I, Mitch Hayes, performed the subject inspection on May 09, 2011. Your assistance with the
inspections was greatly appreciated. Please find attached with this letter the Basin Wide Information
Management System (BIMS) checklist. Below is a list of findings and recommendations developed from
the inspection.
1. The permit was reissued November 01, 2007 and expires October 30, 2012,
2. The facility consists of 6 — 30,000 gallon Ethanol Above Ground Storage Tanks (AST's) with an
earthen secondary containment area; a covered ethanol loading station with catch basin; 2 -
2,000 gallons oil water separators with a 2,000 gallon underground holding tank that drain the
ethanol loading and unloading station; a wash pit with sump that drains to an oil water separator
that discharges to a sanitary sewer collection line; a truck fueling station with a 10,000 gallons
underground diesel tank with an in ground secondary containment area; and a building housing a
truck maintenance shop.
3. The truck yard and the truck loading area and ethanol loading and unloading point consist of a
level grade gravel lot, The secondary containment area surrounding the ethanol AST's has a
discharge drain however, you stated that this drain has a locked hand operated T-valve and that
it has never been opened. All truck maintenance takes place inside an enclosed building. Used
oil is stored in barrels until there is sufficient quantity to recycle. The oil water separators that
receive flow from the ethanol loading and unloading point discharge into ,an underground holding
tank. The oil water separator that receives flow from the wash pit flows into a sanitary sewer
collection line.
4. From observation, any rainfall that collects on the property would be absorbed into the gravel lot.
There is no stormwater sheet flow. There is no discharge from any of the oil water separators.
There are no discernable discharge outfalls. Accordingly, you may choose to request rescission
of your permit. In order to request rescission of NPDES permit NCG080401, please address your
letter to Ken Pickle, Stormwater Permittinig Unit, Attention: Ken Pickle, 1617 Mail Service Center,
Raleigh, NC 27699-1617. Please understand if your facility is altered such that stormwater
discharges occur, coverage by a permit is required. The failure to have valid coverage under an

Inspection summary;

permit modification. This modification documents the change in name at the subject facility. All other terms and
conditions in the original permit remain unchanged and in full effect. This permit modification is issued under
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be a written petition conforming to Chapter 150E of the North
Carolina General Statutes, filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
North Carolina 27699-6714. Unless such demand is made, this decision shall be final and binding.
This permit does not affect the legal requirement to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, Coastal Area Management Act, or any other Federal

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or Permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Dear Permittee:
This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-2I5.6 and 33 USC 1251 et. seq-
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Dear Permittee:
Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under .
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

Hearings, Post Office Drawer 27447, Raleigh, North Carolina, 27611-7447. Unless such request for hearing is made or
