This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1, the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended) and in accordance with the November 14, 2013 Settlement Agreement between Eaton Corporation and NCDENR. This permit modification clarifies that the permit covers all stormwater discharges from industrial activities at the facility, including the discharges from your onsite stormwater retention pond. The engineer's statement included with your recent application has certified that work has been completed to change onsite stormwater drainage to assure that impacted groundwater is no longer infiltrating into the storm drain system. You should note that this permit is for stormwater discharges only and any wastewaters from your site, now or in the future, would need to be addressed by permit coverage through the NC Division of Water Resources (DWR). It is our understanding of the November 14, 2013 Settlement Agreement that adherence to the conditions of the agreement and issuance of this stormwater permit supersedes previous permit coverage, including NC0.003379. Box 241 Roxboro, NC 27573 Subject: Compliance Evaluation Inspection Eaton Corporation — Roxboro Plant NPDES Permit NCO003379 NPDES Stormwater Permit NCG030027 Person County Dear Mr. Pienkosz: The subject inspections were conducted by Mitch Hayes of the Raleigh Regional Office on November 30, 2011. Your assistance with this inspection was greatly appreciated. Please find the attached Basin Wide Information Management System (BIMS) inspection checklists summarizing the inspection. Below is a list of findings and recommendations developed from the inspection: NPDES Permit NC0003379 was reissued March 07, 2008 and became effective April 01, 2008. The permit will expire January 31, 2013. Permit renewal is required 6 months prior to permit expiration date. The Division of Water Quality database Basinwide Information Management System (BIMS) indicates that the 2011 permit annual fee due January 19, 2011 has not been paid. Failure to pay annual permit fees is subject to permit revocation. Not having a permit to discharge waste is subject to enforcement action. BIMS lists you, Craig Pienkosz, Physical Chemical — 1 certified (PC-1), as the Operator in Responsible Charge (ORC). You stated that Gary A. McDaniel will be the back-up ORC (bORC) pending passing the PC —1 exam. 2. The facility is currently monitoring for ground water contamination. The NPDES Permit NC0003379 does authorize stormwater, with potential groundwater seepage, to be discharged. There are 30 monitor wells and 6 recovery wells on site. The 0.022 MGD wastewater treatments facility consists of the following units: oil / water separator and metal precipitation system. Oil and chemical spills are sent to an oil 1 water separator, a unlined stormwater detention basin with a 7.5 hp surface aerator, a diffused bubbler aerator, a 60 degree V-notch weir, a Prosonic ultrasonic flow meter, and a telemetry system to warn if the aerators are off line. The aerators are on separate electrical breakers to provide redundancy. 3. At the time of inspection, aerators, flow meter and telemetry were operational. The flow meter is calibrated once a year. Effluent discharging into the drainage ditch, Discharge Outfall 001, appeared somewhat cloudy most likely due to the mixing of water from the aerators in the unlined basin. Ultrafiltered recovered oil from the oil 1 water separator is sold and water is discharged to the City of Roxboro Privately Owned Treatment Works (POTW). Ground water is air stripped and discharges to the City of Roxboro POTW. There is no process wastewater that is discharged from the facility. 4. You are certified, NC Certification # 5426, for the parameter pH. Temperature on the pH meter is used for reporting and is checked with an NIST thermometer annually. The facility contracts out Tritest to analyze volatile organic compounds, and ENCO Labs in Cary, NC to analyze all other parameters. Commercial lab results, chain of custody records, and bench sheets were compared with data submitted on the Discharge Monitoring Report (DMR) for the month of July 2011. No discrepancies were noted. 5. Discharge Monitoring Reports (DMR's) for the period January 2010 through September 2011 were reviewed for compliance with permit limits and monitoring requirements. The following violations were noted: • Toxicity was not reported for the October 2010. Permit requires that annual acute toxicity monitoring be performed by June 30. Toxicity results must be entered on the effluent DMR form for the month in which it was performed. In addition, toxicity results on DWQ form AT-1 must be sent to the Environmental Sciences Section. Please send an amended DMR with the results for the month which the toxicity test was sampled. • Temperature and pH for November 2010 was incorrectly reported on the DMR for November 2010. These values were reported in the average column. Please send in an amended DMR. • Permit limit violation for trichloroethylene was noted for January 26, 2011. This violation has been addressed. NPDES Stormwater Permit NCG030027 6. The Stormwater Permit NCG030027 was issued and became effective November 01, 2007 and expires October 31, 2012. Permit renewal is required 6 months prior to permit expiration date. 7. Stormwater drains and flows into a series of underground piping throughout the facility and above ground drainage ditches to same unlined stormwater detention basin as described for NPDES Permit NC0003379. The water in the detention basin appears to be more ground water driven than stormwater driven. As noted in item 3, effluent was discharging and appeared somewhat cloudy most likely due to the water being aerated in the unlined basin. Stormwater flowing from the northwest side of the property flows into a concrete lined ditch and discharges into a wooded area. This area receives rooftop and parking lot drainage that are not associated or comingle with industrial activities on site and therefore do not require monitoring. The west side of the property contains an area that collects metal chips in a trailer that is housed under cover. Wooden pallets are also stored in this area although the pallets are picked up for recycling 3 times a week. This area also has 3 Above Ground Storage Tanks that have a concrete secondary containment wall. Stormdrains on the west side of the property are routed to the stormwater detention basin. 8. A copy of the permit was available at the time of inspection. A Stormwater Pollution Prevention Plan (SPPP) has been developed and contained all permit requirements. Employee training on safety and cleanup procedures was completed October 2011. Facility site inspection is done once a week. Analytical monitoring was last completed in December 2011. Roxboro, NC 27573 Dear Mr. Pienkosz: Natural Resources Subject: Stormwater Compliance Evaluation Inspection NPDES permit no. NCG030027 Eaton Automotive Parts Plant, Roxboro Person County Dee Freeman Secretary On May 6, 2010 Ms. Autumn Romanski and I conducted a stormwater inspection with you. We greatly appreciated the time and help you gave us. The storrnwater program was in compliance and the plan was being followed in every detail, except that when the permit had been renewed in 2007 the company apparently did not receive a copy. Therefore, the few changes in monitoring have not been implemented. Any omission is a moot point in light of DWQ conclusions from this inspection, as explained below. Details Semi-annual analytical sampling required by the 2007 permit includes TSS and Pb. Instead, by following the previous version of the permit, Settleable Solids had been run, and there were no Pb tests in the stormwater database. However, the same discharge point from the aerated pond had been sampled monthly to meet requirements found in wastewater permit NC0003379. The overlapping parameter list provided the omitted data for all but TSS and Pb. This extensive database showed compliant levels for all stormwater parameters. There is one action identified during the tour around the plant that needs attention. The grate over a concrete stormwater discharge point had been damaged when a truck ran over the grate, so a small amount of debris and vegetation has accumulated in the box. This structure should be cleaned out and a new grate installed, steps you agreed would be taken. Our tour around the plant revealed excellent housekeeping and the absence of any potential pollutants by exposure to rainwater. Our office is able to offer a No Exposure certificate letter for conditions such as these, which would replace the existing stormwater permit. in fact, the present permit would be rescinded at the same time the No Exposure is granted. if the Eaton Corp. wishes to make this change, submit an application found at httj2:Hportal.nedenr.org/�web/wq/ws/su/npdessw#No Exposure NPDES. A review of the plant records indicated that all records are being kept as required. A comparison of the December 2006 and June 2007 DMRs indicated minor discrepancies. The June 2007 chain of custody for effluent samples lacked collection date and time. December 2006 indicated no discrepancies. 4. Mr. Adam Yasin is the ORC and at the time of the inspection there is not a back up ORC. Klimek, P.E., Director Division of Water Quality I conducted a compliance evaluation inspection of the Eaton Roxboro plant on October 25, 2005. You represented the facility during the inspection. Your assistance with the inspection was greatly appreciated. The Eaton plant contains a Physical/Chemical 1 water pollution control facility that consists of a retention basin, surface aerator, and ultrasonic flow meter. Effluent discharges into an unnamed tributary of the Flat River within the Neuse River Basin. You are the operator in responsible charge (ORC) and Jim Fesperman is the backup ORC. A file review was conducted prior to the inspection. The facility has had one limit violation within the last twelve months — in March 2005 for tetrachloroethylene. No spills have been reported in the past year. A letter was sent to the facility from DWQ in October 2005 concerning the use of incorrect parameter codes for tetrachloroethyiene and trichloroethylene on the August 2005 DMR. A comparison of March 2005 and July 2005 DMRs to facility's records did not show any discrepancies. Effluent flow was measured using an ultrasonic flow meter. In conversation you stated that the flow meter has been calibrated annually by Mr. Fesperman though you did not have paperwork documenting the last calibration available at the time. Please send a copy of the calibration record for 2005 to the DWQ Raleigh Regional Office by November 18, 2005. The Stormwater Pollution Prevention Plan was reviewed during the inspection. This plan has been revised annually by you. All employees and contractors at the plant undergo some form of spill management training. The BMPs currently being used seemed to be sufficient. A visual examination of the stormwater drainage ditches showed areas vegetation growth within the ditches. The ditches should be cleaned. The laboratory records reviewed were satisfactory. Single use pH buffers are used for calibration of the pH meter. During the inspection, effluent samples were stored in a refrigerator prior to analysis. However the refrigerator did not contain a thermometer to insure that the proper temperature (1.0 — 4.4° C) is maintained. I recommend that a thermometer be placed in the refrigerator and checked routinely. Klimek, P.E., Director Division of Water Quality This writer, of the NCDENR, conducted an inspection of the Eaton Corporation Roxboro Facility (NPDES Permit Nos. NCO003379 & NCG030027) on February 25, 2005. You, Facility ORC with PC-2 Certification, represented the Plant during the inspection. Your assistance was greatly appreciated. (Mr. Jim Fesperman is the Facility Backup ORC, also with PC-2 Certification.) Findings during the Inspection are as follows: 1) This Physical/Chemical-1 Water Pollution Control Treatment Facility consists of a retention basin, with surface aerator, that is the collection point for non -contact cooling water and stormwater (with groundwater seepage). 2) A review of the DMR data for the 12-month period from January 2004 through December 2004 was performed prior to this Inspection. The DMR's indicated compliance with permit limitations with the exception of daily limit violations for tetrachloroethylene on January 10, 2004 and April 12, 2004. These violations were addressed in a previous Compliance Evaluation Inspection Report dated July 15, 2004. 3) It was noted that the Total Nitrogen Load for 2004 was not included on the December 2004 DMR as required in Part I A (3) of Permit No. NC0003379. Subsequent to this Inspection you reported that this DMR had been amended and resubmitted. 4) Please begin measuring and reporting significant rainfall events (0.25 inches/day or greater) that cause a discharge of stormwater and groundwater seepage from outfall 001. Effluent samples for TCE and PCE shall be collected during or directly after such rain events. (See Part i A (2) of Permit No. NC0003379.) 5) Please begin monitoring all volumes of wastewater discharged from outfall 001. (See Part I A (1), Footnote 1 of Permit No. NC0003379.) Monitoring results shall be reported on the DMR. (See Part II D 2 of Permit,No. NC0003379.) 6) A random comparison of bench note and contract lab data with the Discharge Monitoring Reports for November 2004 was made. No discrepancies were noted. 7) Please begin maintaining a log as Per NC Administrative Code Section: 15A NCAC 2113.0506 (c) (3) — see attached. The log should include dates and times of visits and document proper process control monitoring. 8) The Facility's Storm Water Pollution Prevention Plan was reviewed during this inspection. Facility personnel receive site -specific training on the Plan annually. All of the Facility's stormwater discharge points were viewed during this inspection.
