You have our approval, in accordance with the attached conditions, to place fill material in 1,795 square feet of
wetlands or waters for the purpose of stabilizing a shoreline with a bulkhead as you described in your application dated 6
October, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112 In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Please reference the application of Frank Stone for Department of the Army (DA)
authorization and a State Water Quality Certification to construct a wooden bulkhead and
discharge backfill material, on property located off State Road 1217, adjacent to Blounts Bay,
on Colington Island, in Dare County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by December 13, 1999, the District Engineer will
deem that waiver has occurred.

Bio Report
PROJECT SETTING
The applicant's property is on Colington Island between SR 1217 (Colington Road) and Blounts Bay,
in Dare County. The entrance to the site is on the northwest side of Colington Road in the middle of a
horseshoe curve, across the street from Colington United Methodist Church. The entrance drive
passes a home and a large cargo container on the right along the water before, crossing a culvert that
connects a horseshoe shaped canal to Blounts Bay. The property consists of 1.91 acres and has an
elevation of approximately 2' to 3' above normal water level.
Existing structures on the property include six 16'x16' elevated dwelling units located along the canal.
The units are adjacent to the shoreline of a man-made canal and are in poor condition. A dilapidated
spilt level dwelling is on the north end of the property adjacent to Blounts Bay. Approximately
509.77' of shoreline along Blounts Bay, and an adjacent canal, is bulkheaded. The interior canal has a
natural shoreline with no evidence of erosion or accretion, and there are no man-made structures in the
canal. According to the applicant's agent the canal was excavated from wetlands. The entrance was
located on the northwest end of the property, which has fill in over the years. Average depth of the
canal is two feet below normal water level.
The canal circles around the back of the south of the six small dwelling units and connects to Blounts
Bay by an 11' culvert under the access road. Approximately 434 square feet of Coastal wetlands are
along the interior edge of the canal and include cattail (Typha sp.) and black needle rush (Juncus
roemarianus). Upland vegetation includes yard grasses, live oak (Quercus virginiana), loblolly pine
(Pinus taeda) and magnolia (Magnolia virginiana).
Blounts Bay and it tributaries are classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental Management's water
quality classification for the Bay is SC (fish propagation), and is not open to the taking of shellfish.
Additional review indicates that there are no known archeological sites or geological formations
associated with the applicant's property.
PROJECT DESCRIPTION
The applicant's proposed to construct a 485' long bulkhead along an exiting canal that circles round
the southern end of the property. The applicant would like to construct the bulkhead an average of
five feet (maximum 8') waterward of normal water level. Average water depth at the waterward edge
of the bulkhead is one foot below normal water level. No coastal or freshwater wetlands will be filled
in conjunction with the project. Backfill for the bulkhead will be from an upland source. According
to the application 180 cubic yards of material will be placed below normal water level. The bulkhead
will tie into an existing bulkhead on the west side of a dilapidated spilt level dwelling, and terminate at
the culvert on the east side of the property. No submerged aquatic vegetation is within the project
area.

Bio Report
Based on a site visit and review of the plan submitted approximately 28' of the proposed bulkhead will
be placed on high ground, 98' will be landward of coastal wetlands and 359' will be placed waterward
of normal water level (NWL). Based on an average depth of one foot and an average alignment of five
waterward of NWL, staff estimates that approximately 33.27 cubic yards of fill will be placed in
shallow water habitat.
ANTICIPATED IlVIPACTS
• The loss of approximately 1,795 square feet of shallow water habitat and public trust
water will occur from filling.
• The applicant's will gain 1,795 square feet of high ground.
• Approximately 3,693 square feet of high ground disturbance will be associated with this
permit.
• Temporary localized turbidity during construction of the bulkhead.
• No submerged aquatic vegetation, coastal wetlands or freshwater wetlands will be
impacted by this project.

PROJECT NARRATIVE
STONE - Colington Harbour
Our clients J. Frank Stone, James F. Stone, Jr. and Michael Keith Stone are proposing to
construct a wooden bulkhead around the southern perimeter (see plat) of their commercial
property which supports six commercial cottage units, dilapidated split level dwelling, framed
shed, concrete rip rap, concrete septic tank and water pump/storage shed. The proposed project
will be constructed using a backhoe and hydraulic pump. The project will entail constructing a
wooden bulkhead along the shoreline and pushing suitable sand behind the bulkhead. This
project has been designed to minimize environmental impacts.

Bio Report
Based on a site visit and review of the plan submitted approximately 28' of the proposed bulkhead will
be placed on high ground, 98' will be landward of coastal wetlands and 359' will be placed waterward
of normal water level (NWL). Based on an average depth of one foot and an average alignment of five
waterward of NWL, staff estimates that approximately 33.27 cubic yards of fill will be placed in
shallow water habitat.
ANTICIPATED IMPACTS
• The loss of approximately 1,795 square feet of shallow water habitat and public trust
water will occur from filling.
• The applicant's will gain 1,795 square feet of high ground.
• Approximately 3,693 square feet of high ground disturbance will be associated with this
permit.
• Temporary localized turbidity during construction of the bulkhead.
• No submerged aquatic vegetation, coastal wetlands or freshwater wetlands will be
impacted by this project.
