Dear Mr. Williams:
You have our approval, in accordance with the attached conditions and those listed below, to dredge 300 square feet of waters for
the purpose of constructing a boat basin, ramp and dock at your lot on SR 1155 and Moore's Creek, as you described in your application
dated September 20, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you
change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided
in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. A "plug" shall be left in place between the boat basin and open water and only removed when turbidity levels in the basin are
visually low enough so as not to cause a turbidity plume in Moore's Creek.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions.

8. PROJECT SU MVIARY: Mr. Williams is requesting a permit to dig a boat basin out of high
ground, 135' long by 30' wide, install a boat ramp and small dock for his private use.

9. PROJECT DESCRIPTION
Mr. Williams' property is a 1.25 acre lot located on State Route 1115, Borough Road, in Pender County.
The property borders Moore's Creek south of Moore's Creek National Battlefield near Currie, North
Carolina. Lot number 17 is a wooded, undeveloped lot measuring 100' wide by 580' long with 100'
bordering the creek on the back and Borough Road on the front.
Mr. Williams eventually plans to build a house on the lot. There is an existing septic system already in
place.
This application is requesting authorization to excavate a boat basin out of high ground. The basin would
extend from the - 10' water depth in Moore's Creek back into the property approximately 135' and
would be 30' wide, 6'-10' deep. Approximately 10' of shallow bottom along of the shoreline of Moore's
Creek would be disturbed to make the connection for the boat basin. Also being requested is a 30' x 30'
concrete boat ramp and 6' x 30' dock which would be constructed within the boat basin. Two boat slips
are being requested in conjunction with the proposed dock. The excavation work would be accomplished
by a trackhoe. Spoil material from the excavation is to go on high ground on either side of the proposed
basin. This layout is shown on sheet 3 of 5 of the project drawings. The sides of the boat basin will be
sloped and stabilized by a combination of rip-rap rock and seed/mulch. The proposed basin, ramp and
dock are intended for the private use of Mr. Williams.
The U. S. Army Corps of Engineers evaluated Mr. Williams property for the presence of federal wetlands
and found that no wetlands are located on this tract. No coastal wetlands are present in this area either.
The waters of Moore's Creek have been classified as C Sw by the Division of Water Quality. Moore's
Creek is not a Primary Nursery Area and is not open to shell fishing. However, the creek is used by
anadramous fish populations.
10. ANTICIPATED IMPACTS
Temporary turbidity within Moore's Creek will likely result from the excavation. The shoreline and
surrounding shallow bottom will be altered as result of the project. The impacts of this excavation could
be minimized by the use of turbidity curtains and leaving a "plug" between the high ground excavation
and the creek until the boat basin area is stabilized.
Approximately 13,050 square feet of high ground will either be excavated or filled in conjunction with
this project. About 2100 cubic yards of soil will be excavated to create the boat basin.

On August 23, 1999, the Wilmington Regional Office received a copy of the CAMA Major Permit
Application for James D. Williams. The North Carolina Administrative Code requires any project that
must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to
apply for and receive a Stormwater Management Permit by the Division of Water Quality. Any
construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A
NCAC 2H. 1000 and may result in appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application
form, fee, and supporting documentation, or a written response regarding the status of this project and the
expected submittal date must be received in this Office no later than October 3, 1999. Failure to respond
to this request may result in the initiation of enforcement action, and construction may experience a
subsequent delay. Please reference the Project Number above on all correspondence. If you have any

only high quality copies will be accepted. Blue-Iine
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

The intention of the applicant is to enhance the property for a building site of a private
home. The reason for the buin is to keep one or two small boats out of the main steam of
Moore's Creek, There is no plan of commercial use of the property, now or in the future,
Since this is a flood prone area, the basin would allow loading or unloading of a boat
regardless of water level conditions. The lot is 600 feet deep and the 200 fleet closet to
Moore's Creek is useless during water level changes without this basin.
