of a greenway trail connector from an
existing greenway trail from Golden Harvest Drive to Mills Park Drive. This greenway trail
connector will provide pedestrian access from the Greystone Subdivision to Mills Park
Elementary School and Mills Park Middle School. The construction of the greenway trail
connector will also provide additional greenway trail for recreational use by the public.
Project History
Wetlands within the proposed greenway corridor were delineated by S&EC during the
wetland delineation completed for the Greystone Subdivision project. The wetland
delineation was field reviewed by the Corps, and S&EC submitted the wetland surveys to the
Corps of Engineers for verification and signature. The wetland delineation was approved
through the issuance of the Nationwide Permit 12 and 39 for the Greystone Subdivision
project (AID# SAW-2005-20207-292). The approved wetland delineation identified on the
surveys submitted by S&EC encompasses the location of the proposed greenway trail
connector.
Avoidance and Minimization
Prior to the determination of the greenway trail connector, the applicant utilized the existing
wetland delineation for the property so that impacts to wetlands and `waters' could be

minimized. In order to minimize wetland and stream impacts, 6' wide, elevated timber
boardwalk will be constructed to create the connection from the main greenway to the
existing greenway from Golden Harvest Lane. The utilization of an elevated timber bridge
will completely avoid wetland impacts at this greenway trail crossing. The main portion of
the greenway trail connector has been designed as a 1o' wide trail to allow for
bicycle/pedestrian traffic, as well as emergency vehicle access in the event of an emergency.
The wetland crossing of the main portion of the greenway trail connector was designed to
cross the wetlands/stream at the narrowest point to minimize wetland and stream impacts.
The main greenway trail wetland crossing has also been designed to utilize retaining walls to
stabilize fill to further minimize wetland impacts. By designing the greenway trail connector
at the proposed crossing, wetland and stream impacts have been avoided and minimized.
The main greenway trail connector will result in 0.002 acres of wetland impacts and 40 if of
stream impacts.
Mitigation
Because the impacts are less than o.1 acres, we do not believe that mitigation should be
required.

This project includes the installation of approximately 550' of greenway which will provide a connection between an

The Corps of Engineers issued Nationwide Permits 12 and 39 for the Greystone Subdivision project (AID# SAW-2005-
20207-292), which included wetland surveys submitted by S&EC for the project site. The issuance of the NWPs verifed
the wetland surveys submitted to the Corps by S&ED. The wetland delineation associated with the Greystone
Subdivision project included the delineation of the wetlands within the vicinity of the proposed greenway connector
corridor. Therefore, a jurisdictional determination of the project area has been completed.

minimize wetland and stream impacts. To further minimize impacts, this crossing has been designed to utilize retaining
walls to stabilize fill, rather that using traditional backslopes which would have increased wetland impacts.

To avoid and minimize wetland and stream impacts, an elevated timber bridge will be constructed from the existing greenway

main reenwa trail wetland crossing. During construction, silt fencing will be installed to contain sediment within the project
