APPROVAL of 401 Water Quality Certification

Dear Mr. Nelson:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material
in 0.47 acre of wetlands for the purpose of residential construction as you described in your application received by
the Division of Water Quality on October 11, 1999 and revised drawings received by the Division of Water Quality
on November 29, 1999. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge
and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Enclosed please find 2 copies of the revised drawing for subject project.
We have revised the impacted area in the development located on the east side of the
property, as you requested on October 25th. The revision decreases the impacted
acreage from .07 acres to .05 acres. However, we have also added an impacted area
in the development located on the north side of the property near the second road
crossing. This area was overlooked on our drawing sent to you on October 7th and was
brought to our attention by Ken Averitte of NCDENR. This development area will add
.03 acres to the impacted area. The total impacted area in the development now totals
.08 acres and the total road area remains the same at .39 acres. This revises the total
impacted area to .47 acres as shown on the drawing. Please review this revision and
send your approval as soon as possible. We will not require you to sign off on the
drawings for this project. Thank you for your time and if you have any questions or

On 11 October 1999 the Division of Water Quality (DWQ) was notified by receipt of
your application for the Cape Fear Estates - Mobile Home Park on SR 2000 regarding your plan
to fill wetland for the purpose of developing the mobile home Park in Cumberland County.
Approval from DWQ is required to disturb these wetlands. From conversations that Mr. Ken
Averitte of our Fayetteville Regional office had with Mr. Seffels on October 28, 1999, we
understand that a revised site plan will soon be sent. Until that plan is received, this application
will be placed on hold as incomplete.

This list was adapted from the North Carolina Natural Heritage Program's County Species List. It is a listing
of North Carolina's federally listed and proposed endangered, threatened, and candidate species and Federal
species of concern (for a complete list of rare species in the state, please contact the North Carolina Natural
heritage Program). The information in this list is compiled from a variety of sources, including field
sut"veys, museums and herbariums, literature, and personal communications. The North Carolina Natural

Enclosed please find 2 copies of the revised drawing for subject project.
We have revised the impacted area in the development located on the east side of the
property, as you requested on October 25th. The revision decreases the impacted
acreage from .07 acres to .05 acres. However, we have also added an impacted area
in the development located on the north side of the property near the second road
crossing. This area was overlooked on our drawing sent to you on October 7th and was
brought to our attention by Ken Averitte of NCDENR. This development area will add
.03 acres to the impacted area. The total impacted area in the development now totals
.08 acres and the total road area remains the same at .39 acres. This revises the total
impacted area to .47 acres as shown on the drawing. Please review this revision and
send your approval as soon as possible. We will not require you to sign off on the
