In regards to our COC Number NCG030447, it has become apparent that we are now in Tier III
due to sample results that show our copper levels are above benchmark for the fourth time during
the term of this permit. On February 24'h of 2016 Caterpillar Sanford and Clayton EHS staff
contacted Ken Pickle to discuss previous actions, future plans and to seek guidance for both zinc
and copper.
Since the discovery of benchmark exceedances in copper and zinc we have had many discussions
with a range of Caterpillar staff, including upper management, and Divisional EHS staff. Both
internal and external housekeeping efforts have been improved, products that contain both
constituents have been tracked, and stormdrain filters and socks have been strategically deployed
to slow the exposure of metals. One staff member also attended the recent NCMA Annual Water
Quality Compliance Workshop.
We have been, and continue to, perform monthly sampling due to our previous Tier Two status.
Unfortunately there are not enough data points from samples to satisfy a conclusion of
improvement or solution from these efforts. Any assistance would be appreciated. To date we
have had the last two month's samples come back under benchmark for copper and zinc. Our
plan, if the March sample comes back under benchmark, is to return to biannual sampling. We
would sample in June and then again in the September -November timeframe.
As we discussed with Ken we will be diligent in preventing and controlling this exposure via
process and/or engineering improvements that are within technical and financial means.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal,ncdenr.ore/web/wq/ws/su/current,-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On June 22, 2010, 1, Vicki Webb, of the Raleigh Regional Office conducted a compliance evaluation
inspection of the subject facility. You represented the facility during the inspection. All of your help was
appreciated as it eased the inspection process.
The following observations were made:
1. The Caterpillar Inc. is permitted to discharge stormwater into the receiving waters designated as
an unnamed tributary to Gum Fork, class WS IV water, in the Cape Fear River Basin.
2. Caterpillar Inc. is located at: 5000 Womack Rd., Sanford, NC in Lee County.
3. All components of the Stormwater. Pollution Prevention Plan (SP3) were present including:
detailed site map with labeled storm outfall, a list of potential contaminants, a spill and response
plan, a narrative describing BMPs, and a contact list of whom to contact in an emergency.
4. Qualitative and quantitative inspection records were available for review and appeared complete.

Stormwater Monitoring Forms and Documents.
Analytical monitoring performed on December 2, 2009 exceeded the bench mark for TSS. The
facility implemented Tier one response on December 20, 2009. Erosion was found to be the
culprit. The facility installed sedimentation fences and sowed grass seed around the area where
equipment is tested to help with erosion.
6. Stormwater from the site is channeled where it flows to a sediment pond prior to discharge. This
pond was cleaned in the summer of 2009.

We appreciate the visit in September and want to provide you with an update of the
action items that were identified during your inspection. Over the past month the
sediment basin has been cleaned out and the erosion area noted was repaired.
Copies of the monitoring reports for the past 3 years have been added to the on -site
records and Mike Outlaw with Atlantic Environmental Associates has agreed to provide
those going forward.
Since analytical reporting is not required until the last year of the permit annual
monitoring will not be conducted until that time.
Please see the attached storm water discharge monitoring report and letter from Tritest
stating the lower detection limit. This should address the discrepancy in the previous
monitoring report.

Total Toxic Organics sampling is applicable only for those facilities which perform metal finishing operations, manufacture semiconductors, manufacture electronic crystals, or
manufacture cathode ray tubes. For purposes of this permit the definition of Total Toxic Organics is that definition contained in the EPA Effluent Guidelines for the facility subject
to the requirement to sample (for metal finishing use the definition as found in 40 CFR 433. l 1; for semiconductor manufacture use the definition as found in 40 CFR 469.12; for
electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode ray tube manufacture use the definition found in 40 CFR 469.31).
Facilities that develop a solvent management plan to be incorporated into the Stormwater Pollution Prevention Plan may matte a request to DWQ that monitoring of total toxic
organics be waived. The solvent management plan shall include a list of the total toxic organic compounds used; the method of disposal used instead of dumping, such as
reclamation, contract hauling, or incineration; and the procedures for assuring that toxic organics do not routinely spill or leak into the stormwater. For those facilities allowed such a
waiver, the discharger shall include the following signed certification statement on the discharge monitoring report:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics (TTO), I
certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the stormwater or areas which are exposed to rainfall or stormwater
runoff has occurred since filing the last discharge monitoring report. I further certify that this facility is implementing the solvent management plan included in the
Stotmwater Pollution Prevention Plan."

The lead, results"were originally reported using a detection limit of 0.050 mg/L. Our
normal detection limit for lead is 0.005 mg/L. I do not know why the analyst reported the
lead at "a detection limit that differed from our normal one. However, the sample was
analyzed using the normal detection limit, and review of the data'showed no lead was
detected' at the normal reporting limit of 0.005.
Therefore, we have amended the report to reflect the proper detection limit, and our
quantified result for the sample was <0.005 mg/L.
I am sorry for any inconvenience this reporting error may have caused. The technician
who analyzed this sample is no longer with Tritest. Our new metals analyst will report
all metals for your client at the proper levels. The employees who review our reports are
also aware of this situation, and will hopefully catch any errors" in reporting levels before
the report is finalized.

On August 29, 2005, 1 conducted a stormwater compliance evaluation inspection of the Caterpillar facility in
Sanford, NC. Mike Outlaw of Atlantic Environmental Associates and yourself represented the facility during the
inspection. Your aid was greatly appreciated.
The Caterpillar Sanford facility discharges stormwater into an unnamed tributary of Gum Fork (Class WS IV) in
the Cape Fear River Basin. Most industrial processes are conducted within the plant though metal parts are stored
outside prior to use. The stormwater is directed into a drainage ditch on the perimeter of the property prior to
discharge. Sediment fences are in place at sites around the property. Chemicals are stored outside in a tank farm
which contains secondary containment and an alarm. Stormwater from the proving ground flows into a sediment
pond prior to discharge. According to DWQ records and our conversation, the facility has had no spills that have
reached the surface waters during the last three years.
There appeared to be erosion damage near the drainage ditch prior to the sediment fences. Also, at the time of the
inspection, the sediment pond required cleaning. According to Mr. Outlaw both of these areas are scheduled for
maintenance within the month.
Copies of the monitoring reports for the last three years should be kept on -site.
Analytical monitoring is only required during the first and last years of the permit if the facility meets the cut-off
concentrations as defined within the general permit. The Caterpillar facility meets these requirements and is,
therefore, not required to conduct analytical monitoring until the last permit year. However, if you choose to
continue analytical monitoring, the facility is required to submit the data to DWQ in the monitoring reports.
For total lead concentrations, the lab analyzing your samples has reported concentrations of < 0.50 mg/L,
significantly higher than the cut-off concentration. This data was then passed to the DWQ in the monitoring
reports. After a conversation with the lab, Mr. Outlaw stated that the limit of detection for lead is actually 0.003
mg/L and that no lead had been detected at these levels. Please submit to the DWQ a revised monitoring report
for Spring 2005 that reflects this new information. I also ask that you submit a letter to me at the Raleigh
Regional Office explaining the discrepancies to be included in your permit file.

This memorandum is to provide a summary of our project in Sanford, North Carolina and
request NC DENR provide a letter of determination that air and water quality permits are
not requiredfor this project. DENR's expeditious completion would be most helpful.
We are constructing a 77,500 square foot manufacturing facility which will be leased to
Caterpillar Logistics. The manufacturing facility will be located on Elwin Buchanan
Drive in Sanford, NC. Also, we plan. to add an additional 50,000 square feet to the
existing building as Caterpillar. Logistics expands its volume. The manufacturing process
will not change with the addition space.
Summary of Manufacturing Process by Caterpillar Logistics:
Caterpillar Logistics is part of Caterpillar, a world wide leader in the manufacture of
construction and mining equipment, engines and gas turbines. Caterpillar Logistics provides a
full range of logistics services to Caterpillar and third party clients through a network of
manufacturing facilities. Lee County will be the home of Caterpillar Logistics' newest
assembly facility to scree the Caterpillar skid steer loader plant located at Lee County
Industrial Park in Sanford. The new facility in Sanford will involve the assembly of engine,
hydraulic tank, and tire/rim parts that arrive from various locations — this means this facility
will be responsible for third -part. logistics, receiving production materials and providing
sub/light assembly services for the Caterpillar plant locatedin the industrial park The new
facility will operate two shifts with approximately 30 employees,
Specifically, Caterpillar Logistics will complete the following manufacturing processes:
1. Tire and Rim sub -assembly process
2. Engine sub -assembly process

Caterpillar Logistics will use manual and air -powered tools to complete the manufacturing
process.
Caterpillar Logistics will not use any paint, chemicals, or hazardous materials of any kind. In
their manufacturing process, no resulting by-products are produced as this is an assembly
facility. Likewise, no exhaust or air emissions of any kind occur due to their assembly
process. County water and sewer will be utilized. Normal HVAC will be provided
throughout the building.
SurnmNy of Building Construction:
The new manufacturing facility will be located on 12,97 acres of land on the comer of
Deep River Road and Elwin Buchanan Drive in Lee County Industrial Park. This
property is approximately 1.3 miles from the existing Sanford Caterpillar. facility.
The new facility will be a 77,500 square foot facility with expansion capability to .
125,000 square feet.
The facility will have a 30' eave height, 12 depressed dock doors, two drive-in doors, a
26,000 pound air compressor, sprinkled to specifications of NC State Fire Code, six 36"
fans for cooling, 2,500 square feet of office space, 40 tractor -trailer parking spaces, 30
car parking spaces, and all roads and driveways paved with curbs and gutters.
Lee Central LLC is .financing this project with tax free bonds and requests that NC
DENR provide a letter of determination that air and water quality permits are not required
for this project.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger

withow coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983,

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002, The Division staff is currently in the process of rewriting [his permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at.least $250.00. Larger
pcnalIies may he assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of' "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will he notified when the
rescission process has been completed.
