This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq. ;
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. A valid reason for
requesting rescission is required, incomplete forms will be returned and you will still be subject to possible
escalated action. Mailing instructions for submitting rescission request are listed on the bottom of the form. You
will be notified when the rescission process has been completed.

On September 8, 2009, Cheng Zhang of the Raleigh Regional Office (RRO) conducted a
Stormwater Compliance Evaluation Inspection at JM Eagle Manufacturing Co. Inc. Your
assistance was greatly appreciated. The inspection report is attached. Findings during the
inspection were as follows:
1. Certificate of Coverage (COC) No. NCG050137 of NPDES general permit
NCGO50000 was issued to JM Eagle Manufacturing Co. Inc. to discharge stormwater
runoff to Ledge Creek, a Class -II NSW stream, in the Neuse River Basin.
2. The facility has developed a Stormwater Pollution Prevention Plan (SPPP). A review
of the plan indicated that several required components were lacking:
Narrative description of practices
• Stormwater Best Management Practice (BMP) summary
• Preventive maintenance and good house keeping plan
Please update the SPPP plan by adding the above missing components. Stormwater
pollution prevention employee training was not conducted and documented annually.
Please include the SPPP training as part of the annual employee safety training and
keep record for each training event. The annual review/update of the SPPP should be
documented.
3. Qualitative monitoring was conducted at the two stormwater discharge outfalIs semi-
annually. You are recommended to use the DWQ qualitative monitoring form
presented to you during the inspection in future monitoring.

On Friday, July 2, 2004, in response to a citizen complaint, Mr. Shannon Langley of the North
Carolina Division of Water Quality's (DWQ) Raleigh Regional Office investigated a complaint
of dumping used oil at the subject facility. The assistance of plant staff including Victor Russell,
Mehrdad Esfandiary and Ed Brick was appreciated. Upon inspection, it was observed the facility
utilizes a water recycle system and mineral oil in its pipe extrusion process. The facility
maintains several oil/water separators throughout the manufacturing facility. Waste mineral oil
is typically collected in drums and disposed of off -site.
On July 2, 2004, the facility cleaned out the bottoms of its oil/water separators and discharged
the sludge and water mixture on the backside of its property (corner nearest the Interstate 85).
This sludge/water mixture ran down a concrete area into the woods and onto the ground behind
the facility in an open area. It was stated by company staff that this cleaning of the oil/water
separators occurs annually. It was further stated a similar method of disposal for the sludge has
been used in the past cleaning events.
This activity is a violation of NCGS 142-215.1(a)(2) which states a permit is required to
"Construct or operate any sewer system, treatment works, or disposal system within the State."
Further, since mineral oil is derived from petroleum, this activity violates NCGS 143-215.83,
143-215.84 and 143-215.85 which makes it unlawful to discharge or cause to be discharge oil or
other hazardous substances into or upon any waters, tidal flats, beaches, or lands within this
State. Our office is referring the matter to our agency's staff with expertise in these areas who
may follow up with you further.

6. What waste from the facility is tributary to the Sanitary sewer system?
7. Describe how the area has been cleaned up since July 2, 2004.
Any documentation you have to support your answers to the above questions would be
appreciated and should be submitted.
It appears from our understanding of the way your manufacturing process works that a
wastewater recycle permit may be required for continued operation. Attached is an application

INSTRUCTIONS FOR FORM: RFA 01-02
(WASTEWATER RECYCLE FACILITIES)
The Division of Water Quality will not accept this application unless all the instructions are
followed. Plans and specifications must be prepared in accordance with 15A NCAC 2H .0200 and
good engineering practices. Failure to submit all of the required items will lead to additional
processing and review time for the permit application.

A. Application Form (All Application Packages):
✓ Submit one original and four copies of the completed and appropriately executed application form.
The instructions (Pages 1 and 2 of 5) do not need to be submitted. Any changes made to this form
will result in the application being returned. The Division of Water Quality (Division) will only
accept application packages that have been fully completed with all applicable items addressed.
✓ The application must be signed by an appropriate person in accordance with 15A NCAC 2H .0206.
✓ The project name should be consistent with the project name on the plans, specifications,
agreements, etc.
✓ If this project involves a modification or renewal of an existing wastewater recycle facility, submit
one copy of the existing permit.
✓ If this project is for a renewal without modification the application should only complete sections I
& II; and sign the applicants signature on Page 5.
B. Attachment (All Application Packages):
✓ Submit the completed and properly executed Form WSCA (most recent version) for each
watershed within the project location.
C. Application Fee (All New or Modification Application Packages):
✓ Please see our website for the appropriate application fee.
✓ Submit a check in the appropriate amount made payable to: North Carolina Department of
Environment and Natural Resources (NCDENR). The appropriate amount can be determined from
a Fee Schedule Attachment or from the above cited website.
D. Cover Letter (All Application Packages):
✓ Submit one original and four copies of a cover letter, which lists all items and attachments included
in the application package as well as a brief project description.
✓ If necessary for clarity, include attachments to the application. Such attachments will be
considered part of the application package and should be numbered to correspond to the section to
which they refer.
E. Wastewater Analysis for Industrial Wastewater (All New Application Packages):
✓ Submit five copies of an analysis of the influent wastewater. The chemical analysis must include,
but shall not be limited to: Total Organic Carbon, BOD5i COD, Nitrates, Chlorides, Phosphorous,
Phenol, Total Volatile Organic Compounds, Total Coliforms and Total Dissolved Solids.
✓ All testing shall be performed by an appropriate Division certified laboratory.
✓ Where an actual wastewater sample cannot be obtained, wastewater generated from similar
wastewater recycle facilities or unit processes in a different location may be sampled. When no
actual wastewater analysis data can be obtained, this data shall be estimated and references
provided to justify the approximations.
F. Detailed Plans and Specifications (All Application Packages):
✓ Submit five sets of detailed plans and specifications signed, sealed, and dated by a NC licensed
Professional Engineer.

✓ Plans must include the following minimum items: a general location map, plan and profile views
of the wastewater recycle facilities as well as the proximity of the facilities to other utilities and
natural features, and detail drawings of all items pertinent to the facilities. The map shall clearly
indicate all buffers as required in 15A NCAC 2H .02190)(5).
✓ Specifications must include, at a minimum, the following for all items pertinent to the overall
wastewater recycle facilities: specifications for each unit process and quality of construction
testing procedures to ensure the integrity of the final product is in accordance with 15A NCAC 2H
.0205 (d)(1)(B), including leakage and pressure testing.
✓ Plans and specifications must depict a completed design and not be labeled with preliminary
phrases (e.g., FOR REVIEW ONLY, NOT FOR CONSTRUCTION, etc.) that indicate that they
are anything other than final plans and specifications. However, the plans and specifications may
be labeled with the phrase: FINAL DESIGN - NOT RELEASED FOR CONSTRUCTION.
G. Engineering Calculations (All Application Packages):
✓ Provide a water balance calculation that clearly demonstrates that the facilities are to be complete
wastewater recycle facilities (i.e., hydrologic inputs minus hydrologic losses show that more
wastewater is utilized than produced). The basis for all values and assumptions should be well
documented in this calculation.
✓ If the recycle facility is completely enclosed (under roof or all closed tanks) AND it involves the
use of a package wastewater treatment system specifically designed for this type of facility, five
copies of the manufacturer's information may be submitted in lieu of the engineering calculations
requested below.
✓ Submit five copies of all design calculations that have been signed, sealed, and dated by a NC
licensed Professional Engineer.
✓ Calculations must include the following minimum items: flow calculations; equipmentiunit process
sizing calculations; treatment efficiency calculations; hydraulic calculations through the
wastewater recycle facilities; friction/total dynamic head calculations and system curve analysis for
all pump stations; pump selection information including pump curves, manufacturer's information,
and recommended installation guidelines; pump station cycle times and pump run times; and
flotation calculations for all equipment/unit processes.
H. Treatment and/or Storage Units (All Application Packages with Open Unit Processes Such as
Impoundments, Ponds, Lagoons, Etc.):
✓ Ensure that the submitted technical specifications address the proper installation and liner as
required in 15A NCAC 2H .0219(c), (d) and (f).
✓ Submit documentation detailing that adequate freeboard is provided to ensure containment of the
25-year, 24-hour storm event and continue to ensure structural integrity of the unit. Consideration
should be given to drainage area, slope, soils, impervious areas, etc.
I. Residuals Management Plan (All Application Packages):
✓ Submit a detailed explanation as to how the residuals that are generated (including sediments and
grit) will be stored, treated and disposed of in accordance with 15A NCAC 211.0205(d)(1)(H).
✓ If oil or grease removal and collection is a designed unit process, please submit an oil/grease
disposal plan.

renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. A valid reason for
requesting rescission is required, incomplete forms will be returned and you will still be subject to possible
escalated action. Mailing instructions for submitting rescission request are listed on the bottom of the form. You
will be notified when the rescission process has been completed.
