Dear Mr. Pearson:
Division of Water Resources' Central and Regional staff has reviewed the application package
received October 22, 2019. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on January
20, 2020.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through C, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Siunature Authority (15A NCAC 02T .0106):
The application and the subsequent Land Owner Agreement forms (LOA 06-16) were signed by
Mr. Robert W. Pearson on behalf of the City of Lincolnton. According to 15A NCAC 02T
.0106(a)(4), the application must be signed by either an executive officer, elected official in the
highest level of elected office, or other authorized employee in the case of a municipal, state, or
other public entity. Please execute the attached signature authority delegation letter in accordance
with 15A NCAC 02T .0106(d) to authorize Mr. Pearson to sign this permit application on behalf
of the City of Lincolnton.
2. The field NC-CA-24-09 is located on land owned by an entity called Group Four Investments. The
Landowner's Certification on the LOA form for this field was signed by Mike Davis, but it is
unclear whether or not Mike Davis is authorized to make decisions regarding the use of the land on
behalf of Group Four Investments. Please submit documentation which indicates that Mr. Davis is
authorized to sign on behalf of Group Four Investments.
B. Soil Evaluation:
The application proposes 18 new land application fields, but only 14 soil boring logs were
submitted. According to the Soil Scientist Evaluation Policy part 4.c.i.1, a minimum of one soil
profile description shall be required for each field. The following fields did not have an associated
soil profile description:
a. NC-LT-47-01
b. NC-LT-47-03
c. NC-LT-49-02
d. NC-CA-48-11
In order to be able to propose these fields, the Permittee shall submit a minimum of one soil profile
description in accordance with section 4 of the Soil Scientist Evaluation Policy. Otherwise, these
fields shall be removed from the application.
C. Site Man:
There appears to be a habitable residence near the southwest corner of field NC-CA-24-09 located
on parcel 266703208954 with the address of 9557 W NC 10 Highway that was not buffered on the
site map. According to the Catawba County GIS site, there is a three -bedroom habitable residence
structure located on this parcel that is within 400 feet of the proposed application site. Please
identify this structure on an updated site map and apply the appropriate setback to the structure. If
sections of the current proposed land application site are removed due to this setback, then a new
application area shall be included with this site map.
2. The regional reviewer noted in their staff report that there are areas in the southwestern section of
field NC-LT-48-05 that need to be buffered out due to the presence of a wetland. The updated site
maps received November 25, 2019 do not address this issue. Please identify this wetland feature
on an updated site map and apply the appropriate setback to the feature. If sections of the current
proposed land application site are removed due to this setback, then a new application area shall be
included with this site map.
